Work Detail

1. The Subject Of The Order Is The Construction Of A Photovoltaic Installation On The Building Of Primary School No. 1 In Komorniki, Ul. Staszica 25, 62-052 Komorniki, Plot Registration Numbers: 301/5, 301/6 And 301/9, Registration District: 302107_2.0003, Komorniki, Pozna Poviat, Greater Poland Voivodeship.2. The Subject Of The Order Includes Comprehensive Design And Construction Of: A System Of Photovoltaic Modules Generating Electricity, Installed On The Property Owned By The Komorniki Commune.3. The Detailed Scope Of Work Is Described In Annex 1 To The Draft Provisions Of The Contract.4. The Task Will Be Carried Out In An Active School Facility Where Classes Are Held For Approximately 900 Students. Therefore, The Contractor Is Obliged Not To Disturb The Functioning Of Primary School No. 1 In Komorniki And To Ensure Safety For Children Attending School.5. The Installation Elements That Are The Subject Of The Order Must Be Brand New, Free From Manufacturing Defects And From Liabilities To Third Parties. Photovoltaic Panels And Inverters Should Be Produced No Earlier Than 2023.6. The Terms Of Execution Of The Order Are Described In Annex No. 8 To The Swz (Drafted Provisions Of The Contract).7. The Contractor Is Obliged To Specify In The Offer Form What Photovoltaic Panels And Inverters He Offers.8. The Ordering Party Does Not Divide The Order Into Parts. Therefore, The Ordering Party Does Not Allow The Submission Of Partial Offers Referred To In Art. 7 Point 15 Of The Public Procurement Law. Reasons For Not Dividing: The Subject Of The Order Constitutes An Inseparable Whole, All Works Are Interconnected And It Is Not Possible To Separate A Separate Scope To Allow For The Submission Of Partial Offers. Failure To Divide The Contract Into Lots Does Not Distort Competition In The Procedure.9. The Ordering Party Does Not Envisage The Possibility Of Awarding Contracts Referred To In Article 214(1)(8) Of The Act. 10. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Tasks. 11. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. In Such A Case, He Is Obliged To Provide In Annex No. 1 To The Swz - Bid Form, Information About The Part Of The Order The Execution Of Which He Intends To Entrust To Subcontractors And Provide The Names Of Their Companies, If They Are Already Known. Entrusting The Performance Of Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of This Order. The Contractor May Change Or Resign From The Subcontractor. 12. Equivalent Solutions: In The Case Of Names Of Materials Used In The Documentation Of The Procedure, They Should Be Understood As Examples - With The Parameters Desired By The Ordering Party. This Means That The Ordering Party Allows In Each Case The Use Of A Material Equivalent In Terms Of The Main (Essential) Technical And Operational Parameters, While Maintaining At Least The Same Level Of Quality, Durability, Functionality And Compatibility With Other Materials Used (Built-In) During The Execution Of The Order. Only Such Changes In Materials Are Allowed That Are Within The Scope Of The Included Construction, Technological And Technical Solutions. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents Confirming The Parameters Of The Materials And Equipment. If The Contractor Intends To Use Any Solutions Or Equivalent Materials, He Is Obliged To Describe Them In Detail In The Offer And Demonstrate Their Equivalence. Pursuant To Art. 101 Section 4 Of The Public Procurement Law If The Documents Describing The Subject Of The Contract Include A Reference To Standards, Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, And Such References Were Not Accompanied By The Expression Or Equivalent, The Ordering Party Allows Solutions Equivalent To Those Described In Each Such Standard, Technical Assessment, Approval, Technical Specification, Technical Reference System. Due To The Above, It Should Be Assumed That Each Standard, Technical Assessment, Approval, Technical Specification, System Of Technical References Appearing In The Description Of The Subject Of The Contract Is Accompanied By The Words Or Equivalent. Pursuant To Art. 101 Section 5 Pzp, The Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove, By Attaching To The Offer, Appropriate Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Order To An Equivalent Extent. The Ordering Party Allows The Possibility Of Submitting Equivalent Offers Regarding The Proposed Materials And Devices Presented In Annex No. 1 To The Draft Provisions Of The Contract, Provided That They Have Technical Parameters, Not Worse Than That Required By The Ordering Party. The Offered Equipment And Equivalent Materials Must Have Appropriate Certificates Or Approvals For Commercial Trading Required By Law.13. Requirements Regarding The Employment Of Persons By The Contractor Or Subcontractor On The Basis Of An Employment Relationship: The Ordering Party Shall Require The Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship Of Persons Performing The Following Activities In The Scope Of The Execution Of The Order, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 1 Of The Act Of June 26, 1974 - Labor Code. Type Of Activities Necessary For The Execution Of The Order To Which The Requirements Apply To Employment Under An Employment Relationship By The Contractor Or Subcontractor Of Persons Performing Activities During The Execution Of The Order: Persons Assembling The Installation. Method Of Verifying The Employment Of The Above-Mentioned. Persons, The Employers Rights To Control The Contractors Compliance With The Requirements Related To The Employment Of Persons And The Sanctions For Failure To Meet These Requirements Are Specified In 5 Of The Draft Provisions Of The Contract (Appendix No. 8 To The Swz).14. Warranty And Warranty For The Photovoltaic Installation: - Pv Panels Must Have A Minimum Warranty. 10 Years Max. 15 Years And 25 Years For Min. 80% Capacity (Subject To Assessment); - Inverters Must Have A Minimum Warranty. 10 Years Max 15 Years (Subject To Assessment), - The Structure Must Have A Minimum Warranty. 10 Years (Not Subject To Assessment), - Other Installations Must Have A Minimum Warranty. 5 Years Max. 6 Years (Not Subject To Assessment) - Assembly Works In Accordance With The Offer Min. 5 Years Max 6 Years (Not Subject To Assessment). The Contractor Is Obliged To Specify In The Bid Form What Warranty It Offers For The Above Order Elements. The Scope Of Warranty Rights Is Regulated By The Provisions Of The Civil Code.
