Detailed Description Of The Subject Of The Order: 1) The Provision Of Specialist Care Services Will Be Carried Out Based On The Provisions Of: A) The Act On Social Assistance Of March 12, 2004 (Consolidated Text: Journal Of Laws Of 2023, Item 901, As Amended); B ) Act On Mental Health Protection Of August 19, 1994 (Consolidated Text: Journal Of Laws Of 2022, Item 2123, As Amended); C) Regulation Of The Minister Of Social Policy Of September 22, 2005 On Specialized Care Services ( Journal Of Laws Of 2005, No. 189, Item 1598, As Amended), Hereinafter Referred To As The Regulation.2) The Task Of The Contractor Of The Subject Order Is To Provide Specialized Care Services For People With Mental Disorders.3) The Task Of The Contractor Of The Subject Order Is To Provide Specialist Care Services Max. 3 Hours Per Day Per Person, Monday To Friday From 700-2000 For People Residing In The Pilzno Commune, Indicated By The Ordering Party In The Period Until December 31, 2024. 4) The Parties Allow The Possibility Of Reducing Or Increasing The Number Of People And Hours In The Scope Of Services Provided, To Meet The Needs Of The Ordering Party, And Their Actual Amount Will Result From From Actually Completed Hours. In The Event Of A Reduction Or Increase In The Number Of Hours, Payment Will Be Made For The Hours Actually Completed. In Such A Case, The Unit Prices Offered By The Contractor Will Remain Unchanged.5) The Ordering Party Reserves The Right To: A) Substantive Control Of The Services At The Place Of Their Provision; B) Correction Of Service Hours For Persons Qualified To Use The Services; C) Individual Conversation With The Contractors Employees /Contractor Providing Services Covered By This Agreement;D) Submit A Request To The Contractor To Change The Person Providing The Services, If There Are Circumstances Justifying The Change;6) The Contractor May Only Admit Persons Who Meet The Conditions Specified In 3 Of The Regulation To Provide Specialized Care Services;7) To Provision Of Specialized Services, The Contractor May Not Refer Persons Who Are Members Of The Beneficiarys Immediate Family Or Those Who Do Not Ensure Impartiality And Objectivity Of Action;8) Persons Participating In The Performance Of The Order Must: Be Physically And Intellectually Fit, Available, Cultural, And Have The Ability To Maintain Proper Interpersonal Contacts , Will Undertake To: Maintain Professional Secrecy Regarding Information They Obtain In The Course Of Performing Their Duties, And In Particular Not To Disclose This Information During The Provision Of Services And After Termination Of Employment. The Person Providing The Service Should Have A Photo Id. The Service Provider May Not Introduce Unauthorized Persons To The Place Of Provision Of Services, And May Not Smoke, Use Drugs, Intoxicants Or Consume Alcohol While Providing Services. The Services Must Be Performed With Respect For The Dignity And Feelings Of This Person, In Compliance With Generally Accepted Social Norms;9) The Contractor Himself Organizes Training In The Field Of Personal Data Protection, Method Of Arrival At The Place Of Performance, Costs Of Telephone Calls, Preventive Examinations, Personal Accident Insurance And Occupational Health And Safety Training;10) Information On The Provision Of Services, Their Scope, Date And Amount Will Be Provided In Writing By The Person Designated By The Ordering Party On The Basis Of An Administrative Decision Issued By The Ordering Party And An Individual Educational And Therapeutic Program;11) The Ordering Party Reserves That The Number Of Hours Multiplied By The Amount Resulting From The Selected Offer May Not Exceed The Amount Of Pln 1,504.70 Per Month Per Person.12) In Emergency Cases, The Contractor Is Obliged To Take Action Without Undue Delay After Being Notified By The Ordering Party;13) In A Situation Where The Termination Of The Provision Of Services Takes Place Earlier Than Specified The Decision, The Ordering Party Will Immediately Inform About It In Writing; 14) Service Provision Time Means The Time Of Performing The Ordered Scope Of Services. The Ordering Party Reserves That The Time Of Providing Services Does Not Include The Time Of Travel Or Arrival To The Place Of Provision Of Services. 1 Hour Means 60 Minutes;15) The Size Of The Services Provided, The Type And Date Of Their Implementation Must Be Consistent With The Issued Administrative Decision. In A Situation Where The Person Providing The Services Cannot Perform Them Within The Deadlines Set For Any Reason, The Contractor Is Obliged To Provide A Replacement, But The Replacing Person Must Necessarily Have Equivalent Or Higher Qualifications;16) The Contractor Is Obliged To: A) Appoint A Person Responsible For Contacts With The Ordering Party, Which Will Be Obliged To Prepare A Monthly List Of Beneficiaries, Including The Hours Worked And The Amount Of Payment For Services In Accordance With Annex No. 2 To The Draft Contract; B) Inform In Writing The Contact Person On The Ordering Partys Side About The Commencement Of The Provision Of Services, Providing The Details Of The Person Providing The Services (Name, Name, Telephone Number) In A Given Environment No Later Than On The Day Of Their Commencement. In The Event Of A Change In The Person Providing The Services, The Contractor Immediately Informs The Ordering Party, E.G. By Phone, Providing The Details Of The Person Currently Providing The Services, Who Must Have Equivalent Or Higher Qualifications, And Then Confirms The Situation In Writing Along With The Qualifications And Experience Of The Service Provider; C) Introduce The People Providing The Services To The Environment Services. At The Request Of The Ordering Party, The Introduction Of A Person To A New Environment Should Take Place With His Participation; D) Inform The Ordering Party About Events That May Affect The Provision Of Services; E) Cooperate On An Ongoing Basis With Persons Designated By The Ordering Party To Perform The Contract; F) Keep The Required Documentation Of The Services Provided In The Form Of: Monthly Time Sheets For Specialist Care Services With Signatures Of The Beneficiaries (And In The Case Of Children, By Their Parents Or Legal Guardians), In Accordance With Annex No. 1 To The Draft Contract, And Monthly Descriptive Reports On The Implementation Of Specialist Care Services, Including An Assessment Of Psychosocial Functioning Person, Services Provided And Results Achieved; G) Comply With The Principle Of Continuity Of Provision Of Specialized Care Services For People With Mental Disorders By The Same Person.17) The Contractor Is Obliged To Comply With The Recommendations Of The Chief Sanitary Inspector And Relevant Ministries Regarding The Pandemic.18) The Contractor Cannot Charge No Additional Fees From People Providing Specialist Care Services.
