1. The Subject Of The Order Is The Successive Delivery Of Milk And Dairy Products For The Needs Of The Social Welfare Home In Zawiercie. 2. The Detailed Type Of Assortment And Scope Of The Order Are Specified In The Assortment And Price Form Constituting Annex No. 3 To The Swz. The Quantities Of Individual Goods Given In This Form Are The Quantities Expected By The Ordering Party, Which Were Adopted In Order To Compare Offers And Select The Most Advantageous Offer. The Ordering Party Reserves The Right To Change The Quantity Of Individual Goods Depending On Current Needs While Maintaining Unit Prices And Up To The Amount Of The Future Public Procurement Contract And The Right To Limit The Order By A Maximum Of 20% Of Its Scope. 3. Goods Covered By The Order And The Method Of Their Delivered To The Ordering Party Must Be In Accordance With The Provisions Of The Specification Of Order Conditions, The Product And Price Form, The Standards And Approvals Applicable To The Subject Of The Order And The Provisions Of Law. 4. The Place Of Delivery Is The Registered Office Of The Ordering Party: Ul. Rzemie lnicza 9, 42-400 Zawiercie.5.The Execution Of The Order Must Be Consistent With The Principles Of The Haccp System Implemented And Used In The Contractors Plant.6.Delivery Will Be Made Successively, Depending On The Current Needs Of The Ordering Party On The Basis Of Separate Orders Specifying Min. Quantity, Product Range And Delivery Date. Orders Will Be Placed By The Ordering Partys Representatives In A Previously Agreed Manner: By Phone, E-Mail Or In Person. 7. The Ordering Party Requires Deliveries To Be Made On Business Days, Six Times A Week. 8. The Contractor Will Ensure Deliveries Within 2 Business Days From The Date Of Placing The Order, Between 07:00 And 08:00 In The Morning. If The Delivery Date Falls On A Public Holiday, Delivery Will Be Made On The Business Day Preceding That Day. 9. The Moment Of Delivery Will Be Deemed To Be The Delivery Of The Ordered Goods To The Ordering Partys Food Warehouse. Each Time, The Ordering Partys Representative Will Carry Out Quantitative And Qualitative Acceptance Of The Goods. 10. The Contractor Will Deliver The Goods To The Ordering Party Using A Means Of Transport Adapted To Transport Food In Accordance With Applicable Regulations. 11. Upon Each Written Request Within The Deadline Specified By The Ordering Party, The Contractor Will Present (If Applicable): A) Decision Of The State District Sanitary Inspector For The Means Of Transport, Which Allows The Transport Of Milk And Dairy Products, B) Current Medical Certificate From The Examination For Sanitary And Epidemiological Purposes Of The Person Delivering The Goods. 12. The Contractor Will Be Obliged To Deliver Goods: A) Of The First Quality, Approved For Sale In Accordance With Applicable Requirements, Standards And Approvals, B) Fresh, Clean, Undamaged, Without Foreign Odors, C) With A Weight In Accordance With The Contract And Order, D) In The Quantity In Accordance With The Order. 11. The Packaging Of Goods Should Enable Their Identification In Accordance With The Commercial Document. 12. The Contractor Will Ensure The Packaging Of The Goods: A) In Accordance With Sanitary Guidelines, B) Clean, Protecting Against Loss Of Food Properties And Taste, C) Protecting Against Dirt Or Damage During Transport. If The Nature Of The Goods Requires It, The Contractor Will Deliver It In Additional Packaging With The Characteristics As In The First Sentence. 13. Packaging Of The Producers Of The Delivered Goods: A) Must Not Show Signs Of Tampering With The Factory Seal, Damage Or Dirt, B) Must Have Printed Information At Least About Name Of The Food, Information About The Manufacturer, Expiration Date. 14. Detailed Conditions For The Execution Of The Order Are Described In The Draft Provisions Of The Future Procurement Contract (Appendix No. 1 To The Swz). 15. Division Of The Order Into Parts: The Ordering Party Does Not Divide The Order Into Parts, Thus Does Not Allow The Possibility Of Submitting Partial Offers Referred To In Art. 91 Of The Public Procurement Law.1) Reason For Not Dividing The Order Into Parts: The Ordering Party Does Not Divide The Order Into Parts Due To The Homogeneous Nature Of The Order And The Product Range Constituting Its Subject. Entrusting The Order To One Contractor Makes It Possible To Develop Efficient Cooperation Between The Parties Without The Ordering Party Having To Engage Additional Personnel Resources To Coordinate The Task Being Performed, While Not Generating Further Costs.2) Each Contractor Has The Right To Submit Only One Offer. A Situation In Which The Same Entity Appears In Two Or More Offers Submitted Jointly Or Is An Independent Contractor And At The Same Time Participates In A Joint Offer Will Be Considered Equivalent To The Submission Of More Than One Offer. 16. The Ordering Party Does Not Allow The Submission Of Variant Offers. 17. Submitting A Larger Number Of Offers Or An Offer Containing Variant Proposals Will Result In The Offer Being Rejected. 18. Electromobility: The Contractor Will Be Obliged To Apply The Current Requirements Resulting From The Provisions Of The Act Of January 11, 2018. On Electromobility And Alternative Fuels And Ensuring The Share Of Electric Or Natural Gas-Powered Motor Vehicles In The Fleet Of Motor Vehicles Used In The Performance Of The Subject Of The Contract In The Number Resulting From The Above Act. No Later Than On The Day Of Concluding The Public Procurement Contract, The Contractor Will Submit To The Ordering Party A Declaration On The Adaptation Of The Fleet Of Motor Vehicles Used In The Performance Of The Contract To The Requirements Of January 11, 2018. On Electromobility And Alternative Fuels (If There Are Circumstances Arising From The Provisions Of This Act) Or A Statement Showing That The Number Of Motor Vehicles Used To Complete The Order Does Not Require The Use Of Electric Or Natural Gas-Powered Motor Vehicles In The Form Specified In The Draft Provisions Of The Future Contract Regarding The Order (Appendix No. 1 To The Swz). The Contractor Will Be Obliged To Submit The Above Declaration Whenever It Is Necessary To Update The Information Provided To The Ordering Party In The Initial Declaration (Before Signing The Contract). 19. The Ordering Party Does Not Envisage Awarding Orders Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law
