Iii.1. The Subject Of The Order Is The Delivery Entitled: Delivery Of Food Products To Educational Institutions Of The Klemt w Commune In The First Half Of 2024. Iii.2. Scope Of Implementation Of The Subject Of The Order: The Ordering Party Orders, And The Contractor Undertakes To Deliver, Food Products, Referred To In The Contract As Goods Or Products, The Range, Quantity And Quality Of Which Are Specified In The Price Form, Constituting Annex No. 1A To The Terms Of Reference (Swz).Form Price, Constituting Annex No. 1A To The Terms Of Reference (Swz), Applies In Particular To: 1) Primary School. Janusz Korczak In Dobczyn, Ul. Mazowiecka 67, 05-205 Dobczyn;2) Primary School In Klemb w Named After Maj. Gen. Franciszka ymirski, Ul. Gen. Franciszka ymirsskiego 68, 05-205 Klemb w;3) Primary School In Stary Kraszew, Ul. Szkolna 5, 05-205 Stary Kraszew;4) Primary School. Polish Military Organization In Ostr wek, Ul. Delivery Of Food Products, Vegetables And Fruits, Sweets And Drinks. Each Part Of The Subject Of The Order Has A Separate Table To Be Completed In The Price Form, Constituting Annex No. 1A To The Swz (Table No. 1 - 4). The Ordering Party Reserves The Right To Change (Increase Or Decrease) The Quantity Of The Product Given In The Price Form Depending On The Number Of Children Using From The School Canteen During The Implementation Of The Above-Mentioned Subject Of The Order. In The Event Of Urgent Need, With The Consent Of The Contractor And If The Selected Product Is Available, The Ordering Party Allows For The Possibility Of Ordering An Assortment Other Than Those Listed In The Price Form, At Its Current Price Offered By The Contractor On The Date Of Placing The Order. The Ordering Party Allows The Use Of Equivalent Products, I.E. Products With Features And Qualities Not Worse Than Those Specified In The Swz. The Grammage Of The Offered Equivalent Product Cannot Be Lower Than The Grammage Of The Product Indicated In The Price Form. The Offered Equivalent Products Must Have The Same Organoleptic Properties (Taste, Smell, Color, Aesthetics, Consistency) And Contain The Same Raw Materials Used For Production As The Product Specified By The Ordering Party. Seasonal Products Will Be Ordered By The Ordering Party During The Period Indicated In The Price Form. The Contractor Undertakes To Deliver The Full-Value Goods Ordered By The Ordering Party Within The Dates And Quantities Specified By The Intendant - The Ordering Party By Telephone Or E-Mail. Delivery Of The Ordered Goods Will Take Place By 8:00 A.M. On The Day Following The Order Placement Or On Other Dates Agreed With The Ordering Party. The Ordering Party Allows For The Preparation Of A Delivery Schedule Between The Parties, Specifying Detailed Delivery Dates For Individual Products Specified In The Price Form. In Emergency Cases, The Ordering Party Reserves The Right To Order The Contractor To Make Ad Hoc Orders, In Which The Delivery To The Ordering Partys Headquarters Must Take Place Within 2 Hours From The Moment Of Ordering The Delivery. Reserves The Right To Select Individual Food Products According To Current Needs And The Purpose Of Their Purchase. The Delivered Goods Should Meet The Following Conditions: 1) They Must Be Marked With A Visible, Current Expiration Date, In Particular Products Such As: Meat, Dairy Products, Fruit, Vegetables And Bread , Should Be Delivered Fresh And Meet Applicable Quality Control Standards And 2) Have Appropriate Quality Specifications Or Certificates; 3) Have An Appropriate System For Transporting Goods - Maintaining The Separation Of Transport; 4) Have An Appropriate Temperature During Transport (Frozen Food Should Be Delivered In A Refrigerated Truck) And The Conditions Sanitary Conditions Of The Vehicle. Deliveries By Delivery Vehicle Should Be Carried Out While Maintaining Appropriate Sanitary Regimes Required For The Transport Of Food, In Accordance With The Act Of August 25, 2006 On Food And Nutrition Safety (I.E. Journal Laws Of 2023, Item 1448) And Other Currently Applicable Legal Provisions. The Contractor Will Deliver The Ordered Goods Using Its Own Transport, Including Unloading Them To The Premises Of Individual Educational Institutions: 1) Primary School. Janusz Korczak In Dobczyn, Ul. Mazowiecka 67, 05-205 Dobczyn; 2) Primary School In Klemb w Named After Maj. Gen. Franciszka ymirski, Ul. Gen. Franciszka ymirsskiego 68, 05-205 Klemb w;3) Primary School In Stary Kraszew, Ul. Szkolna 5, 05-205 Stary Kraszew; 4) Primary School Named After Polish Military Organization In Ostr wek, Ul. Warszawska 2, 05-205 Ostr wek;5) Municipal Childrens Club Klembu In Dobczyn, Ul. Mazowiecka 67, 05-205 Dobczyn;6) Primary School. Jana Paw a Ii In Krusz, Ul. Kryszta owa 99A, 05-240 Krusze. The Costs And Risk Of Delivering The Goods Are Borne By The Contractor, In Particular When The Food Products Are Delivered Inconsistently With The Terms Of Reference (Swz), Constituting Annex 4 To The Contract Or Are Delivered Inconsistently With The Order Placed By The Ordering Party. Ordering Party Undertakes To Accept And Examine The Goods Within One Day From The Date Of Their Receipt. If The Quality Of The Subject Of The Contract Is Questioned Or Its Defect Is Revealed, The Ordering Party Will Return The Goods To The Contractor, Who Will Consider The Complaint And Replace The Goods With Those That Comply With The Order And Are Free From Any Defects, In Within 2 Hours From The Moment The Complaint Is Accepted. The Complaint Should Include In Particular: The Day And Time Of Filing The Complaint, The Subject Of The Complaint, The Method Of Its Settlement And A Description Of The Sample Of The Complained Product Issued To The Ordering Party. If The Contractor Does Not Accept The Ordering Partys Complaint, The Ordering Party Will Purchase This Batch Of Goods From Another Supplier, And The Difference In Purchase Costs Will Be Charged To The Contractor. The Contractor Undertakes To Implement The Subject Of The Order In Compliance With The Following Provisions: 1) Act Of August 25, 2006 On Food And Nutrition Safety (I.E. Journal Laws Of 2023, Item 1448);2) Act Of December 21, 2000 On The Commercial Quality Of Agricultural And Food Products (Consolidated Text: Journal Of Laws Of 2023, Item 1980);3) Act Of December 16, 2005 On Products Of Animal Origin (I.E. Journal Of Laws Of 2023, Item 872);4) Regulation Of The Minister Of Health Of April 22, 2011 Amending The Regulation On Permitted Additional Substances (Journal Of Laws Of 2011, No. 91, Item 525);5) Regulation Of The Minister Of Agriculture And Rural Development Of June 22, 2020 Amending The Regulation On The Labeling Of Particular Types Of Food (Journal Of Laws Of 2020, Item 1149);6) Regulation Of The Minister Of Health Of 26 July 2016 On Groups Of Foodstuffs Intended For Sale To Children And Adolescents In The Education System Units And The Requirements That Must Be Met By Foodstuffs Used As Part Of The Collective Nutrition Of Children And Adolescents In These Units (Journal Of Laws Of 2016, Item 1154);7) Regulation (Ec) No. 852/2004 Of The European Parliament And Of The Council Of 29 April 2004 On The Hygiene Of Foodstuffs (Journal Of Laws U. L. 139 Of 30/04/2004, P. 1). The Obligations Of The Ordering Party Include: 1) Placing Partial Orders For The Delivery Of Individual Batches Of Goods, In Which The Ordering Party Will Specify The Assortment And Quantity Of The Ordered Food Products; 2) Accepting The Item In Terms Of Quantity And Organoleptic Properties. Contract At The Ordering Partys Headquarters Within The Agreed Hours; 3) Paying The Contractor The Amount Due For Food Products, Actually Delivered Batches Of Goods. The Contractors Obligations Include: 1) Each Confirmation Of Receipt Of The Order; 2) Delivering The Food Products Indicated In The Ordering Partys Partial Order Within The Specified Time And In Accordance With His Expectations;3) Delivering Fresh Food Products (First Quality), Suitable For Consumption With A Maximum Shelf Life (Not Shorter Than 1/2 Of The Shelf Life Specified By The Manufacturer);4) Delivering The Goods To The Ordering Party By Own Means Of Transport , At Its Own Expense And Risk, And To Respond Flexibly To The Increased Or Decreased Needs Of The Ordering Party In Relation To A Given Product Range Or The Entire Order; 5) Transport Of Food Products While Maintaining Proper Sanitary And Hygienic Condition, I.E. In Clean, Closed Containers Adapted For The Transport Of Food, Appropriate By Means Of Transport. The Contractor Declares That The Food Products Listed In The Price Form Meet The Health Quality Requirements In Accordance With The Act Of August 25, 2006 On Food And Nutrition Safety (I.E. Journal Laws Of 2023, Item 1448), In Particular In Compliance With The Principles Of The System Of Analysis And Critical Control Points (Haccp) By The Obligated Entities. To Ensure Food And Nutrition Safety, The Contractor Is Obliged To Have An Implemented Haccp System Of Hazard Analysis And Critical Control Points. The Draft Provisions Of The Agreement Regarding All Parts Of The Above-Mentioned. Public Procurement Proceedings, Constitute Annexes No. 4A, 4B, 4C And 4D To The Terms Of Reference (Swz).
