Detailed Requirements For The Implementation Of The Order Are Included In Annex No. 1 To The Swz - Description Of The Subject Of The Contract (Opz), Other Terms Of The Order Implementation Are Included In Annex No. 5 To The Swz - Draft Provisions Of The Contract.3. Based On Article. 95 Section 1 Of The Public Procurement Act, The Ordering Party Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Activities Specified By The Ordering Party In The Scope Of Contract Execution, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465, As Amended), I.E. Persons Performing Activities Related To The Execution Of The Order.4. Pursuant To The Content Of Art. 95 Section 1 Of The Public Procurement Act, The Ordering Party Requires The Contractor Or Subcontractor (Excluding Staff Employed By The Postal Agent Who Is Not A Subcontractor) To Employ, On The Basis Of An Employment Relationship, At Least 40 People Performing The Following Activities In The Execution Of The Order: Delivery Of Postal Items, Notification Of Delivered Postal Items, Accepting Parcels For Posting And Sending Them, Issuing Parcels (Employees Of Postal Points), Sorting Postal Items (Employees Of Parcel Sorting Points). The Above Requirement Does Not Apply To Work Performed Directly By Persons Running A Sole Proprietorship.5. The Method Of Verifying The Employment Of The Persons Indicated In Point 5 And The Employers Rights To Control The Contractors Compliance With The Requirements Related To The Employment Of These Persons And The Sanctions For Failure To Meet These Requirements Are Specified In The Draft Provisions Of The Contract Constituting Annex No. 5 To Swz.6. The Ordering Party Does Not Require The Contractor To Conduct An On-Site Visit Or Check The Documents Necessary To Complete The Order, Available On-Site At The Ordering Party. 7. Subcontracting: 1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S). 2) The Ordering Party Requires, Pursuant To Art. 462 Section 2 Of The Public Procurement Law, That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance He Intends To Entrust To Subcontractors And Provide (If Known To Him At This Stage) The Names (Companies) Of These Subcontractors.
