The Detailed Method Of Implementing The Subject Of The Order Was Specified In Annex No. 4 To The Swz - Draft Contract And Annex No. 5 To The Swz - Description Of The Subject Of The Order, And The Quantities Specified In The Description Are Only Estimates. 4. The Ordering Party Reserves The Right To Order The Assortment In Different Quantities, I.E. Other Than Those Specified In Annex No. 1A And Annex No. 5 To The Swz, Based On The Current Needs Of Individual Ordering Parties. 5. The Ordering Party Provides For The Possibility Of Exercising The Option Right. 5.1 As Part Of The Option, The Ordering Party Is Entitled To Reduce The Scope Of Deliveries Constituting The Basic Order To The Extent Of Deliveries With A Value Not Exceeding 40% Of The Value Of The Maximum Gross Remuneration Of The Signed Contract (Reducing Option). 5.2 Offer Price Indicated In The Offer Form Is Only Used To Compare Submitted Offers. The Value Of The Order Will Result From The Actual Quantity Of The Ordered Goods, Resulting From The Current Needs Of The Ordering Party (A Given Unit). In Connection With The Possibility Of Exercising The Option Right, The Ordering Party Undertakes To Realize At Least 60% Of The Gross Remuneration Of The Contract Signed By The Ordering Party. 5.3 The Ordering Partys Exercise Of The Option Right Is An Entitlement Of The Ordering Party Which It May, But Does Not Have To, Exercise In The Framework Of These Proceedings. If The Ordering Party Does Not Exercise The Option Right, The Contractor Is Not Entitled To Any Claim In This Respect. 6. The Delivered Assortment Must Be New, Consistent With The Description Specified (According To The Type Of Assortment) In The Annex To The Contract, Packed In The Manufacturers Original Packaging, Guaranteeing Protection Of Its Elements Against Mechanical Damage During Transport And Storage, Factory-Sealed And Intact, With Security Measures Applied By The Manufacturer And Signs Identifying The Product Range, With The Legally Required Approvals And Certificates Authorizing Trading In The Territory Of The Republic Of Poland. 7. The Contractor Is Obliged To Perform The Subject Of The Order With With Due Care And On Time.8.The Contractor Is Obliged To Deliver The Subject Of The Order To The Headquarters Of Each Unit, In The Quantity And Range Specified In The Partial Order Based On A Written Order (By E-Mail), Using Its Own Transport, At Its Own Expense And Risk.9.In The Case Of Failure Of The Means Of Transport, The Contractor Is Obliged To Ensure Replacement Transport On His Own In Order To Ensure Continuity Of Supplies. 10. The Contractor Is Obliged To Deliver Products In Accordance With The Requirements Of The Ordering Party Indicated In Annex No. 1A To The Swz - Assortment And Price Form, Annex No. 5 To The Swz - Description Of The Subject Of The Order And In The Content Of This Swz.11. The Subject Of The Order Must Meet The Requirements In Applicable Law Regarding Cleaning Products, In Particular: The Act Of February 25, 2011 On Chemical Substances And Their Mixtures (I.E. Journal Laws Of 2022, Item 1816) And The Act Of October 9, 2015 On Biocidal Products (Journal Of Laws 2021.24, I.E.). 12. The Contractor Provides A Warranty For The Delivered Products For A Period Of 12 Months From The Date Of Delivery And Signing Of The Acceptance Document By A Representative From Each Unit The Ordering Party And The Contractor, But Not Shorter Than The Manufacturers Warranty, In Packaging Marked In A Statutorily Specified Manner - In Accordance With The Act Of February 25, 2011 On Chemical Substances And Their Mixtures.13. The Contractor Is Obliged To Hand Over The Products Directly To The Person Authorized To Collect And To Provide All Necessary Information Upon Delivery In Order To Perform A Quantitative And Qualitative Assessment Of The Delivery Item. It Is Not Allowed For The Contractors Representative To Leave The Products Unattended Or To Unauthorized Persons.14. Deliveries Of Cleaning Products Will Be Made Successively, Depending On The Current Needs Of The Ordering Parties Listed Above In Section 2 Of This Chapter - (10 Units In The K trzyn Poviat - Towns: K trzyn And Reszel) Based On A Written Order. The Deadline For Partial Deliveries To Each Unit Mentioned Above In Section 2 Will Be Specified In The Offer Form - Counting From The Date Of Placing The Order. Working Days Are Considered To Be Days From Monday To Friday, Excluding Public Holidays, From 8:00 A.M. To 3:00 P.M. Whenever Trademarks, Patents Or Origins, As Well As Standards Are Used In The Content Of The Swz, Including The Description Of The Subject Of The Contract And Annexes To The Swz, The Ordering Party Allows Trademarks, Patents Or Origin, As Well As Equivalent Standards. The Equivalent Assortment Should Have Technical, Qualitative, Functional, Utility, Properties Or Composition Corresponding To The Features Indicated In The Description Of The Subject Of The Order Or Have Better Features.16. All Trademarks, Trademarks, Patent References, Model Names, Catalog Numbers Used In The Specification And Annexes They Only Serve To Determine The Technical And Qualitative Functional, Operational, Properties Or Composition Of The Product, And Do Not Indicate The Manufacturer. The Ordering Party Treats All Trade Names Used In The Description Of The Subject Of The Order As Specific Information, Which Was Used Only To Approximate The Needs Of The Ordering Party. The Ordering Party Indicated In The Description Of Individual Products The Criteria Used To Assess Equivalence.17. The Contractor Who Adopts Equivalent Solutions For The Valuation Is Obliged To Prove The Equivalence Of The Adopted Products.18. In Order To Confirm That The Offered Equivalent Solution Meets The Requirements Specified In The Swz And Annexes To The Swz, The Contractor Will Submit A Detailed Description Of The Offered Product Of The Equivalent Procurement, In Which For Each Product It Will Specify The Name Of The Manufacturer Or Catalog Number, The Name Of The Product And Other Product Features Allowing For Clear Identification Of The Offered Product. Product And Confirmation Of Compliance With The Description Of The Subject Of The Order. 19. The Contractor Who Refers To Solutions Equivalent To Item 48, 49, 50, 51 App. No. 1A - Assortment And Price Form, Is Obliged To Demonstrate That The Offered Product Meets The Minimum Requirements Specified In The Assortment And Price Form. In Order To Demonstrate The Fulfillment Of These Requirements, The Evidence Referred To In Chapter Xviii Of Swz Should Be Submitted With The Offer.20. Description Of The Offered Product, Which Should Clearly Show The Ordering Party That The Offered Subject Of The Contract Is Of The Same Or Better Parameters, Are Required Only For A Product Other Than The Type And Name Indicated In The Description. For Example: (Description - Item No. 17), If The Contractor Offers A Tytan Product That Meets All The Requirements Described In Item No. 17, The Contractor Is Not Obliged To Provide An Additional Description. If, However, It Is A Product Other Than Tytan That Meets All The Requirements Described In Item No. 17, The Contractor Is Obliged To Provide A Description.21. Also, If The Ordering Party Does Not Indicate The Product Type By Name In Annex No. 1A - Assortment And Price Form, The Contractor Is Obliged To Provide A Description Including The Manufacturers Name Or Catalog Number, Product Name And Product Description.22. Pursuant To Art. 101 Section 4 Of The Pzp, The Ordering Party Allows Equivalent Solutions Described In The Swz And Annexes To The Swz, Using Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Pzp, Including Equivalent Documents. 23. Before Submitting An Offer, The Contractor Is Obliged To Read The Specification Of The Terms Of The Order, The Subject Of The Order, The Draft Contract, As Well As Obtain Other Necessary Information Needed To Prepare The Offer. It Is Assumed That The Contractor Included In The Offer The Data Provided By The Ordering Party, Including Explanations And Modifications.24. The Ordering Party, In Connection With Art. 91 Section 2 Of The Ppl Indicates That The Contract In Question Is Not Divided Into Parts: Economic, Technical And Organizational Aspects As Well As The Purposefulness Of The Contract Support The Decision Not To Divide The Contract Into Parts. The Division Would Pose A Risk Of Excessive Organizational Difficulties In The Execution Of The Order, Which Could Result In The Order Not Being Completed In A Coordinated And Timely Manner.
