The Subject Of The Order Is The Purchase And Delivery In The Form Of Operational Leasing With A Purchase Option, One Street Sweeper Free From Defects To The Registered Office Of The Ordering Party.2. The Scope Of The Order Includes The Delivery Of A Brand New Sweeper, Manufactured In 2022 Or 2023, To Przedsi biorstwo Cleaning Sp ka Z O.O. In Mor g, I.E. The Sweeper Should Be Brand New, Not A Demonstration, Not An Exhibition Display, Unused, Complete, Free From Construction, Material, Manufacturing, Workmanship And Legal Defects, Ready For Use And Technically Operational.3. The Sweeper Should Be Complete And Ready For Operation. The Contractor, Together With The Sweeper, Is Obliged To Provide A Correctly Issued Invoice And Documents Required By Law In Force On The Date Of Delivery.4. The Supplier Is Obliged To Ensure That The Ordering Partys Staff Is Trained In The Operation Of The Sweeper, Including The Devices And Technological Innovations Installed In It.5. Warranty And Warranty Conditions: The Ordering Party Has Set A Minimum Warranty And Warranty Period For The Sweeper, Which Cannot Be Shorter Than 18 Months From The Date Of Delivery. The Distance Of The Service Point Is No More Than 100 Km From The Ordering Partys Headquarters, Warranty And Post-Warranty Service Available Within 48 Hours.6. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1B To The Swz, Which Constitutes An Integral Part Of This Swz And Will Constitute An Annex To The Contract.7. The Ordering Party Allows The Submission Of Equivalent Offers. Equivalent Should Be Understood As Equipment With Parameters, Quality Of Workmanship And Technology Not Worse Than Those Specified In The Description Of The Subject Of The Contract Specified In The Swz. Pursuant To Art. 30 Section 5 Of The Public Procurement Law, The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies, Services Or Construction Works Offered By Him Meet The Requirements Specified By The Ordering Party (E.G. Present A Comparison Of The Technical Parameters Of The Product Range Required By The Ordering Party With The Parameters Offered Assortment, Etc.).7.1. The Ordering Party Informs That The Contractor Who Submits Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Product He Offers Meets The Requirements Specified By The Ordering Party. Due To The Above, The Ordering Party Requires The Contractor To Describe, Using Technical And Qualitative Parameters, The Solutions It Offers To The Ordering Party As Equivalent To Those Described By The Ordering Party. The Required Information Should Be Provided In The Offer Form Constituting Annex No. 1 To The Swz, Including The Technical Form (Appendix No. 1A).7.2. The Offered Sweeper Should Meet The Minimum Requirements Of The Ordering Party Specified In The Detailed Description Of The Subject Of The Order, Annex No. 1B To This Tor, Or Have Better Parameters. If The Ordering Party, In The Description Of The Subject Of The Order, Indicated In The Swz Any Trademark, Patent Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, Or Described The Subject Of The Order By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems - It Should Be Assumed That The Indicated Patents, Trademarks, Origin, Source Or Specific Process That Characterizes These Products Or Services, Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Determine The Technical, Operational And Utility Parameters, Which Means That The Ordering Party Allows The Submission Of An Offer In This Part Of The Subject Of The Order With Equivalent Technical, Operational And Utility Parameters.7.3. The Term Equivalent Means Having Equal Value And Equal Importance. This Means That The Product Or Technical Solution Described By The Ordering Party Does Not Have To Be Identical And Does Not Have To Be The Same. Demonstrating Equivalence Does Not Mean Proving That The Offered Product Is Better Or Not Worse Than The One Required By The Ordering Party, But That It Makes It Possible To Achieve The Effect Intended By The Ordering Party Using Other Technical Solutions.7.4. The Ordering Party Requires That The Contractor, When Describing The Solutions It Offers As Equivalent To Those Described And Listed By The Ordering Party In The Detailed Description Of The Subject Of The Order Constituting Annex No. 1B To The Swz In Terms Of All Parameters, Indicate The Manufacturer, Model, Description And Parameters Of The Offered Product In The Bid Form Constituting Annex No. 1 To The Swz, Including The Technical Form (Appendix No. 1A).7.5. When Assessing Whether The Solutions Provided By The Contractor Are Equivalent, The Ordering Party Will Compare The Technical Parameters Described In The Detailed Description Of The Subject Of The Order By The Ordering Party And Those Indicated In The Offer Form, Including In The Technical Form By The Contractor.8. The Ordering Party Requests That The Contractor Indicate The Parts Of The Order Whose Performance He Intends To Entrust To Subcontractors And That The Contractor Provide The Companies Of The Subcontractors.9. Entrusting The Performance Of Part Of The Subject Of The Order To A Subcontractor Or Subcontractors Requires The Conclusion Of A Subcontracting Agreement, Which Should Be Understood As An Agreement In Written Form For A Fee, The Subject Of Which Are Services, Supplies Or Construction Works Constituting Part Of The Public Procurement, Concluded Between The Contractor Selected By The Ordering Party And Another Entity ( Subcontractor), And In The Case Of Public Procurement Contracts For Construction Works, Also Between The Subcontractor And A Further Subcontractor Or Between Further Subcontractors. The Ordering Party Allows The Possibility Of Entrusting The Performance Of The Order To A Subcontractor Or Subcontractors, Which Does Not Release The Contractor From Responsibility For The Proper Performance Of This Order.
