The Investor Supervision Inspector Will Act As An Investor Supervision Inspector Within The Meaning Of The Act Of July 7, 1994, Construction Law (Journal Of Laws Of 2023, Item 682), In Accordance With The Scope Specified In Article 25 And Article 26 Of The Abovementioned. Act And Implementing Regulations. 4. The Investors Supervision Inspector Will Perform The Ordered Supervision In Accordance With The Requirements Of The Ordering Party, Applicable Regulations And Principles Of Technical Knowledge. 5. The Basic Duties Of The Supervision Inspector Include: A) Representing The Ordering Party - Investor By Checking The Compliance Of The Implementation Work With Design Documentation, In Particular Technical Specifications For The Execution And Acceptance Of Works, Decisions, Legal Provisions, Including, Among Others, Technical And Implementing Regulations In The Field Of Occupational Health And Safety And Standards And Principles Of Technical Knowledge; B) Checking The Quality Of Work Performed, Devices And Materials Used, And In Particular Preventing The Use Of Defective And Unauthorized Products And Their Use In Construction, Control And Archiving Of Documents Confirming The Approval Of These Materials For Sale;C) Approving Materials And Quality Of Workmanship In Accordance With The Terms Of The Contract Concluded With The Contractor Of The Work, With Stwior, Design Documentation,D) Making Decisions On The Approval Of The Use (Or Rejection) Of Materials, Prefabricated Elements, Equipment And Devices Intended For The Implementation Of The Task In Based On Legal Provisions, Standards And Requirements Formulated In The Contract With The Contractor, In The Design Documentation, And The Technical Specification For The Execution And Acceptance Of Works; E) Qualification Of Demolition Materials That Do Not Constitute Waste, Suitable For Further Use, Provided To The Ordering Party By The Contractor; F) Confirmation Of Actual Performed Works And Removal Of Defects;G) Checking And Approving As-Built Documentation Before Final Acceptance;H) Participating In Acceptance, Final And Final Acceptance Of The Investment;I) Issuing Instructions To The Construction Manager Regarding The Removal Of Irregularities Or Threats, J) Requesting The Construction Manager To Make Corrections Or Re-Performing Faulty Works And Suspending Further Works If Their Continuation Could Pose A Threat Or Cause Unacceptable Non-Compliance With The Design Documentation And Stwior;K) Ongoing Control Of The Quantity, Timeliness And Correctness Of The Works Performed, Taking Actions To Meet The Investment Implementation Deadline; L) Ongoing Checking Of The Compliance Of The Installed Devices With The Requirements Of The Ordering Party, And In The Event Of Any Irregularities - Calling On The Contractor To Remove The Defects; M) Requesting From The Contractor Of The Work A Declaration Of Performance, A Declaration Of Conformity With The Ce Mark, An Enec Certificate, Photometric Calculations Of The Installed Lighting Fixtures, To Confirm Compliance With Requirements Set By The Ordering Party And Compliance With The Pn-En 13201 Standard, Approvals, Certificates And Other Documents Regarding Built-In Materials And Devices;N) Verification Of Measurement Results And Test Reports In The Electrical Industry And, If Necessary, Performance Of Electrical Measurements And Checks (If Applicable); O) After The Commencement Of Work, Supervise The Execution Of The Task With Such Frequency And At Such Times As To Ensure The Effectiveness Of Supervision, But At Least Twice A Week And At Each Request Of The Ordering Party When The Presence Of A Supervision Inspector Is Indispensable, No Later Than On The Next Day After Notification , And In Exceptional Situations, Immediately And Participate In The Acceptance Of The Installation;P) Keep The Ordering Party Informed About The Progress Of The Works, About The Problems Encountered And The Remedial Actions Taken To Overcome Them (Early Warning, Especially In Matters That May Affect The Date Of Completion Of The Works);Q) Participation During The Warranty And Warranty Period In Warranty Inspections Upon Notification Of The Ordering Party, Confirmation Of Removal Of Defects And Faults During The Warranty And Warranty Period, Participation In Post-Warranty Acceptance Of The Investment, Without Additional Remuneration. R) Performing Other Activities Provided For The Supervision Inspector In The Contract With The Investment Contractor 6 Without The Consent Of The Ordering Party, The Supervision Inspector Is Not Authorized To Issue An Order To The Contractor Of Construction Works To Perform Additional And Replacement Works, Or To Discontinue The Works.7. If, During The Period Of Delivery/Construction Works, It Becomes Necessary To Perform Additional Works Not Provided For In The Agreement With The Contractor, The Supervision Inspector Should Immediately Notify The Ordering Party In Order To Decide Whether To Commission Them To The Contractor.8. Without The Consent Of The Ordering Party, The Supervision Inspector Is Not Authorized To Issue An Order To The Contractor Of Supplies/Construction Works To Perform Additional Or Replacement Works. 9. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Word Or Equivalent.
