1. The Subject Of The Order Is Purchase Of A Brand New Agricultural Tractor, Plow And Sand Spreader. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 4 To Swz.2. If The Description Of The Subject Of The Order Would Indicate Trademarks, Patents Or Origin In Relation To Certain Materials And Devices, The Ordering Party, In Accordance With Art. 99 Section 5 Of The Act, Allows The Submission Of Equivalent Products. All Products From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Goods Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order. By The Provision Regarding The Minimum Requirements For Quality Parameters, The Ordering Party Understands The Requirements Of The Goods Contained In Publicly Available Sources, Catalogs And Manufacturers Websites. The Use Of Exemplary Manufacturers Names Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. Therefore, The Use Of Manufacturers/Products Names Is For Example Purposes Only. When Describing The Subject Of The Order, The Ordering Party, Indicating The Name Of A Specific Manufacturer (Supplier) Or A Specific Product, Also Allows Equivalent Products With Quality Parameters And Functional Features, At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Parameters Or Better. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents (Along With The Offer) Authenticating These Materials Or Devices. They Will Be Subject To Assessment By The Ordering Party, Which Will Be The Basis For The Ordering Partys Decision To Accept Equivalents. The Ordering Party Reserves The Right To Ask The Author Of The Design Documentation For An Opinion On The Offered Materials Or Devices. If The Contractor Does Not Submit Documents Regarding The Use Of Other Materials And Devices, It Is Understood That The Materials And Devices Proposed In The Description Of The Subject Of The Order Were Included In The Calculation Of The Offer Price.3. The Technical And Qualitative Features Of The Subject Of The Order Should Comply With Polish Standards Transposing European Standards Or Standards Of Other Member States Of The European Economic Area.
