A Detailed Description Of The Subject Of The Order Is Specified In The Document Entitled Description Of The Subject Of The Order (Opz) Constituting Annex No. 4 To Swz.3. The Estimated Size Of The Order During The Term Of The Contract Is Approximately 1,960 Pieces.4. The Scope Of The Order Includes The Delivery Of: 1) Coffin Decoration Made Of Live Flowers (6 Pcs.) On A Living Background With Live Accessories - 330 Pcs. 2) Warsaw Wreath (Standard) Made Of Live Flowers (25 Pcs.) On A Living Background With Live Accessories Accessories - 1200 Pcs.3) Warsaw Wreath (Large) Made Of Live Flowers (40 Pcs.) On A Living Base With Live Accessories - 50 Pcs.4) Warsaw Wreath (Standard) Made Of Artificial Flowers (25 Pcs.) On A Living Base With Live Accessories - 50 Pcs.5) Warsaw Wreath (Large) Made Of Artificial Flowers (40 Pcs.) Due To The Inability To Clearly Determine The Size Of The Order, The Ordering Party Reserves The Right To Purchase A Smaller Number Of Decorations, Bouquets And Wreaths Than Specified In The Swz And The Contract Due To Circumstances That Could Not Be Predicted In Advance And Over Which The Ordering Party Had No Influence. In Such A Situation, The Contractor Will Not Raise Any Reservations Or Claims For Non-Delivery Exceeding The Scope (Level) Of The Order Guaranteed By The Ordering Party, I.E. 50% Of The Order Size.6. The Ordering Party Reserves The Right To Make Quantitative Shifts Between Individual Assortments In A Given Category Of Goods, As Well As Between Individual Categories Of Goods, Depending On The Actual Needs Of The Ordering Party. The Quantitative Change May Not Increase The Maximum Gross Remuneration Due To The Contractor For The Implementation Of This Contract, Specified In The Offer Form.7. The Ordering Party Reserves The Right To Order Wreaths, Bouquets And Decorations Other Than Those Indicated In Ii.2, I.E. At The Customers Special Request According To The Individual Valuation Agreed Upon When Placing The Order. 8. Detailed Requirements Related To The Subject Of The Order: A) Deliveries Of Wreaths, Bouquets And Decorations Will Be Carried Out Successively, According To The Needs Of The Ordering Party, On Dates (Day And Time), Quantities And According To Patterns Each Time Provided By The Ordering Party. B) The Order Will Be Placed By Phone By 3:00 P.M., No Later Than On The Business Day Preceding The Delivery Date. C) Deliveries Will Be Made From Monday To Saturday, Excluding Sundays And Holidays From 7:00 A.M. To 3:00 P.M. D) Place And Time Of Delivery: The Ordering Partys Registered Office At The Agreed Time At The Time Of Placing The Order.E) The Cost Of Delivery To The Ordering Partys Office Is Covered By The Contractor.F) The Quality Of Each Batch Of Delivered Wreaths, Bouquets And Decorations Will Be Checked By The Ordering Partys Employee, With The Possibility Of Replacement In The Event Of Intervention By The Customer Or Ordering Party.G) Delivered Goods That Do Not Meet The Quality Requirements Will Not Be Accepted. And Must Be Replaced With Appropriate Ones Or Repaired Within A Maximum Of 1 Hour From Notification By The Ordering Party. H) All Replacement Costs Will Be Borne By The Contractor.10. The Order May Be Fulfilled In Whole Or In Part By Subcontractors. In Such A Case, The Contractor Will Specify The Material Scope Of The Order, The Execution Of Which Will Be Entrusted To Subcontractors And Indicate The Details Of The Subcontractors Companies. The Contractor Will Be Fully Responsible For The Actions Or Omissions Of Subcontractors As For Their Own Actions Or Omissions.11. The Ordering Party Does Not Allow The Submission Of Partial Offers For The Order.12. In Order To Confirm That The Offered Decorations, Bouquets And Wreaths Meet The Requirements Of The Ordering Party, The Contractor Is Obliged To Provide A Catalog With Photos (Photographs) Of The Sample Goods Included In The Offer, With The Name And Description Of The Materials Used And With A Description Of The Items From The Offer Form (E.G. Decoration ... ... Item 1).The Catalog With Photos Is Submitted Together With The Offer. The Assessment Will Be Based On The Formula - Meets - Does Not Meet.13. The Subject Of The Order And The Method Of Its Execution As Well As The Contractors Obligations Are Specified In Detail In: - Template Of The Contract - Annex No. 2 To The Swz, - Description Of The Subject Of The Order - Annex No. 4 To The Swz14. The Ordering Party Informs That Submitting An Offer Does Not Have To Be Preceded By An On-Site Visit Or Checking The Documents Relating To The Order At The Ordering Partys Disposal.15. All Requirements Specified Above Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Pzp Act.16. The Ordering Party Did Not Divide The Contract Into Parts Because It Is Not Justified Due To The Specificity Of The Subject Matter Of The Contract And Its Homogeneous Nature. Artificial Division Of The Order Would Result In Excessive Costs Of Order Execution (E.G. Transport Costs), As Well As The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Order. Moreover, There Would Be A Risk Of Non-Fulfillment Of Part Of The Order. The Order Has A Value Not Exceeding The Eu Thresholds And The Scope Of The Order Is Adapted To The Needs Of The Sme Sector Without The Need To Further Refine The Scope Of The Order.
