The Subject Of The Order Is The Provision Of Comprehensive Rescue Security Services By Performing Rescue Duties At The Swimming Pool Of The Sports And Recreation Center Of The Capital City Of Warsaw. Warsaw In The oliborz District. Place Of Order Fulfillment: Swimming Pool At Ul. Potocka 1 In Warsaw Opening Hours Of The Swimming Pool: Monday - Thursday 06:00 - 23:00, Friday, Saturday 06:00 - 01:00, Sunday 6:00 - 23:00. Scope Of The Contractors Responsibilities: The Ordering Party Has Lifeguards Employed Under A Contract Work And The Contractors Task Will Be To Supplement The Rescue Staff Of The Swimming Pool. The Contractor Will Perform Water Rescue Activities Consisting In Carrying Out Rescue Operations, In Particular Organizing And Providing Assistance To People Who Have Had An Accident Or Are Exposed To The Risk Of Loss Of Life Or Health In The Water Area. The Service Will Be Provided In A Place Used For Bathing In Accordance With Applicable Law, I.E. In Accordance With The Provisions Of The Act Of August 18, 2011 On The Safety Of Persons Staying In Water Areas (Consolidated Text: Journal Of Laws Of 2023, Item 714, As Amended). And Implementing Acts To This Act. Place Of Execution Of The Order: Estimated Average Number Of Rescue Hours Per Month -680. Working Days And Hours May Change Depending On The Occupancy Of The Swimming Pool, Organized Activities And Other Needs Of The Ordering Party. A. The Ordering Party Will Provide The Contractor With The Demand For The Next Month By The 20Th Day Of The Current Month, And The Contractor Will Provide A Personalized Schedule For The Provision Of Services By Rescuers For All Days Of The Next Month, No Later Than 5 Days Before The Beginning Of The Month. The Ordering Party Reserves The Right To Change The Above. Hourly Divisions Within Clock Hours. The Expected Total Maximum Number Of Rescue Hours During The Order Execution Period Is 4,761 Hours. The Number Of Hours Was Included In The Calculation Solely For The Purposes Of This Procedure In Order To Estimate The Value Of The Order And May Be Reduced Depending On The Actual Demand For Rescue Services. By One Rescue Hour, The Ordering Party Understands The Provision Of Water Rescue And First Aid Services By One Person Within One Hour. (60 Minutes). The Contractor Acknowledges That The Number Of Hours Indicated Above Is Only An Estimate And May Be Reduced, In Particular In The Event Of An Interruption In The Operation Of The Swimming Pool Caused By, Among Others, Technological Requirements, Modernization, Renovation Or Failure, As Well As Changes In Working Hours. For Organizational, Procedural, Technical And Economic Reasons, The Need To Introduce Technological Breaks, Failures, The Ordering Party Is Entitled To Limit The Number Of Services Provided By The Contractor. For This Purpose, The Ordering Party Has The Right To Cancel Services At Times And Periods Specified By It. Obligations Arising From The Social Clause A. In The Proceedings In Question, The Ordering Party Applies The Social Clause Pursuant To Art. 95 Section 1 Of The Public Procurement Law. B. The Contractor Undertakes That During The Implementation Of The Subject Of The Agreement, All Rescuers Assigned To The Implementation Of The Subject Of The Agreement Will Be Employed Under An Employment Contract Within The Meaning Of The Labor Code By The Contractor Or Subcontractor Throughout The Entire Period Of Implementation Of The Subject Of The Agreement. C. The Condition Referred To In Section B Will Be Met By Employing New Employees Under An Employment Contract Or Appointing Already Employed Persons Performing Rescuer Activities To Perform The Order.
