In Order To Carry Out The Activity Of The Medical Unit Under Appropriate Conditions, It Is Necessary To Contract Medical Equipment So That The Services Offered Can Be Provided, At A High Quality Level, In Accordance With The Technology On The Market, At A High Competitive Level With A Direct Impact On The Level Of Health Of The Local Population/Those In Transit And Neighboring Territories, As Well As On The Revenues Of The Medical Unit. We Make It Clear That The Contracting Authority Submitted A Request For Funding Through The Ministry Of Health, For Which, In Order To Streamline The Process Of Contracting Services And Works, The Present Public Procurement Procedure Is Initiated Under The Incident Of The Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditioned By The Allocation Of Budget Credits For This Purpose, (By Obtaining A Financing) The Signing Of The Contract Having Been Done In Compliance With The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Legislation On Public Finances. Bearing In Mind The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Credits For This Purpose. If, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, The Contracting Authority, After Receiving The Notification Regarding The Non-Granting Of Funding. Reserves The Right To Cancel The Award Procedure, Provided There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Paragraph (1), Letter C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions , It Being Impossible To Conclude The Public Procurement Contract, But No Later Than 6 Months From The Date Of Completion Of The Public Procurement Procedure.. The Bidders Within This Procedure Understand That The Contracting Authority Cannot Be Considered Responsible For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation.
