1. The Subject Of The Order Is: Development Of Draft Local Development Plans For Areas Located In The City And Commune Of Olsztyn2. Each Of The Areas For Which A Local Development Plan Should Be Prepared Has Been Defined By A Resolution Of The Olsztyn City Council. The Boundaries Of The Plans Are Indicated In Graphic Annexes To These Resolutions In Accordance With The Spatial Planning And Development Act (Journal Of Laws Of 2023, Item 977, As Amended)3. The Order Was Divided Into 2 Parts: 3.1 Part I: Non-Residential Developmenta) Area Located At Ul. Szkolna In Turów In The Olsztyn Commune. Envisaged Change Of Purpose (In Accordance With The Provisions Of The Study Of Conditions And Directions Of Spatial Development Of The Olsztyn Commune) - Production And Service Development. Resolution No. V/60/19 Of The Olsztyn Commune Council Of June 5, 2019 On The Commencement Of The Preparation Of A Local Spatial Development Plan For The Area Located At Ul. . Szkolna In Turów. B) Area Located At The Intersection Of Ul. Mstowska And Ul. Słowackiego In Olsztyn. Envisaged Change Of Purpose (In Accordance With The Provisions Of The Study Of Conditions And Directions Of Spatial Development Of The Olsztyn Commune) - Service And Residential Development. Resolution No. Xix/208/17 Of The Olsztyn Commune Council Of March 28, 2017 On The Commencement Of Changes To The Local Spatial Development Plan Of The Olsztyn Commune. The Contractors Task Is To Prepare A Draft Local Development Plan For The Areas Indicated In Annex No. 2 To The Above-Mentioned Resolution. C) Area Located At The Intersection Of Norwida And Miłosza Streets In Olsztyn. Envisaged Change Of Purpose (In Accordance With The Provisions Of The Study Of Conditions And Directions Of Spatial Development Of The Olsztyn Commune) - Enabling The Location Of A Retention Reservoir. Resolution No. Xxxv/419/23 Of The Olsztyn City Council Of September 12, 2023 On The Commencement Of The Preparation Of A Local Spatial Development Plan For The Area Located In The Intersection Of Norwida And Miłosza Streets In Olsztyn;4. The Scope Of The Subject Of The Order Is Determined By Resolutions Of The Olsztyn City And Commune Council Together With Graphic Annexes - Annex No. 1 To The Swz. The Subject Of The Order Is To Take Into Account The Findings Of The Study Of Conditions And Directions Of Spatial Development Of The Olsztyn Commune And The Proposed Contractual Provisions. The Deadline For Completing The Order And Its Individual Stages Was Specified In Detail In The Material And Financial Schedule.5. The Contractors Responsibilities Under The Order In Question Include: 1) Carrying Out The Formal And Legal Procedure Required For The Draft Local Spatial Development Plan, Resulting From The Act Of March 27, 2003 On Spatial Planning And Development (Consolidated Text: Journal Of Laws 2023.977, As Amended), Completing Formal And Legal Documentation Throughout The Entire Period Of Preparing The Draft Plan And Preparing Documentation Of Planning Works In Accordance With The Applicable Legal Provisions In This Regard, And In Particular In Accordance With: • Regulation Of The Minister Of Development And Technology Of December 17, 2021 On The Required Scope Of The Draft Local Plan Spatial Development (Journal Of Laws 2021.2404), • Regulation Of The Minister Of Development, Labor And Technology Of October 26, 2020 On Spatial Data Sets And Metadata In The Field Of Spatial Development (Journal Of Laws Of 2020, Item 1916)• Act Of October 3, 2008 On The Provision Of Information On The Environment And Its Protection, Public Participation In Environmental Protection And On Environmental Impact Assessments (I.E. Journal Of Laws 2022.1029, As Amended. Amended)2) Preparation Of Draft Documents Resulting From The Planning Procedure Referred To In Art. 17 Of The Act On Spatial Planning And Development, Including Draft Resolutions Of The Olsztyn City Council, 3) Developing The Concept Of A Local Plan, 4) Developing A Draft Local Plan To The Extent Consistent With Art. 15 Of The Act On Spatial Planning And Development, 5) Preparation Of Environmental Impact Forecasts In Accordance With The Act Of October 3, 2008 On The Provision Of Information On The Environment And Its Protection, Public Participation In Environmental Protection And Environmental Impact Assessments (Consolidated Text: Journal Of Laws Of 2022 R., Item 1029, As Amended);6) Preparation Of An Ecophysiographic Study In Accordance With The Regulation Of The Minister Of The Environment Of September 9, 2002 On Ecophysiographic Studies (Journal Of Laws Of 2002, No. 155, Item 1298), 7 ) Preparation Of An Application For Consent To Change The Intended Use Of Land For Non-Agricultural And Non-Forest Purposes, Prepared For The Draft Local Plan, If Required, 6. The Contractor Should Constantly Take Into Account Changes In The Regulations And Principles Of Technical Knowledge In The Plans Being Developed. The Development Plans Submitted To The Ordering Party By The Contractor Should Be Consistent With The Regulations And Principles Of Technical Knowledge In Force On The Date Of Submission.7. When Performing The Order, The Contractor Is Obliged To Comply With The Minimum Requirements To Ensure Accessibility For People With Special Needs Specified In Art. 6 Of The Act Of July 19, 2019 - On Ensuring Accessibility For People With Special Needs. 8. The Ordering Party Recommends That The Contractors Conduct A Local Inspection Of The Areas Covered By The Order In Order To Obtain Information Helpful In Preparing The Offer.9. The Ordering Party Does Not Allow The Indication Of Trademarks, Manufacturers Names, Patents Or The Origin Of Products, Devices And Materials In The Developed Plans. 10. An Exception To This Rule, In Accordance With Art. 99 Section 5 And 6 Of The Public Procurement Law Is A Case In Which The Indication Of Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor Is Justified By The Specificity Of The Subject Of The Contract And It Is Not Possible To Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way, And Such Indication Is Accompanied By The Words Or Equivalent. If The Subject Of The Contract Is Described In The Manner Referred To Above, The Contractor Shall Indicate For Those Elements Of The Project Where Proper Names Are Specified, The Description (Criteria) That Will Constitute The Basis For Assessing Equivalence. If The Contractor Used The Markings Of Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And 3 Of The Labor Law Should Be Understood As Examples. 11. The Ordering Party, In Accordance With Art. 101 Section 1 Point 4 Of The Public Procurement Law Allows In Each Case The Use Of Equivalent Solutions Described In The Content Of The Swz. Each Time A Standard, European Technical Assessment, Approval, Technical Specification And Technical Reference System Is Mentioned In This Swz Or In The Annexes To The Swz, It Should Be Assumed That The Phrase Or Equivalent Has Been Used In Reference To It. 12. Scope And Form Of Documentation That The Contractor Should Prepare And Submit To The Ordering Party: In Accordance With § 1 Point 7 Of The Draft Contractual Provisions - Annex No. 11A And 11B To Swz.13. Program Financed By The European Union: The Order Is Not Financed By The European Union
