The Subject Of The Order Is The Delivery Of An Update Package And License Of The Standard Cost Estimating Program Or The Delivery Of An Equivalent Solution, Along With An Annual Update Service And Annual Access To The Price Database And Training, In Accordance With The Provisions Of The Description Of The Subject Matter Of The Order (Opz), Constituting Annex No. 1 To The Swz. 2. The Subject Of The Order Includes In Particular: Stage I: Delivery Of Licenses And Software Updates: 1) Delivery Of An Update Of The Norma Pro Program License From Version 4.47 To The Current Version Of Norma Expert Or Delivery Of Equivalent Software Licenses, Along With The Possibility Of Updating The Software License To The Latest Versions And Access To The Nationwide Intercenbud Construction Price Base For A Period Of 12 Months 1 Piece. 2) Delivery Of An Update Of The Norma Pro Program License From Version 4.72 To The Current Version Of Norma Expert Or Delivery Of An Equivalent Software License, Along With The Possibility Of Updating The Software License To The Latest Versions And Access To The Nationwide Price Database In Construction Intercenbud For A Period Of 12 Months - 1 Piece. 3) Delivery Of 1 Norma Expert Software License In The Latest Version Or Delivery Of An Equivalent Software License, Along With The Possibility Of Updating The Software License To The Latest Versions And Access To The Intercenbud Nationwide Construction Price Database For A Period Of 12 Months - 1 Piece. 3. As Part Of The Order, The Contractor Is Obliged To Conduct At Least Four-Day Remote Training For A Group Of Up To 3 People In The Use Of Norma Expert Software Or Equivalent Software, In Accordance With The Requirements Contained In Chapter. Iii Opz Constituting Annex No. 1 To The Swz (Stage Ii). 4. If The Contractor Offers Products Equivalent To The Software Referred To In Section 2 The Contractor Must Prove To The Ordering Party That It Meets All The Equivalence Conditions Specified In Chapter Ii Of The Opz Constituting Annex No. 1 To The Swz, I.E. Provide With The Offer: 1) Full License Provisions Of The Equivalent Product Along With Its Translation (If It Is Not Originally In Polish );2) List Of Full Functionality Of Equivalent Software.5. If The Contractor Offers Norma Software, The Contractor Is Also Obliged To Replace Usb Security Keys (2 Pcs.) For The Norma Pro Program Held By The Ordering Party And To Deliver 1 New Usb Security Key For The Norma Expert Program, Which Will Enable The Operation Of The Software. 6. The Contractor Will Provide The Ordering Party With A Quality Guarantee For The Delivered Software For A Period Of At Least 24 Months From The Date Of Signing The Stage Acceptance Protocol. 7. If The Order Documents Indicate Trademarks, Patents Or Origin In Relation To Certain Materials Or Devices - The Ordering Party, In Accordance With Art. 99 Section 5 Pzp, Allows Offering Equivalent Materials Or Devices. Materials Or Devices From Specific Manufacturers Determine The Minimum Quality Parameters And Functional Features That The Materials Or Devices Offered By The Contractor Must Meet In Order To Meet The Requirements Set By The Ordering Party. Materials And Devices From Specific Manufacturers Constitute Only The Quality Standard Of The Subject Of The Order. The Term Minimum Quality Parameters And Functional Features Means That The Ordering Party Understands The Requirements For Materials Or Devices Contained In Publicly Available Sources, Catalogs And Manufacturers Websites. The Use Of Exemplary Manufacturers Names Is Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. The Use Of Product/Manufacturer Names Is For Example Purposes Only. By Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product In The Description Of The Subject Of The Order, The Ordering Party Also Allows Equivalent Products With Performance Parameters And Quality Features At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Or Better Parameters.8. In Each Case When The Ordering Party Describes The Subject Of The Order By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, It Allows Solutions Equivalent To Those Described.9. In Each Case Of Using A Specific Label Or Certificate Specified In Art. 104 And 105 Pzp, The Ordering Party Also Accepts All Other Markings Confirming That Construction Works, Supplies Or Services Meet Equivalent Requirements.10. In Cases Where The Contractor, For Reasons Beyond Its Control, Is Unable To Obtain A Label Or Certificate Specified By The Ordering Party Confirming That The Construction Works, Supplies Or Services Offered By It Meet Equivalent Requirements, The Ordering Party, Within The Deadline Set By Itself, Accepts Other Means Of Evidence, And In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Construction Works, Supplies Or Services Offered By Him Meet The Requirements Of Specific Marking Or Specific Requirements Indicated By The Ordering Party.11. The Use In The Swz Or Procurement Documents Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Report On Tests Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Features Specified In The Description Of The Subject Of The Contract, Offer Evaluation Criteria Or Contract Execution Conditions Means That The Ordering Party Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, If A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In A Timely Manner, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor, And Provided That The Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Contract, The Offer Evaluation Criteria Or The Terms Of Contract Execution.12. When Describing The Subject Matter Of The Contract By Reference To The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Pzp, The Ordering Party Allows Solutions Equivalent To Those Described.13. The Ordering Party May Not Reject The Offer Simply Because The Offered Supplies Do Not Comply With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Matter Of The Contract Refers, Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence In Question , Referred To In Art. 104-107 Pzp, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract.
