The Subject Of The Order Is The Provision Of Specialized Care Services For People (Including People With Autism) With Mental Disorders In Their Place Of Residence, Who Are Wards Of Gops In Top lka, Divided Into 6 Parts: 1) Part No. 1 - Specialized Care Services For People With Mental Disorders - Pedagogical And Psychological Classes - The Estimated Number Of Hours Of Service Provision Is On Average 76 Per Month;2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 4 To The Terms Of Reference. 3. Detailed Obligations Of The Contractor Regarding The Implementation Of The Subject Of The Contract Are Specified In The Draft Provisions Of The Public Procurement Contract - Annex No. 1 To The Terms Of Reference. 4. The Ordering Party Allows The Submission Of Partial Offers.5. The Number Of Lots For Which An Economic Operator May Submit A Tender Or The Maximum Number Of Lots For Which The Contract May Be Awarded To The Same Economic Operator, And The Criteria Or Rules Applicable To Determining Which Lots Of The Contract Will Be Awarded To A Single Economic Operator If Its Tender Is Selected In Greater Than The Maximum Number Of Lots: Each Contractor May Submit An Offer For Each Lot Constituting This Order, I.E. For 6 Lots.6. Employment Requirements Based On An Employment Relationship In The Circumstances Referred To In Art. 95 Of The Public Procurement Law: Pursuant To Art. 95 Section 1 Of The Public Procurement Law, Employment By A Contractor Or Subcontractor On The Basis Of An Employment Relationship Of Persons Performing Activities Related To The Implementation Of The Contract, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2022, Items 1510, 1700, 2140, Of 2023, Items 240, 641) Regarding Manual Workers Who Will Participate In The Implementation Tasks. In Order To Verify The Employment, By The Contractor Or Subcontractor, Under An Employment Contract, Of Persons Performing Activities Indicated By The Ordering Party In The Scope Of Contract Execution, The Ordering Party Requests In Particular: A Statement From The Contractor Or Subcontractor On The Employment Of An Employee Under An Employment Contract, Containing Information , Including Personal Data Necessary To Verify Employment Under An Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Responsibilities. The Above Will Be Provided To The Ordering Party No Later Than On The Date Of Conclusion Of The Contract. The Ordering Party Reserves The Right To Request From The Contractor At Any Time During The Execution Of The Subject Of The Order A Certified True Copy Of The Employment Contract Of The Employed Employee. If It Is Necessary To Introduce Changes In The Composition Of The Team Performing The Work, The Contractor Will Notify The Ordering Party About This Fact. During The Execution Of The Order, The Ordering Party Is Entitled To Perform Inspection Activities Towards The Contractor Or Subcontractor Regarding The Contractors Or Subcontractors Compliance With The Requirement To Employ Persons Performing The Activities Indicated Above Under An Employment Contract. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate.7. Variant Offers: The Ordering Party Does Not Allow The Submission Of Variant Offers. 8. The Ordering Party Does Not Require A Deposit. 9. Security For Proper Performance Of The Contract: The Ordering Party Does Not Provide For The Obligation To Provide Security For Proper Performance Of The Contract. 10. Electronic Auction: The Ordering Party Does Not Envisage Conducting An Electronic Auction After Evaluating The Offers In Order To Select The Most Advantageous Offer.11. Supplementary Orders: The Ordering Party Does Not Envisage Awarding Orders Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law12. Reimbursement Of Costs Of Participation In The Procedure: The Ordering Party Does Not Provide For Reimbursement Of Costs Of Participation In The Procedure.13. Dynamic Purchasing System: The Ordering Party Does Not Plan To Establish A Dynamic Purchasing System.14. Framework Agreement: The Ordering Party Does Not Conduct Any Proceedings To Conclude A Framework Agreement.15. The Ordering Party Does Not Reserve Any Requirements Or Requirements Related To The Execution Of The Order Referred To In Art. 94 And 96 Section 2 Points 2 Of The Act Pzp.16. The Ordering Party Does Not Provide For The Requirement Or Possibility Of Submitting Offers In The Form Of Electronic Catalogs Or Attaching Electronic Catalogs To The Offer In The Situation Specified In Art. 93 Of The Pzp.17 Act. The Ordering Party Pursuant To Art. 310 Of The Public Procurement Act Reserves The Right To Invalidate The Contract Award Procedure If The Public Funds That The Contracting Authority Intended To Use To Finance All Or Part Of The Contract Were Not Awarded To It.
