At Each Request Of The Ordering Party, The Contractor Is Obliged To Submit The Documents Referred To Above Principles Specified In The Draft Provisions Of The Agreement.►The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Maintenance Activities - The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2022, Item 1510). The Contractor Or Subcontractor Is Obliged To Employ People Under An Employment Contract At Least For The Duration Of The Contract Concluded Between The Contractor And The Ordering Party - Art. 281 Section 2 Points 7) Public Procurement Law Act And Art. 95 Of The Public Procurement Law). A) In Order To Document The Employment Of Persons As Above: The Contractor, Within Five Business Days From The Date Of Conclusion Of The Contract, Will Submit To The Ordering Party A List Of Persons Intended To Perform The Service, Where In The Content Of The List The Contractor Will Indicate Which Of The Specified Persons Are Employed. An Employment Contract Specifying The Type Of Activities Performed, The Period For Which The Contract Was Concluded And The Working Time. The List Should Be Submitted In The Form Of A Legible Written Statement Confirming The Facts Under Pain Of Criminal Liability. Personal And Other Data Should Be Marked As Protected And Not Subject To Disclosure Or Disclosure In Accordance With Applicable Law. If The List Of Employees... Constitutes A Business Secret, The Contractor Should Provide This Document With Appropriate Clauses. In Order To Verify Employment By The Contractor And/Or Subcontractor, On Based On An Employment Contract, Persons Performing Activities Indicated By The Ordering Party In The Scope Of Contract Execution, The Ordering Party Provides For The Possibility Of Requesting: 1) A Declaration Of The Employed Employee, 2) A Declaration Of The Contractor Or Subcontractor On The Employment Of An Employee Under An Employment Contract, 3) A Certified Copy Of The Original Employment Contract Of The Employed Employee, 4) Other Documents Containing Information, Including Personal Data, Necessary To Verify Employment Under The Employment Contract, In Particular The Name And Surname Of The Employed Employee, Date Of Conclusion Of The Employment Contract, Type Of Employment Contract And Scope Of Duties Employeeb) In The Scope Of Monitoring The Contractors Compliance With The Requirements Referred To Above (In Accordance With Art. 95 Section 2 Point 3) Of The Public Procurement Law) And Sanctions For Failure To Meet These Requirements: At The Stage Of Contract Implementation, At Each Request Of The Ordering Party, Within Five Business Days From The Date Of Request (In Writing Or By Fax Or E-Mail), The Contractor Will Provide The Ordering Party With Original Documents Confirming Employment On The Basis Of Employment Contracts Of The Persons Specified Above. ►The Contractor Is Obliged To Conduct Detailed Supervision Over The Performance Of The Service At Every Stage.
