5) Description Of The Subject Of The Order, Respectively, In Relation To One To Two Parts Of The Order.1. The Subject Of The Procedure And Order Is To Select A Contractor For Access To The Databases: The Cochrane Library And Pen: Practice-Based Evidence In Nutrition In 2024 And 2025 For The Jagiellonian University - Collegium Medicum In Krakow, Respectively, In Relation To One To Two Parts Of The Order. 1.1 Pursuant To Art. 310 Of The Public Procurement Act, The Ordering Party Provides For The Possibility Of Invalidating The Procedure In Question If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Granted To It.1.2 The Subject Of The Order Was Divided Into 2 (Two) Parts: 1.2.1 Part 1: Access To The Cochrane Library Database,1.2.2 Part 2: Access To The Pen: Practice-Based Evidence In Nutrition Database. 1.3 The Contractors Duties Will Include: 1.3.1 Providing The Medical Library Of The Jagiellonian University Medical College With Monthly Collective Statistical Analyzes Regarding The Use Of The Database By The Ordering Party In An Electronic Version (By E-Mail). 1.3.2 Updating The Database On An Ongoing Basis. 1.4 The Contractor Must Offer The Subject Of The Order In Accordance With With The Requirements Of The Ordering Party Specified In The Detailed Description Of The Subject Of The Order Included In Annexes A And B To Swz.1.5 The Contractor Declares That He Will Professionally Provide The Services That Are The Subject Of The Order And That He Has Appropriate Qualifications, Knowledge, Experience And Authorizations Necessary For The Proper Performance Of The Order. 1.6 The Contractor Guarantees And Declares That He Is Fully Entitled To Conclude The Contract On The Terms Specified Therein, In Particular He Has A Number Of Rights To The Database, All Legally Required Consents And Permits To Grant Licenses, And Accepts Responsibility For Any Claims Of Third Parties Arising In Connection With With The Implementation Of The Contract And Reported Against The Ordering Party In The Scope Of Use By The Ordering Party And Authorized Users Of The Subject Of The Contract In Accordance With Its Terms.1.7 The Contractor Represents And Assures The Ordering Party That The Rights To Use The Database That It Grants To The Ordering Party Do Not Violate The Rights Of Third Parties.1.8 The Contractor Guarantees The Highest Quality Services Provided, In Accordance With Generally Applicable Standards For Services Of This Type, And Declares And Ensures That The Rights It Grants To The Ordering Party Do Not Infringe The Rights Of Third Parties. 1.10 The Contractor Undertakes To Provide A License Agreement For The Cochrane Library Database Immediately After Concluding The Agreement, But Not Later Than 30 Days From The Date Of Conclusion Of The Contract.* Applies To Part 1 Of The Subject Of The Order. The Contractor Should Provide Permanent, Uninterrupted Online Access To The Databases Covered By This Contract Using The Ip Addresses Indicated In Annex 2 To The Contract.1.11 Authorized Users Referred To In Paragraph 2 Are Students Of The Ordering Party And Persons Employed By The Ordering Party (Including Permanent, Temporary And Scientific Employees Of The Ordering Party Participating In Scientific Exchange), However, Persons Other Than Those Mentioned Above Are Also Entitled To Use The Database In The Reading Room Of The Jagiellonian University Medical Library. 1.12 Detailed Scope Of Responsibilities The Contractors And The Method Of Providing The Service Are Specified In The Provisions Of The Contract.1.13 The Ordering Party Allows The Submission Of Equivalent Offers. Each Contractor Submitting An Equivalent Offer, In Accordance With The Provisions Of The Public Procurement Law, Is Obliged To Demonstrate In The Content Of His Offer That The Subject Of The Contract He Offers Meets The Configuration, Technical And Functional Parameters And Required Conditions Specified In The Tor, Or Provides Better Solutions Than Those Described. Equivalence Means That The Offered Products Must Have At Least The Same Configurations, Technical And Functional Parameters And Conditions Required At A Level At Least As Described In The Swz. In Accordance With The Provisions Of The Public Procurement Law, The Contractor Is Obliged To Demonstrate Equivalence In The Content Of The Submitted Offer. When Offering Solutions Other Than Those Described In The Swz, The Contractor Must Demonstrate In Detail In The Offer Their Equivalence With The Conditions And Requirements Described In The Swz, And Is Obliged To Attach To The Offer Detailed Descriptions Showing The Configuration, Technical And Functional Parameters As Well As Conditions Allowing For The Assessment Of Compliance Of The Offered Solutions. Products With Swz Requirements. In Particular, The Contractor Is Required To Provide The Name Of The Manufacturer, The Name Of The Offered Product And A Detailed Description Of Its Configuration, Technical And Functional Parameters And The Fulfillment Of The Required Conditions (Complete Product Cards, Brochures, Catalogues, Folders, Etc.). Pursuant To Art. 101 Section 5 Of The Public Procurement Law, If The Description Of The Subject Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In The Public Procurement Law, The Ordering Party May Not Reject The Offer Only Because The Offered Construction Works, Supplies Or Services Do Not Comply With With Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Order Refers, Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.2. The Contractor Should Complete And Sign The Offer Form Together With Attachments Or Submit An Offer Corresponding To Their Content, Using A Qualified Electronic Signature, Trusted Signature Or Personal Signature, And Post It On The E-Procurement Platform, Available At Http://Ezamowienia.Gov.Pl. Attention! The Offer Must Be Provided With The Appropriate Signature Before It Is Encoded.3. The Contractor Must Attach To The Offer All Documents, Declarations And Attachments Presented In The Swz, Signed Using A Qualified Electronic Signature, Trusted Signature Or Personal Signature.4. The Ordering Party Provides For The Possibility Of Calling On Contractors To Provide Explanations Regarding The Submitted Offer.5. The Conditions For The Execution Of The Order Are Included In The Draft Provisions Of The Contract Contained In Swz.6. Designation Of The Subject Of The Contract According To The Common Procurement Vocabulary Cpv Code: 72320000-4 - Database Services.7. Subcontracting.7.1 The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S).7.2 The Ordering Party Does Not Reserve Any Personal Obligation For The Contractor To Perform Key Parts Of The Order.7.3 If The Contractor Announces Entrusting Part Of The Order To Subcontractors, Their List (Names, Companies) Must Be Attached To The Offer. With The Scope Of Tasks Entrusted To Them (Parts Of The Contract), If Known At The Stage Of Submitting Offers. 7.4 Entrusting Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For Proper Performance Of The Order.6) Deadline For Order Completion, Respectively In Relation To One To Two Parts Of The Order.1. The Contractor Must Ensure The Implementation Of The Subject Of The Order Within: A) Within The Scope Of Part 1 From January 1, 2024 To December 31, 2025. B) In The Scope Of Part 2 From January 1, 2024. Until December 31, 2025
