The Subject Of The Order Is The Performance Of Post-Consolidation Development Works On The Task Construction Or Reconstruction Of Agricultural Transport Roads, Renovation Of Drainage Ditches And Land Reclamation” For The Project Entitled Consolidation Of Land In The Village Of Żurawiczki, Zarzecze Commune Under The Measure Support For Investments Related To Development, Modernization And Adaptation Agriculture And Forestry” Covered By The Rural Development Program For 2014 – 2020”. 2. The Scope Of Works Includes: 1) Construction Or Reconstruction Of Access Roads To The Land Agricultural And Forestry Areas As Well As Access Roads To The Buildings Of Individual Consolidation Participants. 2) Correction Of The Course And Improvement Of Technical Parameters Of Water Drainage Devices Or Other Water Devices. 3) Elimination Of Unnecessary Edges And Roads And Construction Recultivation Procedures Enabling Mechanical Cultivation Of Land. 4) Reconstruction Low Voltage Overhead Line, Reconstruction Of The Overhead Connection, Protection Overvoltage . 5) Reconstruction Of The Overhead Telecommunications Line With Wires Isolated. 3. The Detailed Scope Of Works Is Specified In The Design Documentation Annex No. 1 To The Swz. 4. Equivalent Solutions: 1) If In The Documentation Design Or Stwiorb, I.E. Indicated In The Documents Describing The Subject Of The Order Trademarks, Patent Or Origin, Sources Or Particular Process That Characterizes Products Or Services Provided By A Particular Contractor And Such References Was Not Accompanied By The Phrase Or Equivalent, The Ordering Party Allows Solutions Equivalent To Those Described And Such An Indication Should Be Supplemented With Or Equivalent. Purchaser Does Not Limit The Contractors Ability To Use Equivalent Devices And Materials, With Parameters Not Worse Than Those Described In The Documentation. 2) The Ordering Party Describing The Item Procurement By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, In Accordance With Art. 101 Section 4 Of The Public Procurement Law Allows For Equivalent Solutions Described. Pursuant To Art. 101 Section 5 Of The Public Procurement Law If The Description Of The Subject Of The Contract Refers To The Standards, Technical Assessments And Technical Reference Systems Referred To Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Who Refers For Equivalent Solutions Is Obliged To Prove It In The Offer, In Particular By Means Of The Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law, As Proposed Its Solutions Equally Meet The Requirements Specified In The Description Subject Of The Order. Pursuant To Art. 101 Section 6 Of The Public Procurement Law If The Description Of The Subject Procurement Refers To The Performance Or Functionality Requirements Referred To Referred To In Art. 101 Section 1 Point 1 Of The Public Procurement Law, The Contractor Who Relies On The Solutions Equivalent, Provided That They Comply With The Standards (Polish Standard Transposing The Standard European, Standards Of Other Member States Of The European Economic Area Transposing European Standards, With European Technical Assessment, With A Common Specification Technical Standard, An International Standard Or An Established Technical Reference System By A European Standardization Body) Is Obliged To Prove In The Offer, In Particular Using The Means Of Evidence Referred To In Art. 104-107 Of The Act Pzp That The Construction, Supply Or Service Meets The Performance Requirements Or Functionalities Specified By The Ordering Party. 3) The Ordering Party Does Not Require Submission The Means Of Evidence In Question, Unless The Contractor Uses Them Proves Equivalence To Standards, Technical Assessments, Technical Specifications And Systems Technical References Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act Pzp And The Performance Or Functionality Requirements Referred To In Art. 101 Section 1 Point 1 Of The Public Procurement Law, And Described By The Ordering Party, In Accordance With The Above Subsection 2. 5. Employment Requirements Based On The Employment Relationship, In Circumstances Referred To In Art. 95 Pzp Act 1) The Ordering Party Requires Employment By A Contractor Or Subcontractor Based On The Employment Relationship Of Persons Who In The Course Of They Will Perform Activities Directly Related To The Execution Of The Order In Question In Performing Specific Physical Work Related To The Performance Of Works In The Scope Preparation Of The Site For Construction And Earthworks, Road Works, Recultivation And Melioration (Workers). The Above Requirement Does Not Apply To Persons Performing Independent Work Technical Functions In Construction, People Performing Surveying Services, Suppliers Construction Materials As Well As Persons Performing Temporary/Ancillary Work. The Obligation To Employ Under An Employment Contract Also Does Not Apply To The Following Situations: Where The Contractor, Subcontractor Or Further Subcontractor Personally Performs The Above Activities (E.G. A Natural Person Running A Business, Partners Of A Company Civil). 2) The Ordering Party Decides That: A) The Contractor Is Obliged To: Performing The Activities Listed In Point 1 Were Employed To Perform The Contract For Based On An Employment Relationship Within The Meaning Of The Provisions Of The Labor Code. B) Contractor Obliged Is That Persons Performing The Above-Mentioned Activities Are Employed On The Basis Of Employment Relationship During The Term Of The Contract, At Least For The Period Of Performance Of The Relevant Contracts Activities. C) Method Of Verifying The Employment Of These People And The Authorizations Of The Ordering Party In Terms Of Monitoring The Contractors Compliance With Employment Requirements These Persons And The Sanctions For Failure To Meet These Requirements, The Contracting Authority Specified In Draft Contract – Annex No. 10 To The Swz.
