Tenders Are Invited For Comprehensive Supply Of Natural Gas Along With The Provision Of Natural Gas Distribution Services For Facilities Owned By The Krzeszowice Commune.
1. The Subject Of The Order Is The Comprehensive Supply Of Natural Gas And The Provision Of Natural Gas Distribution Services To Facilities Owned By The Krzeszowice Commune, Indicated In Annex No. 5 To The Swz. 2. Gas Should Be Supplied In Accordance With Applicable Law, In Particular Under The Conditions Specified In The Energy Law Act Of April 10, 1997 And In The Implementing Regulations To This Act. 3. The Ordering Party Will Award A Contract For A Comprehensive Service, Within The Meaning Of Art. 3 Point 30 Of The Energy Law, Implemented On The Basis Of The Comprehensive Agreement Referred To In Art. 5 Section 3 Of This Act. 4. The Supply Of Gas And The Provision Of Distribution Services Will Take Place Under The Conditions Specified In The Provisions Of The Energy Law, The Civil Code And The Implementing Regulations Issued On Their Basis. 5. The Operator Of The Gas Distribution System Is Polska Sp ka Gazownictwa Branch In Krak w. 6. The Current Gas Seller Is Pgnig Obr t Detaliczny Sp. Z O. O., Ul. Jana Kazimierza 3, 01-248 Warszawa. The Contract Does Not Require Notice. The Indicated Consumption Point Numbers, Tariff Groups And Ordered Hourly Capacities Are Consistent With The Information Indicated On The Invoices Issued By The Current Seller. 7. The Total Estimated Consumption Of Natural Gas [Kwh] During The 24-Month Period Starting From March 1, 2024 Is 503,060 Kwh. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 5 To The Swz. The Specified Amount Is An Estimate, The Ordering Party Provides For The Possibility Of Changing The Quantity Of Received Natural Gas In The Range Of +/- 30% Without The Need To Incur Additional Costs. 8. The Given Price Should Include All Costs Related To The Implementation Of The Subject Of The Order, I.E.: For The Supply Of Natural Gas And The Provision Of Distribution Services, Vat, Possible Discounts And Rebates And Other Costs Necessary To Perform The Subject Of The Order. The Gross Offer Price Will Be The Maximum Gross Value Of The Contract That Will Be Concluded With The Contractor. 9. The Ordering Party Allows For Changes In Net Unit Prices During The Term Of The Distribution Contract In The Event Of The Introduction Of New Distribution System Operator Tariffs Approved By The Decision Of The President Of The Energy Regulatory Office. The Price Offered For Gas Supply Is To Be Unchanged Throughout The Term Of The Contract. 10. The Price For Fuel And Subscription Will Be Fixed Throughout The Duration Of The Contract, But Only Fixed And Variable Network Rates May Be Changed, Unless These Rates Change As A Result Of The Approval Of The New Dso Tariff. 11. The Ordering Party Is Not A Payer Of Excise Tax. 12. Gas Should Be Delivered 24 Hours A Day To The Delivery And Reception Points Listed In Annex No. 5 To The Swz, Which Is A Set Of Gas Devices Used To Connect The Internal Network, Owned By The Ordering Party, To The Gas Network Of The System Operator. 13. The Contractor Will Be Obliged To Ensure The Standards And Quality Of Service For The Ordering Party In Accordance With Applicable Energy Law Provisions In This Respect. It Should Ensure Continuity Of Supplies Without Any Interruptions In Supplies And Have A Reserve Guaranteeing Continuity Of Supplies. 14. The Contractor Is Obliged To Have A Current Contract With The Distribution Network Operator (Except For The Operator Itself) Operating On The Premises Of The Ordering Party, Enabling The Sale Of Gaseous Fuel Via The Distribution Network To Gas Collection Points. 15. The Ownership Of The Gas Fuel Is Transferred To The Ordering Party After Measurement At The Outlet Of The Gas Meter. 16. As Part Of The Comprehensive Agreement, The Contractor Is Responsible For Ensuring Gas Measurement At Power Consumption Points In Accordance With Applicable Law And Dso Conditions. 17. The Demand For Gas Fuel Was Used To Calculate The Estimated Value Of The Order And May Differ From The Actual Use Of Gas Fuel, And In No Case May It Constitute The Basis For Any Claims On The Part Of The Contractor. Note: The Forecasted Gas Consumption Is Indicative Because It Is Not Possible To Determine In Advance The Amount That Will Be Delivered To The Ordering Party And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Gas Fuel In The Given Quantity. During The Execution Of The Order, The Ordering Party Reserves The Right To Reduce Or Increase The Total Amount Of Purchased Gas Fuel In Relation To The Amount Specified In The Swz (Including Annexes). The Occurrence Of The Circumstances Referred To Above Will Result In A Corresponding Reduction Or Increase In The Remuneration Due To The Contractor For The Implementation Of The Subject Of The Order. 18. The Ordering Party Requires That The Amount Of Supplied Gas Be Settled On A Monthly Basis, Based On The Actual Reading Of The Measurement System, According To The Prices And Rates Specified In The Contractors Offer (Price Form Constituting Annex No. 1A To The Swz). 19. The Contractor Is Obliged, Pursuant To The Power Of Attorney Granted By The Ordering Party For This Purpose, To Terminate The Existing Comprehensive Agreement For The Supply Of Gas Fuel And To Carry Out The Procedure For Changing The Gas Fuel Supplier, In Accordance With The Instruction For Operation And Operation Of The Distribution Network Regarding The Provision And Use Of Gas Fuel Distribution Services , Approved By The President Of The Energy Regulatory Office. 20. The Supplied Natural Gas Should Meet Legal Requirements And Technical Parameters In Accordance With The Provisions Of The Act Of April 10, 1997. Energy Law (Consolidated Text: Journal Of Laws Of 2021, Item 716, As Amended) And Implementing Acts Issued On Its Basis And The Act Of February 16, 2007.
