Regardless Of The Above-Mentioned Concept Of Solutions - All Road Elements Should Be Designed In Accordance With Applicable Regulations.4. A Telecommunication Sewage System Should Also Be Designed Along The Road In Question Or A Derogation Should Be Obtained. The Designed Road Should Be Connected To The Existing Road Network Through Intersections Or Public Exits.5. The Design Documentation Should Also Provide For Drainage Of Road Lanes Along Their Entire Section. Optimal Solutions For Water Management Should Be Designed By Building Collectors, Ditches, Storm Sewage Systems Or Reservoirs. The Documentation Should Meet The Requirements Contained In The Applicable Legal Regulations.6. The Scope Also Includes Obtaining The Necessary Decisions, Agreements And Conditions On Behalf Of The Ordering Party In Order To Have The Right To Use The Land By The Ordering Party For Construction Purposes, As Well As Obtaining (If Required Under Separate Regulations) An Environmental Decision, Water Permit And Obtaining The Necessary Arrangements And Conditions For The Execution Of The Subject Of The Order.7. Obtaining, On Behalf Of The Ordering Party, The Final Decision Authorizing The Implementation Of A Road Investment (Zrid) And Other Necessary Decisions And Arrangements. For The Entire Task Specified In Section 2. One Decision Must Be Obtained Permitting The Implementation Of A Road Investment.8. The Order Includes The Preparation Of Design Documentation, Legal And Formal Studies: 1) Construction Design (Pb) In Accordance With Current Regulations - Pzt + Pab; 2) Obtaining, On Behalf Of The Ordering Party, The Final Decision Authorizing The Implementation Of A Road Investment (Zrid) And Other Necessary Decisions And Arrangements; 3) Technical Design (Pt) In Accordance With Current Regulations;4) Investors Cost Estimates And Bills Of Quantities;5) Technical Specifications For The Execution And Acceptance Of Works (Stwior);6) Permanent Traffic Organization Design;7) Temporary Traffic Organization Design;8) Geotechnical Documentation; 9) Bioz Information;10) Preparing Answers To Questions And Modifying Design Studies At The Stage Of Public Procurement Proceedings;11) Performing Authors Supervision As Part Of The Price Offer For The Preparation Of Design Documentation.9. All Documentation Must Be Prepared In Paper Version In 5 Copies (Including 3 Copies For Submitting The Zrid Application) And In Electronic Version On Cd (Descriptive Parts In Pdf And Doc Format, Drawing Parts In Pdf And Dwg, Quantities And Cost Estimates In Pdf And Xls). .10. The Order Of Preparation Of The Studies: 1) Preparation Of Design Studies As Part Of The Construction Project As A Conceptual Design And Then Obtaining The Employers Approval During The Development For The Adopted Solutions (At Least As Part Of The Conceptual Design, Presentation Of The Land Development Design (Pzt), Longitudinal Profile, Normal Sections);2) Obtaining The Required Decisions, Arrangements, Opinions, Permits And Permits;3) Preparing Complete Applications And Obtaining Appropriate Decisions And Permits On Behalf Of The Ordering Party;4) Submitting Complete Documentation Together With The Obtained Opinions, Arrangements And Decisions To The Ordering Party, Including The Environmental Decision And Water Permit -Legal And Confirmation Of The Submitted Complete Application For A Decision On Permission To Implement A Road Investment.11. The Tender Documentation Includes: 1) Construction And Executive Design (Or Construction And Executive Design) In Accordance With Current Regulations; 2) Temporary And Permanent Traffic Organization Design; 3) Technical Specifications For The Execution And Acceptance Of Construction Works; 4) Preparation Of Bills Of Quantities For Each Industry Separately In Accordance With Applicable Regulations And With The Road Division Indicated By The Ordering Party; 5) Preparation Of Investor Cost Estimates Separately For Individual Industries, And With The Road Division Indicated By The Ordering Party. All Elements Of Cost Estimates Should Be Marked With Appropriate Cpv Codes;6) Development Of Detailed Technical Specifications For The Execution And Acceptance Of Construction Works (In Accordance With Applicable Regulations) Separately For Individual Industries.12. Obtaining A Decision To Implement A Road Investment: 1) The Contractor Will Submit To The Competent Architectural And Construction Administration Authority A Complete Application For A Decision To Authorize The Implementation Of A Road Investment; 2) Before Submitting The Application For The Decision Referred To In Point 1), The Contractor Is Obliged To Determine With The Ordering Party Whether The Application Should Also Include An Application For The Immediate Enforceability Of This Decision; 3) The Contractor Will Provide The Ordering Party With An Application Confirming Receipt And Date Of Receipt, Submitted To The Competent Administrative Authority, For Issuing A Decision To Authorize Implementation Of A Road Investment Together With The Applicable Annexes To The Application And A Complete Set Of Documentation;4) If Deficiencies Are Demonstrated By The Authority Conducting The Proceedings, The Contractor Is Obliged To Introduce Appropriate Changes And Additions Within The Deadline Specified By This Authority;5) After Receiving The Decision To Authorize The Implementation Of The Road Investment This Decision Should Be Communicated To The Ordering Party Along With The Finality And Finality Clause;6) The Contractor Is Responsible For The Compliance Of The Bill Of Quantities With The Project. In The Event Of Inquiries From Bidders During The Public Procurement Procedure For The Implementation Of Works, The Contractor Is Obliged To Respond To The Je owe Commune Office Within 24 Hours;7) All Fees For Obtaining Decisions, Arrangements, Opinions And Other Fees Not Mentioned Are Borne By The Contractor;8) The Handover And Acceptance Of The Subject Of The Order Will Take Place On The Basis Of The Delivery And Acceptance Protocol And The Contractors Statement On The Completeness Of The Project And That The Project Was Carried Out In Accordance With With The Contract, Applicable Regulations, Standards And Is Complete From The Point Of View Of The Purpose It Is Intended To Serve.13. Payments: 1) 80% Of The Value Of The Task According To The Contract, After Submitting An Application For A Decision To Implement A Road Investment Together With A Complete Construction Design (2 Additional Copies) And Submitting The Remaining Documents Described Above To The Ordering Party; 2) 20% Of The Value Of The Task According To The Contract After Obtaining By The Contractor Of The Final Decision To Implement The Road Investment And Delivery Of The Approved Construction Design (1 Copy) To The Ordering Party. 14. As Part Of The Performance Of The Subject Of The Contract, The Contractor Will Also Be Obliged To: 1) Prepare Answers To Questions And Modify Design Studies At The Stage Of The Public Procurement Procedure For The Implementation Of Works Covered By The Completed Documentation; 2) Prepare Answers To Questions From Contractors Carrying Out Works On The Basis Of The Completed Documentation; Documentation And Modification Of Design Studies At The Stage Of Execution Of Construction Works, When It Will Be Necessary And Necessary For The Proper Implementation Of Construction Works Based On The Prepared Documentation;3) To Perform Authors Supervision;4) To Divide The Study (Including Cost Estimates) Into Implementation Stages At The Request Of The Ordering Party.15. The Contractor Will Exercise Authors Supervision In The Manner And On The Terms Specified In The Act Of July 7, 1994, Construction Law, And The Costs Of Authors Supervision Should Be Included In The Offer Price. The Contractor Is Obliged To Exercise Authors Supervision Personally Or Through Designers Corresponding To The Industries Of The Individual Design Industries Appearing In The Design Documentation Of The Investment In Question. Authors Supervision Will Be Performed According To The Needs Resulting From The Progress Of Works. Authors Supervision Will Be Exercised From The Date Of Commencement Of Construction Works To The Date Of Completion Of All Works Covered By The Design Documentation. 16. If The Materials Describing The Subject Of The Order Contain Trademarks, Patents Or Origin, Source Or Detailed Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Ordering Party Allows Materials And/Or Solutions Equivalent To Those Described, Provided That The Technical, Quality And Functionalities Not Worse Than Those Indicated In The Documentation And Not Leading To A Change In Technology. The Names Indicated In The Documentation Should Be Treated As Examples. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate In The Offer That The Construction Works And Materials Used/Delivered As Part Of The Subject Of The Order Offered By Him Meet The Requirements Specified By The Ordering Party.
