The Subject Of The Order Is A Comprehensive Supply Of Gaseous Fuel (High-Methane Natural Gas Type E) Within The Meaning Of The Act Of April 10, 1997 - Energy Law (Consolidated Text: Journal Of Laws Of 2022, Item 1385, As Amended), Hereinafter Referred To As The Energy Law, Covering The Sale And Distribution Of Gaseous Fuel For The Needs Of The Ordering Party In The Period From January 1, 2024 To December 31, 2024 To Installations Located In The Following Buildings (Receipt Locations):3.3. School Complex Named After Commission Of National Education In Tymbark (Substation) 34 -650 Tymbark 349 (Tariff W-5.1_Ta)3.4. School Complex Named After Commission Of National Education In Tymbark (Dormitory) 34- 650 Tymbark 348 (Tariff W-.3.6_Ta)3.5. School Complex Named After Commission Of National Education In Tymbark (School) 34 -650 Tymbark 349 (Tariff W-3.6.Ta)3.6. The Total Expected Consumption Of Gas Fuel (For All Collection Points) Is: 572,379 Kwh. 3.7. The Estimated Amount Of Gas Fuel Consumption (Total And For Individual Collection Points, In Accordance With Annex No. 3 To The Swz) May Differ From The Actual Consumption Of Gas Fuel During The Term Of The Contract. This Quantity Is Only Indicative For Comparison Of Submitted Offers And In No Case Does It Constitute An Obligation On The Part Of The Ordering Party To Purchase Gaseous Fuel In The Given Quantity. The Contractor Will Not Be Entitled To Any Claim For Failure To Collect The Expected Amount Of Gas Fuel By The Ordering Party. The Contractors Remuneration Will Be Calculated According To The Unit Prices Specified In The Offer And The Amount Of Actual Gas Fuel Consumption At Individual Collection Locations. Settlements For The Sale And Distribution Of Gas Will Be Made Based On The Readings Of The Measurement And Billing System (Data Provided By The Distribution System Operator, Hereinafter Referred To As Dso), Separately For Each Reception Location. The Ordering Party Guarantees The Contractor That It Will Collect At Least 90% Of The Estimated Amount Of Electricity Specified In Point 3.3.3.8. The Contractor Will Supply Gas Fuel In Accordance With The Applicable Quality Standards Of Customer Service. 3.9. The Supply Of Gaseous Fuel Will Be Based On A Comprehensive Contract For The Sale And Distribution Of Gaseous Fuel And Will Be Performed In Accordance With Applicable Law, In Particular Under The Conditions Specified By The Energy Law And The Implementing Regulations To This Act.3.10. The Cost Of The Subject Of The Order Consists Of: 3.11. Fee For Consumption (Sale) Of Natural Gas,3.12. Subscription Fee,3.13. Fixed Distribution Fee,3.14. Variable Distribution Fee.3.15. The Contractors Obligations Will Include Timely Performance Of All Activities And Arrangements With The Dso Necessary To Carry Out The Procedure For Changing The Seller, Starting From Submitting To The Dso A Notification On Concluding A Contract For The Sale And Distribution Of Gas Fuel.3.16. The Ordering Party Will Provide The Contractor With An Appropriate Power Of Attorney To Carry Out The Necessary Formalities So That It Is Possible To Effectively Conclude A New Contract Enabling The Commencement Of Services Within The Time Specified In Point 5 Of The Swz. The Ordering Party Will Provide Any Missing Data To Complete The Sellers Change Applications. Carrying Out These Activities Is Part Of The Subject Of The Contract. The Cost Of Changing The Seller Is Borne By The Contractor.3.17. The Contractor Will Be Responsible For The Entire Process, Including The Course And Timely Execution Of The Order, Quality, Compliance With The Technical And Quality Conditions Specified For The Subject Of The Order. Due Diligence Is Required When Executing The Order, Understood As The Diligence Of A Professional In The Activities Covered By The Subject Of This Order.3.18. A Detailed Description Of The Subject Of The Order Constitutes Annex No. 3 To The Swz And The Draft Provisions Of The Contract Constituting Annex No. 4 To The Swz.3.19. The Ordering Party Does Not Divide The Order Into Parts And Therefore Does Not Allow The Submission Of Partial Offers. Offers That Do Not Include The Full Scope Of The Subject Of The Order Will Be Rejected.3.20. Reasons For Not Dividing The Contract Into Parts: The Ordering Party Refrained From Dividing The Contract Into Parts, Which Could Include The Supply And Distribution Of Gas To Buildings/Receipt Points, Because Such A Division Of The Contract Into Parts Would Not Bring Any Economic Benefits For The Ordering Parties And Would Not Affect The Quality Order Being Performed. 3.21. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Tasks In Accordance With Art. 121 Of The Act Pzp.3.22. The Declaration Referred To In Art. 62Bb Of The Act Of April 10, 1997 Energy Law Constitutes Annex No. 5 To The Swz. If The New Tariff Is Approved By The President Of The Energy Regulatory Office, The Ordering Party Agrees To Change The Rates For Gas Fuel And Subscription Fees.3.28. If The New Tariff Is Approved By The Energy Regulatory Office, The Ordering Party Agrees To Change The Rates For Gas Fuel And Subscription Fees
