1. The Subject Of The Order Is The Provision Of Services For Manual Dismantling Of Bulky Waste And Sorting/Finishing Of Construction Waste At Zakład Gospodarki Odpadami S.A. In Bielsko-Biała At Ul. Krakowska 315 D.2. The Scope Of Work Includes: 1) Manual Disassembly Of Large-Size Waste Using Simple Tools Provided By The Contractor (Hammers, Axes, Crowbars, Hand Saws, Etc.) And Loading Of Separated Raw Materials Into Appropriate Containers; 2) Manual Sorting/Cleaning Of Construction Waste; 3) Maintaining Order At The Workplace And In The Adjacent Surroundings; 4) If It Is Not Possible To Perform The Services Of Dismantling Large-Sized Waste, Manual Sorting/Cleaning Of Construction Waste, The Ordering Party May Commission The Contractor To Work At The Composting Plant, Operating The Glass Or Styrofoam Sorting Line, Including Operating The Briquetting Press. 3. The Service Will Be Provided: 1) By 3 Trained Employees; 2) Monday To Friday From 7:00 A.M. To 3:00 P.M. The Ordering Party Reserves The Right To Modify Working Hours, Including The Number Of Hours Per Shift, Of Which It Will Inform The Contractor At Least 24 Hours Before The Planned Modification.4. The Estimated Number Of Man-Hours Per Employee In Providing The Service Being The Subject Of The Contract Is 160 Man-Hours Per Month (1,920 Man-Hours Over A 12-Month Period). The Ordering Party Stipulates That The Given Number Of Man-Hours Is An Estimate And May Be Changed Depending On The Ordering Partys Needs Without Financial Consequences. The Ordering Party Ensures That The Minimum Number Of Man-Hours For All Employees Will Be: 4,000.5. Pursuant To The Provisions Of Art. 95 Of The Public Procurement Law, The Ordering Party Requires That At Least 3 Persons Involved In The Execution Of The Order, Performing Activities Necessary To Perform The Contract, And Regarding Activities Related To The Manual Dismantling Of Large-Sized Waste And The Sorting/Refining Of Construction Waste, Are Employed Under An Employment Contract Within The Meaning Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465, As Amended). The Employment Obligation Applies Throughout The Entire Period Of Performance Of The Above-Mentioned. Activities During The Term Of The Contract And Applies To Both The Contractor And The Subcontractor. 6. The Contractor Provides Protective Vaccinations For Employees, In Particular Against: Jaundice, Tetanus, Typhoid Fever, Hepatitis A, Hepatitis B.7. The Contractor Takes Full Responsibility For Matters Related To Occupational Health And Safety Of Employees Involved In The Implementation Of The Contract.8. The Contractor Is Obliged To Comply With All Applicable Legal Provisions And Special Conditions And/Or Internal Regulations In Force On The Premises Of The Ordering Party, And Also Ensure That Their Employees Comply With Them. This Applies In Particular To Compliance With The Requirements Relating To: 1) Labor Law And Social Security; 2) Occupational Health And Safety; 3) Fire Protection; 4) Environmental Protection; 5) Road Traffic. Due To The Above, The Contractor Undertakes Full Liability For Any Adverse Effects Resulting From His Actions, Oversights Or Negligence In The Field Of Safety, Health, Fire Protection And Environmental Protection Towards Zgo S.A., The Place Of Work, As Well As Any Third Party. 9. The Contractors Staff Is Obliged To Keep Secret All Information Obtained On The Premises Of The Ordering Party And Maintain Confidentiality. 10. The Ordering Party Will Provide The Contractor With Cloakrooms Free Of Charge And Will Allow The Use Of Social Rooms For The Duration Of The Services. 11. The Contractor Provides Its Employees With Working And Protective Clothing And Equipment In Accordance With Occupational Health And Safety Rules And Regulations. Protective Clothing Must Be Adapted To The Nature Of The Work Performed And Agreed With The Employers Occupational Health And Safety Services. 12. The Contractor Is Responsible For Disinfecting And Washing The Work Clothes Of His Employees. 13. The Contractor Will Pay The Ordering Party A Monthly Lump Sum Of Pln 60.00 Net For Each Employee For The Use Of Tap Water By The Contractors Employees For Sanitary And Hygienic Purposes. 14. The Contractor Will Pay The Ordering Party For Providing Regeneration Meals For The Contractors Employees In Accordance With Submitted Invoices For The Costs Incurred By The Ordering Party In This Respect. 15. The Ordering Party May Request The Contractor To Replace An Employee Who Does Not Perform His Duties Properly Or Whose Behavior Deviates From Generally Accepted Principles. 16. In The Event Of Any Damage In Connection With The Service Provided, The Ordering Party Has No Right To Withhold Payment To The Contractor For This Reason. 17. The Contractor Is Fully Liable For Any Damage Caused By His Employees On The Premises Of The Ordering Party. 18. For Losses Or Damages Found Attributable To The Contractor, The Contractor Will Pay Compensation According To A Separate Calculation By The Ordering Party Within 30 Days From The Date Of Invoice Issuance. 19. A Change In Prices On The Initiative Of The Contractor For The Provision Of Services Is Permissible In The Form Of An Annex To The Contract In The Event Of A Change In The Amount Of The Minimum Remuneration For Work Or The Amount Of The Minimum Hourly Rate In Proportion To Its Increase, Established On The Basis Of The Provisions Of The Act Of October 10, 2002 On Minimum Remuneration. For Work. 20. The Contractor Is Obliged To Familiarize His Employees With The Instructions In Force At The Ordering Party Regarding Protecting Them Against Risk To Life And Health. 21. In The Event Of An Accident At Work Of An Employee Of The Contractor, The Ordering Party Is Obliged To Immediately Notify The Contractor About It And Provide Him With All Assistance In Investigating The Circumstances And Causes Of The Accident.22. The Contractor May Not Entrust The Performance Of Services To Other Entities Without The Written Consent Of The Ordering Party. 23. The Price Indicated In The Offer Should Include All Costs Related To The Execution Of The Order.
