Main Subject Of The Contract According To The Common Procurement Vocabulary (Cpv): 09123000-7 Natural Gas 65210000-8 Gas Transmission4. The Subject Of The Order Will Be Implemented In Accordance With The Provisions Of The Act Of April 10, 1997 - Energy Law (Journal Of Laws Of 2022, Item 1385, As Amended) And The Implementing Acts Issued On Its Basis. The Quality Of The Delivered Subject Of The Order Must Comply With The Polish Standard Pn-C-04750 Gas Fuels - Classification, Marking And Requirements. The Distribution System Operator Is Responsible For The Quality Of The Subject Of The Order, In Accordance With The Regulation Of The Minister Of Economy Of July 2, 2010 - On Detailed Conditions For The Operation Of The Gas System (Consolidated Text: Journal Of Laws Of 2018, Item 1158, As Amended).5. The Contractor Undertakes To Sell High-Methane Natural Gas Type E And Ensures Its Distribution To The Ordering Party On A Continuous Basis Throughout The Duration Of The Contract. The Contractor Is Obliged To Carry Out All Activities And Arrangements With The Distribution System Operator Necessary To Carry Out The Supplier Change Procedure And Conclude A Distribution Contract On Behalf Of The Ordering Party. The Ownership Of The Gas Fuel Is Transferred To The Ordering Party Within The Ownership Limit Of The Distribution System Operators Gas Network Specified In The Conditions Of Connection To The Gas Network. As Part Of The Execution Of The Subject Of The Order, Settlements For The Consumption Of Gas Fuel Will Be Based On The Actual Reading Of The Measurement System.6. Estimated Annual Consumption: Specified In Annex 3.7. Consumption Of Gas Fuel By The Ordering Party In The Last 12 Months: In Accordance With Annex No. 3.8. The Given Natural Gas Consumption During The Contract Period Is An Estimated Amount Used To Calculate The Offer Price, Compare Offers And Select The Best Offer. It Does Not Constitute An Obligation For The Ordering Party To Purchase Natural Gas In The Specified Quantity. Actual Consumption Will Result From The Current Demand Of The Ordering Party. The Contractor With Whom The Ordering Party Signs A Contract Is Not Entitled To Any Claim For The Supply Of Natural Gas In The Amount Specified In Annex No. 3 To Swz.9. The Current Gas Supply Contract Is Concluded Until December 31, 2023 With Pgnig Obr t Detaliczny Sp. Z O. O. Warsaw.10. The Ordering Party Does Not Envisage Dividing The Order Into Parts And Does Not Allow The Submission Of Partial Offers. Awarding The Order To Several Contractors May Result In An Increase In Gas Prices At Each Of The Ordering Partys Consumption Points. It Should Also Be Mentioned That Dividing The Contract Into Parts May Involve Excessive Technical Difficulties Or Excessive Costs Of Contract Execution. Dividing The Order Into Parts Could Also Result In The Ordering Party Being Forced To Sign Several Contracts And Receive Invoices From Different Companies, Which Would Make It Additional Difficult To Control Gas Consumption. It Should Also Be Noted That The Decision Not To Divide The Contract Into Parts Does Not Violate The Principles Of Fair Competition And Does Not Impede Access To The Contract For Entities From The Sme Sector.
