1. The Subject Of The Tender Is The Selection Of A Contractor Who Will Perform Deliveries For The Ordering Party, Consisting Of Successive Deliveries By The Contractor To The District Hospital. The Ordering Party Stipulates That The Delivered Subject Of The Order Must Have The Requirements Required By Current Law, E.G. Permits, Certificates, Attestations And Markings Provided For In The Provisions Of The Medical Devices Act, Proving The Required Approval For Use And Marketing In Poland In Accordance With The Regulation Of The Minister Of Health On Essential Requirements. And Procedures For Assessing The Conformity Of Medical Devices.3. The Subject Of The Order Must Be Marked By The Manufacturer In Such A Way That It Is Possible To Identify Both The Product And The Manufacturer.4. The Ordering Party Stipulates That The Offered Subject Of The Order, With An Expiry Date, Must Have A Sufficiently Long Validity Period Allowing For Free Use For A Minimum Period Of 12 Months From The Date Of Delivery.5. The Ordering Party Informs And Explains That In The Scope Of All Packages Specified In Points 5.15 - 5.23 Of The Swz In Question, It Allows The Possibility Of Offering In The Price Form Of The Submitted Tender Offer The Determination Of Unit Prices For 1 Item, Specifying Individual Prices With An Accuracy Of Up To 4 Decimal Places.6. The Ordering Party Informs And Explains That In The Scope Of Packages In Which It Is Allowed To Offer A Package Of A Different Size Than That Indicated In The Swz, The Contractor Intending To Make Such A Change Is Obliged To Appropriately Recalculate The Ordered Quantity, Possibly Rounding It Up To The Nearest Full Package, And Is Also Obliged To To Indicate Such A Change In The Submitted Offer Form.7. The Ordering Party Informs And Explains That In All Packages That Are The Subject Of The Order, It Has Specified The Packaging Sizes In Cases Where It Considers It Important. By Which It Should Be Understood That In Positions Where The Size Of The Packaging Has Been Precisely Determined, Changes Are Not Allowed. In Other Cases, Contractors Themselves May Determine The Size Of The Offered Commercial Packaging With An Appropriate Conversion Of The Ordered Quantity So That The Ordered Quantity Is Divisible By The Size Of The Offered Packaging. If The Offered Packages Are Not Divisible By The Ordered Quantity, It Is Required To Offer The Number Of Packages Rounded Up To The Nearest Full Package. Moreover, Contractors Are Obliged To Indicate The Changes Made In The Submitted Offer Form By Changing The Unit Of Measurement From Pieces To Packages, Indicating The Size Of The Offered Package And Changing The Quantity Accordingly.8. The Purpose Of This Procedure Is To Obtain A Product With The Technical, Quality, Operational And Functional Parameters Specified In The Swz, And Not To Purchase Disposable And Reusable Medical Equipment Of A Specific Brand Or Manufacturer. For These Reasons, The Contracting Authority Has Exercised Due Diligence To Ensure That The Subject Matter Of The Contract Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Could Lead To The Preference Or Elimination Of Certain Contractors Or Products. If, Despite This, It Turns Out That Such Indications Appear Anywhere In The Swz And In Its Annexes, They Should Not Be Treated As Requirements Relating To The Subject Of The Contract, And Should Be Considered Only As Informational Indications (Not Binding On Contractors). . For These Reasons, An Offer That Does Not Comply With Such Indications Will Not Be Considered Inconsistent With The Content Of The Swz And Will Not Be Rejected For These Reasons.9. The Ordering Party Stipulates That Deliveries Will Be Made Successively For The Duration Of The Contract On The Basis Of Partial Orders Placed By The Head Of The Supply Section Of The Hospital In Zakopane Via Fax Or E-Mail.10. The Terms Of Execution Of The Order Are Included In The Draft Contract, Which Constitutes Annex No. 5 To The Swz.
