Part Of The Order No. I Name: Successive Purchase Of Diesel Oil (On) And Unleaded Gasoline (Pb95) For Official Vehicles Of The District Office In Ostrowiec wi tokrzyski: 1) The Subject Of The Order Is Refueling With Diesel Oil (On) And Unleaded Gasoline (Pb 95) Vehicles Of The District Office As Well As Canisters And Barrels.2) The Ordering Party Reserves The Right To Increase Or Decrease The Amount Of Purchased Fuel While Maintaining Permanent Discounts Indicated By The Contractor In The Offer Form. 3) The Expected Amount Of Fuel Purchased During The Duration Of The Contract Will Be Approximately 22,800 Liters For Diesel And Approximately 3,240 Liters For Pb 95. The Given Amounts Of Fuel Are Approximate And Do Not Bind The Ordering Party, And Their Purchase Will Be Carried Out According To The Current Needs Of The Ordering Party - A Maximum To The Amount Of Financial Resources Allocated For This Purpose In The Budget. The Minimum Quantity Of Purchased Fuels Will Be 13,000 Liters (On) And 1,200 Liters (Pb95).4) Purchased Fuels Must Meet The Requirements Specified In The Regulation Of The Minister Of Economy Of October 9, 2015 On Quality Requirements For Liquid Fuels (Journal Of Laws Of 2023, Item 1314) And The Pn - En 228 (Pb) And Pn - En 590 (On) Standards Or Equivalent Standards, Respectively.5) Fuels Must Be An Original Product, I.E. They Should Be Produced By The Manufacturer Who Owns The Recipe And Symbol , Name And Trademark Used To Mark It.6) The Order Will Be Fulfilled: A) In The Cashless System, At The Gas Station Indicated By The Contractor Located In The City Of Ostrowiec wi tokrzyski, B) Successively, By Refueling The Ordering Partys Vehicles And Equipment, In Accordance With Its Needs, C) Vehicles Will Be Refueled In Fuel Tanks, And Equipment In Canisters Or Barrels, D) Sales Will Take Place According To Retail Prices Applicable At The Gas Station Indicated By The Contractor (At Least One) On The Day Of Fuel Purchase, Taking Into Account A Permanent Discount Price Declared In The Offer.7) The Contractor Is Obliged To: A) Keep Records Of The Quantity And Type Of Fuel When Collecting Fuel At The Gas Station. The Contractor Is Obliged To Each Time Provide The Driver With Proof Of Fuel Release, Containing Data On: Place, Date, Quantity, Price And Type Of Fuel Issued, B) Issuing Vat Invoices Based On The Transaction Report Prepared By The Contractor. The Transaction Report Will Be A Collective List, Systematized According To The Order Of Purchase Dates, Containing The Following Data: Dates And Exact Time Of Individual Transactions, Registration Numbers Of The Vehicles For Which The Purchase Was Made, Quantity, Type And Price Of Purchased Fuels, Addresses Of Gas Stations Where The Transactions Were Carried Out, C) Invoicing A Maximum Of Twice A Month And Sending Invoices To The Ordering Party Along With A Printout Of The List Of Transactions Made In A Given Settlement Period. The Following Settlement Periods Are Established: - From The 1St To The 15Th Of Each Month, - From The 16Th To The Last Day Of The Month.8) The Ordering Party Is Obliged To Pay For The Purchased Fuel On The Basis Of A Correctly Issued Vat Invoice. The Payment Deadline For The Collective Invoice Is 30 Days From The Date Of Sale. The Sale Date Is The Last Day Of A Given Settlement Period. The Payment Deadline Is The Date Of Receipt Of The Payment Into The Contractors Bank Account.9) Other Arrangements: A) Fuel Refueling Will Be Carried Out 24 Hours A Day On Business Days From Monday To Friday As Well As On Public Holidays, B) The Contractor Will Be Obliged, At The Request Of The Ordering Party, , To Present Documents And Fuel Quality Certificates, Within 7 Days From The Date Of Receipt Of The Letter Containing Such A Requestc) The Following Rules Apply To Complaints Related To Poor Quality Of Fuels: - The Complaint Should Be Submitted In Writing With Justification, - The Contractor Should Consider The Complaint In Within 14 Days Of Receiving It. If The Consideration Of A Complaint Requires Collecting Additional Information, In Particular Obtaining It From The Ordering Party Or The Gas Station Operator, The Contractor Will Consider The Complaint Within 14 Days From The Date Of Obtaining This Information. - Failure To Notify The Ordering Party Within The Above-Mentioned Deadline. About The Method Of Considering The Complaint Is Tantamount To Accepting It, - If The Complaint Is Accepted, The Contractor Is Obliged To Cover The Value Of The Damage Incurred Up To The Amount Documented By Appropriate Invoices, - The Acceptance Of The Complaint Does Not Deprive The Ordering Party Of The Right To Seek Full Compensation Before The Court In Accordance With Applicable Regulations.10) Amount Or Scope Of The Order: A) The Quantity Of Fuels Ordered Is An Estimate, The Minimum Quantity Of Fuels Is 13,000 Liters (On) And 1,200 Liters (Pb95) Or Up To The Amount Of Pln 180,000.00, B) The Ordering Party Reserves The Right Not To Fully Use The Subject Of The Order , With The Right To Reduce The Value Of The Contract, Without The Contractors Right To Submit Claims In This Respect, As Well As To Change The Estimated Quantity Of Individual Fuels Up To The Amount Of The Contractual Amount, C) In The Event Of A Significant Change In Circumstances Causing The Performance Of The Contract To Be No Longer In The Public Interest, Which Could Not Have Been Foreseen At The Time Of Concluding The Contract, The Ordering Party May Withdraw From The Contract Within 30 Days Of Becoming Aware Of These Circumstances. In Such A Case, The Contractor May Only Demand Remuneration Due For The Performance Of Part Of The Contract.
