1. The Subject Of The Order Is The Implementation Of A Task Called: Establishment Of A Facility Serving Cultural Functions Through The Reconstruction Of A Public Building At Ul. Szkolna 26 In Janik. The Project Is Implemented With The Use Of Funds From The European Agricultural Fund For Rural Development Under The Rural Development Program For 2014 - 2020. Operation Investments In Facilities Performing Cultural Functions Implemented Under The Measure Basic Services And Village Renewal In Rural Areas . The Contractor Must Foresee All Circumstances That May Affect The Price For The Execution Of The Subject Of The Contract. The Bill Of Quantities Constitutes Auxiliary Material, The Contractor Cannot Estimate The Value Of The Order Solely On Its Basis.2. The Subject Of The Order Will Be Implemented While Ensuring Accessibility For People With Special Needs Through The Use Of Reasonable Accommodations, Removing Barriers And Preventing Their Occurrence, In Accordance With Art. 4 Of The Act Of July 19, 2019 On Ensuring Accessibility For People With Special Needs (Journal Of Laws Of 2022, Item 2240). The Contractor Will Be Obliged To Ensure Accessibility For People With Special Needs, In Accordance With Art. 6 Of The Above-Mentioned Act In The Field Of Architectural Accessibility: 1) Ensuring That Horizontal And Vertical Communication Spaces Of Buildings Are Free From Barriers - A Single-Story Building, There Cannot Be Any Lowering Or Steps Dangerous For The Blind, The Width Of Passages Is Adapted To The Needs Of Disabled People; 2) Installation Devices Or The Use Of Technical Means And Architectural Solutions In The Building That Enable Access To All Rooms, Excluding Technical Rooms - Construction Of A Bathroom For Disabled People, Entry To The Building Without Architectural Barriers From The Ground Level; 3) Providing Information On The Layout Of Rooms In The Building, At Least Visually And Tactilely Or Audibly - The Price Of The Offer Should Also Include The Purchase And Installation Of A Tactile Board, With Information On The Layout Of Rooms In The Building, At Least Visually And Tactilely Or Audibly; 4) Ensuring That People With Special Needs Can Evacuate Or Saving Them In A Different Way - Evacuation Through Designated Escape Routes. All Waste Generated During Construction Works Becomes The Property Of The Contractor, Who Is Obliged To Manage Them In Accordance With The Act Of December 14, 2021 On Waste (Journal Of Laws Laws Of 2023, Item 1587 And 2029).3. The Subject Of The Order Is The Reconstruction Of The Building Located At Ul. Szkolna 26 In Janik In The Following Industries: - Architectural - Construction, - Construction, - Sanitary, - Electrical. The Scope Of The Order Includes: - Measurement, Preparatory, Demolition And Dismantling Works, Foundation Works, - Reinforced Concrete Construction Works, Including, Among Others, Execution Columns, Ceilings, Reinforced Concrete Walls, - Masonry Works, Including, Among Others, Construction Of External Curtain Walls, Partition Walls, - Assembly Works, Including, Among Others, Installation Of Windows And Doors, Etc., - Finishing Works, Including, Among Others, Plastering, Painting , Floors, Reconstruction Of The Existing Platform, - Strengthening The Roof Truss, - Changing The Size Of External And Internal Door Openings, - Electrical Installations, Including: Switchboard, Lighting Installation, Cable Laying And Installation Of Accessories, Lightning Protection And Earthing Installation, Photovoltaic Installation, -Sanitary Installations, Including: Cold And Hot Water Installation, White Installation, Sanitary Sewage Installation, Central Heating Installation, Underfloor Heating, Boiler Room Technology With A Heat Pump, Gas Installation, Mechanical Ventilation, Air Conditioning Installation. 4. The Ordering Party Does Not Allow The Submission Of Offers. Partial, Referred To In Art. 7 Point 15 Of The Public Procurement Law. Reasons For Not Dividing The Order Into Lots: Pursuant To Art. 91 Section 2 Of The Act Of September 11, 2019 - Public Procurement Law (Journal Of Laws Of 2023, Items 1605 And 1720), A Detailed Analysis Of The Subject Of The Contract Was Made And The Advisability Of Dividing The Contract Into Parts Was Considered. The Ordering Party Does Not Allow The Submission Of Partial Offers. Justification For Not Dividing The Order Into Parts. Taking Into Account The Specificity Of The Contract And The Scope Of Construction Works, The Ordering Party Stated That Dividing The Public Contract Into Parts, Giving The Possibility Of Selecting Different Contractors To Simultaneously Implement The Presented Scope Of The Contract, Is Unjustified. The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Order Could Seriously Jeopardize The Proper Execution Of The Order And The Ordering Partys Assertion Of Rights During The Warranty Period. The Lack Of Division Does Not Limit The Principle Of Competition In Any Way, As The Ordering Party Allows Subcontracting Under This Order, And Contractors May Also Jointly Apply For A Public Contract. This Formula Also Increases Efficiency And Logistics In Management, And Allows You To Optimize Construction Costs. It Should Also Be Noted That The Issue Of Divisibility Of The Provision Is Not Regulated In The Public Procurement Law, Therefore, In Accordance With Art. 8 Section 1 Of The Public Procurement Law - The Ordering Party Shall Apply The Provisions Of The Civil Code In This Respect, In Particular Art. 379 § 2 Performance Is Divisible If It Can Be Partially Fulfilled Without A Significant Change In Its Subject Or Value. Taking The Above Into Account, It Should Be Considered That The Service Cannot Be Provided Without A Significant Change In The Subject Matter, Which Means That It Should Be Treated As One Whole. At The Same Time, The Lack Of Division Of The Order Into Lots Does Not Restrict Competition And Ensures Equal Access For Entities From The Small And Medium-Sized Enterprise Sector. It Should Also Be Noted That A Possible Division Of This Contract Into Lots Would Be Pointless, As The Estimated Value Of The Contract (Below The Amounts On Which The Obligation To Submit Notices To The Publications Office Of The European Union Depends) Is Not High Enough To Hinder The Participation Of Small And Medium-Sized Enterprises In These Proceedings.5. The Contractor Is Obliged To: 1) Perform Preparatory Works; 2) Prepare Construction Facilities, Storage Rooms For Storing Materials And Tools, Social Rooms For Employees, Secure And Mark The Construction Site Area; 3) Keep The Construction Site In Good Order; 4) Organize The Site To Which The Contractor Will Dispose Of The Generated Waste; 5) Preparing A Geodetic Inventory, If Applicable, And Preparing As-Built Documentation Agreed With The Supervision Inspector, Containing All Documentation Confirming The Correctness Of The Execution Of The Scope Of The Contract, Including, Among Others: Protocols, Approvals And Certificates Of Built-In Materials; 6) On The Side The Contractor Is Responsible For Installing Fire Extinguishers And Other Equipment Required By Applicable Law, As Well As Marking Escape Routes And Fire Protection Devices, Which Results From The Regulation Of The Minister Of Internal Affairs Of June 7, 2010 On Fire Protection Of Buildings, Other Construction Facilities And Areas (Journal Of Laws Laws Of 2023, Item 822), As Well As The Development Of Fire Safety Instructions;7) The Contractor Will Perform The Scope Of The Subject Of The Order From Its Own Materials, Using Its Own Equipment. The Contractors Tasks Include Presenting Material Cards With Certificates And Approvals To The Supervision Inspector For Their Acceptance Before Installation (The Method And Form Of Acceptance Of Materials To Be Agreed With The Supervision Inspector). The Contractor Is Obliged To Agree With The Ordering Party On The Colors Of All Materials Used, In Particular The Color Of Paints, Doors, Tiles (Including Their Dimensions); Purpose, He Will Install Submeters On His Own;9) The Contractor Will Obtain All Documents, Permits, Decisions, Arrangements And The Like, Necessary For The Proper Performance Of The Subject Of The Contract And Obtaining An Occupancy Permit Or Submitting An Effective Notice Of Completion Of Construction Works To The District Construction Supervision Inspectorate In Ostrowiec Świętokrzyski . All Fees Related To The Above Are Covered By The Contractor.6. By Submitting An Offer In This Procedure, The Contractor Undertakes To Perform The Task Described In The Construction Design And In The Terms Of Reference. All Documents Describing The Subject Of The Order (Construction Design, Bill Of Quantities And Terms Of Reference) Should Be Treated As Complementary And Explanatory In The Sense That In The Event Of Any Ambiguity Or Ambiguity, The Contractor May Not Limit Either The Scope Of His Obligation Or The Scope Of Due Diligence. When Performing Its Obligations Under The Public Procurement Contract.7. The Ordering Party Does Not Allow The Possibility Of Submitting Variant Offers Or Offers In The Form Of Electronic Catalogues.8. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 And 8 Of The Public Procurement Law.9.
