Z O. O. Krak w - Constituting Annex No. 7A To The Swz, B) Designing A Connector With The Existing School Building, C) Designing Spacers Of Existing Networks (Tauron Network, Orange Network, Sanitary Sewage Network, Water Supply Network And Others That Will Require It) And Their Redesign In Order To Removal Of Any Conflicts. It Is Desirable That Before Submitting The Offer, The Contractor Conducts A Local Inspection Of The Area Where The Works Covered By The Subject Of This Order Will Be Located. Conducting A Visit Is Not A Condition For Submitting An Offer In This Procedure. The Costs Of Inspecting The Construction Site Will Be Borne By The Contractor. 5. Construction Works Constituting The Subject Of This Order Should Be Performed In Accordance With This Swz, The Description Of The Subject Matter Of The Order (Opz), The Draft Agreement And In Accordance With The Principles Of Construction Practice, Technical Knowledge, Applicable Regulations And Standards. The Obligation To Perform Works In Accordance With The Above Documents Does Not Release The Contractor From, Among Others: From The Obligation To Verify This Documentation During The Term Of The Contract And Report To The Ordering Party Any Defects Or Omissions Detected Therein, Resulting In The Possibility Of Non-Compliance With The Terms Of The Contract Or Violation Of Legal Provisions.6. From The Date Of Acceptance Of The Construction Site, The Contractor Is Responsible For All Events That Occur During The Execution Of The Contract. The Contractor Is Responsible For All Damage Caused To Anyone During Or In Connection With The Construction, Unless There Is No Causal Relationship Between The Performance Of The Works And The Damage Caused. The Contractor Will Be Liable In Particular For: 1) Damages And Consequences Of Accidents Concerning The Contractors Employees And Third Parties Staying In The Area Of The Works Being Carried Out; 2) Damages Resulting From Destruction And Other Events In Relation To The Works, Materials, Equipment And Other Movable Property Related To The Performance Of The Works During The Implementation Of The Subject Of This Agreement;3) Damage To Works Caused By Him When Removing Defects During The Warranty And Guarantee Period;4) Improper Securing Of The Construction Site And Allowing Unauthorized Persons To Enter The Construction Site.7. The Ordering Party, In Accordance With The Provisions Of Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, Allows Equivalent Solutions For Works, Materials And Systems That Meet Applicable Standards And Requirements. The Ordering Party Reserves That Wherever Trademarks, Patents Or The Origin Of Devices Or Materials Are Indicated In The Description Of The Subject Matter Of The Contract, They Should Be Treated Solely As The Designers Proposals. The Ordering Party Allows Methods, Materials, Devices, Systems, Technologies, Etc. Equivalent To Those Presented In The Description Of The Subject Of The Order. Therefore, It Is Allowed To Propose In The Offer Any Equivalent Market Equivalents With Properties Not Worse Than Those Indicated By The Ordering Party. The Parameters Of The Indicated Standard Define The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Order. The Offer May Include Methods, Materials, Devices, Systems, Technologies, Etc. From Other Brands And Manufacturers, But With Technical, Quality Parameters And Performance And Functional Properties Corresponding To The Methods, Materials, Devices, Systems, Technologies, Etc. In Addition, Replacement Devices Accepted For Valuation: Should Fulfill The Function They Are Intended To Serve, Should Be Compatible With Other Devices So That The Set Of Devices Gives The Intended Effect, Cannot Change The Type And Scope Of Construction Works. The Burden Of Proving That The Material Or Device Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. If The Materials And/Or Equipment Offered By The Contractor As Equivalent Are Not Equivalent In The Light Of The Documents Submitted By The Contractor, The Contractors Offer Will Be Rejected As Not Corresponding To The Content Of The Swz. In The Case Of Describing The Subject Of The Order By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Ordering Party Allows The Execution Of The Order Using Solutions Equivalent To Those Described. In Such A Case, The Procedure Described At The Beginning Of This Point Shall Apply Accordingly.8. In The Case Of Technologies, Systems, Materials Or Equivalent Devices Accepted For Valuation By The Contractor, The Offer Must Be Accompanied By A List Of These Technologies, Systems, Devices Or Materials, Which Will Include: Type And Description Of The Technology Or System Used, Name Of The Device Used /Material, Manufacturers Name, Precise And Unambiguous Type Of Device Or Material.9. In Case Of Doubts As To The Equivalence Of Substitute Technologies/Systems/Equivalent Devices/Materials Proposed In The Offer, The Ordering Party, In Consultation With The Designer, May Require Demonstration (Documentation) Of Equivalence At The Offer Examination Stage. In Particular, For This Purpose, The Contractor May Request That The Contractor Present Catalogs Of The Manufacturer Of A Given Technology/Systems/Devices/Equivalent Materials.
