The Subject Of The Order Is The Provision Of Services Related To The Servicing Of Icebreakers In 2024. Detailed Information On The Subject Of The Order And Scope Of Requirements And Terms Of Execution Of The Order Are Specified In: - Description Of The Subject Of The Order - Annex No. 1 To Swz, - Draft Provisions Of The Contract - Annex No. 8 To Swz 2. Employer Does Not Allow The Submission Of Partial Offers. The Ordering Party Does Not Divide It Into Parts For The Reasons Indicated In Annex No. 1 To The Swz. 3 The Ordering Party Does Not Allow This Possibility Submitting Variant Offers. 4 The Ordering Party Does Not Provide For The Possibility Of Awarding Orders, Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law. 5 The Ordering Party Reserves No Obligation Personal Performance Of Key Parts Of The Order By The Contractor. 6 The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. The Ordering Party Requests Indication By The Contractor, In His Offer, Includes The Parts Of The Order Whose Performance He Intends To Entrust To Subcontractors, And Providing The Names Of Any Subcontractors, If They Are Already Known. The Contractor Responds Will Be Responsible For Any Errors And Damages Resulting From The Subcontractors Actions Is For The Correctness, Timeliness And Quality Of Services Provided By Subcontractors. The Requirements For Subcontracting Are Set Out In The Draft Provisions Contracts. 7 The Ordering Party Does Not Provide For The Possibility Of Exercising The Option Right Referred To Referred To In Art. 441 Of The Public Procurement Law. 8 The Ordering Party, In Accordance With Art. 95 Section 1 Of The Public Procurement Law Requires Employment By The Contractor On The Basis Of An Employment Relationship Of Persons, Hereinafter Referred To As Employees, Who Will Perform Activities During The Execution Of The Order For A Given Part, Specified By The Ordering Party In The Description Of The Subject Of The Order (Appendix No. 1 To The Swz) And In The Draft Provisions Of The Agreement (Appendix No. 8 To The Swz). 9. Ordering Party Decides That: 9.1 The Contractor Is Obliged To Ensure That Employees Performing Activities, Referred To In Point 4.9 Of The Swz Were Employed To Perform The Contract On The Basis Of A Relationship Work, Within The Meaning Of The Provisions Of The Labor Code, 9.2 The Contractor Is Obliged To Employees Were Employed On The Basis Of An Employment Relationship For The Minimum Duration Of The Contract For The Period Of Performance Of The Activities Referred To In Point 4.9 Of The Swz, 10. The Ordering Party Does Not Sets Requirements For The Contractors Employment Of Persons Referred To In Art. 96 Section 2 Point 2 Of The Public Procurement Law. 11 The Ordering Party Recommends That The Contractor Conduct A Site Visit Where The Work Will Be Carried Out, In Order To Obtain Information That May Be Necessary For Preparation Offer And To Conclude A Contract And Perform An Order. Making A Site Visit Is Not Possible Is A Necessary Condition For Submitting An Offer In This Procedure. Accomplishment Costs The On-Site Visit Is Borne By The Contractor. The Contract Is Terminated Before The Expiry Of The Period Indicated In Point 5.1 Of The Swz, I.E.
