The Subject Of The Procedure And Order Is To Select A Contractor For Services Related To Access To Online Textbooks In 2024 For The Jagiellonian University - Collegium Medicum In Krakow. 1.1 Pursuant To Art. 310 Of The Public Procurement Act, The Ordering Party Provides For The Possibility Of Invalidating The Procedure In Question If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Granted To It. 1.2 A Detailed Description Of The Subject Of The Order Together With The Calculation Of The Offer Price Is Included In Annex A To The Swz. 1.3. The Contractors Obligations Will Include: 1.3.1. Access To 608 Textbook Titles Online In 2024. On The Ibuk Libra Platform Or Equivalent Operated By The Contractor. A Detailed List Of Textbook Titles Is Included In Annex A To The Swz - Detailed Description Of The Subject Of The Order Along With The Calculation Of The Offer Price. 1.3.2 Access To The Textbooks In The Electronic Version Will Be Granted To The Maximum Number Of Simultaneous Authorized Users, Specified In Annex A To The Swz (Column No. 10 Number Of Accesses ) Without Time Limits (24/H) Using The Ordering Partys Ip Addresses Indicated In Annex 2 To The Contract Template. For The Purposes Of This Subject Of The Order, The Ordering Party Assumes That The Authorized Users Are Students And Doctoral Students Of The Ordering Party And Persons Employed By The Ordering Party (Including Permanent, Temporary And Scientific Employees Of The Ordering Party Participating In Scientific Exchange), Who Are Entitled To Use The Online Version Of Textbooks In The Librarys Reading Room Medical University Of Jagiellonian University Medical College There Are Also Persons Other Than Those Mentioned Above.1.3.3 The Ordering Party Allows The Submission Of Equivalent Offers. Each Contractor Submitting An Equivalent Offer, In Accordance With The Provisions Of The Public Procurement Law, Is Obliged To Demonstrate In The Content Of His Offer That The Subject Of The Contract He Offers Meets The Configuration, Technical And Functional Parameters And Required Conditions Specified In The Tor, Or Provides Better Solutions Than Those Described. Equivalence Means That The Offered Products Must Have At Least The Same Configurations, Technical And Functional Parameters And Conditions Required At A Level At Least As Described In The Swz. In Accordance With The Provisions Of The Public Procurement Law, The Contractor Is Obliged To Demonstrate Equivalence In The Content Of The Submitted Offer. When Offering Solutions Other Than Those Described In The Swz, The Contractor Must Demonstrate In Detail In The Offer Their Equivalence With The Conditions And Requirements Described In The Swz, And Is Obliged To Attach To The Offer Detailed Descriptions Showing The Configuration, Technical And Functional Parameters As Well As Conditions Allowing For The Assessment Of Compliance Of The Offered Solutions. In Particular, The Contractor Is Required To Provide The Name Of The Manufacturer, The Name Of The Offered Product And A Detailed Description Of Its Configuration, Technical And Functional Parameters And The Fulfillment Of The Required Conditions (Complete Product Cards, Brochures, Catalogues, Folders, Etc.). Pursuant To Art. 101 Section 5 Of The Public Procurement Law, If The Description Of The Subject Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In The Public Procurement Law, The Ordering Party May Not Reject The Offer Only Because The Offered Construction Works, Supplies Or Services Do Not Comply With With Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Order Refers, Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order. 1.3.4 The Ordering Party Allows Equivalence In The Field Of The Electronic Platform. Requirements For The Electronic Platform: 1.3.4.1 The Contractor Will Enable Authorized Users To Create Personalized Accounts On The Platform, Where They Will Be Able To Create Their Own E-Shelves With Books; 1.3.4.2 The Authorized User Will Have The Right To Use Advanced Tools For Working With Text, Including: :A) Creating Notes Directly In Books, B) Tagging Important Fragments In Books And Marking Them With Colors) Searching For Words And Phrases In Textbooks, D) Marking Fragments And Directly Linking Issues And Content Of Books With Dictionaries And Encyclopedias And From The Personalized Sphere Of Publications In The Cloud ,1.3.5 The Ordering Party Will Have Permanent Access To A Panel Used To Generate Book Usage Statistics, Which Will Record: A) The Number Of Openings Of A Given Title, B) The Number Of Pages Of A Given Title Read, C) The Reading Time Of A Given Title, D) The Number Of Unsuccessful Openings ,E) List Of Titles Proposed By Readers For Purchase By The Library,F) List Of Titles For Which The Maximum Number Of Simultaneous Authorized Users Has Been Exceeded.1.4. The Contractor Shall Have The Right To Withdraw Any Title At Any Time In Situations Justified By Copyright Law. For Each Day Of Lack Of Access To A Book, The Ordering Party Will Be Entitled To An Amount Equal To 1/365 Of The Fee For A Given Book. 1.5. The Contractor Must Offer The Subject Of The Order In Accordance With The Requirements Of The Ordering Party Specified In The Detailed Description Of The Subject Of The Order Contained In Annex A To The Swz. 2. The Contractor Should Complete And Sign The Offer Form With Attachments Or Submit An Offer Corresponding To Their Content, Using A Qualified Electronic Signature, Trusted Signature Or Personal Signature, And Post It On The E-Procurement Platform, Available At Http://Ezamowienia.Gov. Pl. Attention! The Offer Must Be Provided With The Appropriate Signature Before It Is Encoded.3. The Contractor Must Attach To The Offer All Documents, Declarations And Attachments Presented In The Swz, Including The Calculation Of The Offer Price - According To The Template Of Annex A To The Swz, Signed Using A Qualified Electronic Signature, Trusted Signature Or Personal Signature.4. The Ordering Party Provides For The Possibility Of Calling On Contractors To Provide Explanations Regarding The Submitted Offer.5. The Conditions For The Execution Of The Order Are Included In The Draft Provisions Of The Contract Contained In Swz.6. Designation Of The Subject Of The Contract According To The Common Procurement Vocabulary Cpv Code: 72320000-4 - Database Services.7. Subcontracting.7.1 The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S).7.2 The Ordering Party Does Not Reserve Any Personal Obligation For The Contractor To Perform Key Parts Of The Order.7.3 If The Contractor Announces Entrusting Part Of The Order To Subcontractors, A List Of Their Names (Names, Companies) Must Be Attached To The Offer. With The Scope Of Tasks Entrusted To Them (Parts Of The Contract), If They Are Known At The Stage Of Submitting Offers. 7.4 Entrusting Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For Proper Performance Of The Order.8. The Contractor Must Ensure The Implementation Of The Subject Of The Order Within A Period Of 12 Months, From January 1, 2024. If The Contract Is Concluded After January 1, 2024.
