The Ordering Partys Requirements Regarding The Subject Of The Order: 1) Offered Product Medicinal Product, The Medical Device Must Have Approvals, Certificates And Be Registered In Accordance With With Legal Regulations Requiring Approvals, Certificates And Registration, 2) The Offered Medical Device Must Be Placed On The Market And Used In Accordance With The Requirements Act Of April 7, 2022 On Medical Devices (Journal Of Laws Of 2022, Item 974), 3) The Offered Medicinal Product Must Be Placed On The Market In Accordance With The Requirements Act Of September 6, 2001 Pharmaceutical Law, Uniform Text (Journal Of Laws Of 2022 Item 12301, As Amended), 4) The Offered Medical Device Must Meet The Standards Or Specifications Technical Data Applicable To This Product; If The Medicinal Product Offered, The Offered Medical Product Did Not Require Notification To The President Of The Product Registration Office Medicinal Products, Medical Devices And Biocidal Products, The Contractor Is Obliged To: To Perform All Necessary Activities At Its Own Expense And On Its Own To Meet All Legal Requirements Related To Placing The Product On The Market And Use In The Territory Of The Republic Of Poland. The Contractor Is Obliged To Perform Such Activities Within The Deadlines Specified In Applicable Regulations And Deliver Them The Ordering Party Shall Be Provided With Appropriate Documents Confirming The Execution Of Such Documents Within These Dates Activities. 3.4. The Ordering Party Allows The Use Of Equivalent Products, I.E. With Chemical, Physical And Qualitative Parameters Not Worse Than Those Specified In Swz Only In Relation To Products Whose Origin Has Been Determined By The Ordering Party By Indicating Trademarks, Patents Or Origin. Purchaser Allows The Possibility Of Offering Equivalent Products Specified In The Swz, I.E. Equivalent Pharmaceutically And Therapeutically And Reimbursed By The National Health Fund. Pharmaceutical Equivalence Describes The Situation In Which Compared Drugs Contain The Same Amount Of Drug In The Same Dosage Form Corresponding To Those The Same Comparable Standards And Which Are Intended For Administration By The Same Route; Equivalence Pharmaceutical Does Not Determine Therapeutic Equivalence, Because Differences In Scope Additives And The Manufacturing Process May Cause Differences In Dissolution And Bioavailability And, Consequently, In The Action Of The Pharmaceutical Agent. Equivalence Therapeutic - Two Agents Are Therapeutically Equivalent If They Are Pharmaceutically Equivalent And If, When Administered At The Same Dose, Their Effects In Terms Of Both Effectiveness And Security Are As Expected On The Basis Of The Relevant Research. The Ordering Partys Requirements Regarding The Subject Of The Order Are Specified In Annex No. 2B To The Swz. If The Contractor Applying For The Contract Offers, By Indicating In The Price Form, The Subject Of The Order Equivalent To The Specified One In The Swz, He Is Obliged - To Confirm That The Offered Deliveries Correspond The Ordering Partys Requirements Specified In The Swz - Provide A Description Of Each In The Price Form From Equivalent Solutions (Trade Name, International, Number Of Pieces In The Package Offered Product). The Ordering Party Agrees To Change The Form Of Oral Forms, I.E. Pricing: - Instead Of Tablets - Coated Tablets, Ampoules - Vials; -Instead Of Tablets Coated - Tablets, Capsules Or Dragees - Instead Of Capsules - Coated Tablets, Tablets, Or Dragees Instead Of Tablets, Coated Tablets Or Capsules With A Slow Release Release Tablets, Coated Tablets Or Capsules And Modified Release And Vice Versa . An Equivalent Solution Means A Solution That Achieves The Effect Established By The Ordering Party And Specified In The Swz Using Other Solutions. The Ordering Party Requires Implementation Subject Of The Order On The Terms Specified In The Contracts.
