The Subject Of The Order Is The Performance Of Works Entitled: Inspection And Maintenance Of The Stormwater Pumping Station At The Gatehouse Located On The Premises Of The Business Park Nad Drwiną Facility In Krakow, Including The Following Works: • Maintenance And Inspection Of Switchboards And Measuring And Control Devices In The Pumping Station, • Maintenance And Inspection Of The Operation Of 4 Krt K 300 – 400/406 Ug – S Submersible Pumps, • Maintenance And Inspection Of The Hydraulic System, Acid-Resistant Steel Piping, Flanged With Shut-Off And Non-Return Fittings (Flap Check Valves, Knife Gate Valves, Coupling Elbows For Pumps),• Cleaning The Lamella Separator Of Petroleum Substances.2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To Swz.3. Requirements Related To The Implementation Of The Order In Terms Of Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship Of Persons Performing The Activities Specified By The Ordering Party In The Scope Of The Implementation Of The Order, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2020, Item 1320) Covers The Following Types Of Activities: A) Employees Performing Installation Work.4. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On An Employment Relationship Are Specified In The Contract Template Constituting Annex No. 2 To Swz.4.1 During The Execution Of The Contract, The Ordering Party Is Entitled To Perform Inspection Activities Towards The Contractor Regarding The Contractors Or Subcontractors Compliance With The Employment Requirement Under The Employment Contract. Work Of Persons Performing The Work Indicated In Point 3 Activities. The Ordering Party Is Entitled In Particular To: A) Request Documents Confirming Compliance With The Above-Mentioned Requirements And Assessing Them, E.G. Certified Copies Of Anonymized Employment Contracts (Devoid Of Employees Personal Data, Except For The Name And Surname, Date Of Conclusion Of The Employment Contract, Type Of Employment Contract, Full-Time Employment), Contractors Or Subcontractors Declaration Of Employment Under The Employment Contract Work Of Persons Performing Activities Containing Elements Of An Employment Contract Or Certificates From The Relevant Zus Branch Confirming The Payment Of Social And Health Insurance Contributions In Respect Of Employment Under Employment Contracts, B) Requesting Explanations In The Event Of Doubts Regarding The Confirmation Of Compliance With The Above-Mentioned Requirements. Requirements, C) Carrying Out Inspections At The Place Of Performance Of The Service.4.2 Due To The Failure By The Contractor Or Subcontractor To Employ Persons Under An Employment Contract, Performing The Tasks Indicated In Point 3 Activities, The Ordering Party Provides For A Sanction In The Form Of The Contractors Obligation To Pay A Contractual Penalty In The Amount Specified In The Relevant Provisions Of The Public Procurement Contract. Failure By The Contractor To Submit, Within The Deadline Set By The Ordering Party, The Declarations Requested By The Ordering Party Confirming The Contractors Or Subcontractors Fulfillment Of The Employment Requirement Under The Employment Contract Will Be Treated As The Contractors Or Subcontractors Failure To Meet The Requirement To Employ The Persons Performing The Persons Specified In Point Under The Employment Contract. 3 Activities.4.3 In The Event Of Justified Doubts As To The Contractors Or Subcontractors Compliance With Labor Law Provisions, The Ordering Party May Request An Inspection By The National Labor Inspectorate.5.
