The Subject Of The Order Is The Delivery And Installation Of Furniture, Multimedia Equipment And Technical And Functional Equipment In The Building Of The Care And Housing Center In Nowa Sarzyna. 2. The Ordering Party Requires The Contractor To Deliver The Purchased Goods Using Its Own Transport, In Accordance With The List Included In The Detailed Delivery Specification Attached To The Swz, Including The Assembly Of Full Equipment At Its Own Expense During The Working Hours And Days Indicated By The Ordering Party. All Elements Of The Order Must Be Brand New, Complete, Free From Defects And Have The Legally Required Safety Certificates And Certificates Confirming Compliance With The Standards In Force In The European Union. This Means That They Are Completely Safe And Fully Meet The Requirements For Products Intended For People With Disabilities. The Delivery In Question Must Meet The Highest Quality And Aesthetic Standards. The Equipment Must Be Complete, I.E. Have All The Necessary Elements - Connections, Cables.3. In A Given Room, The Elements Must Be Consistent In Color. If The Color Of The Equipment Or Fittings Is Not Specified, The Contractor Must Discuss This Matter With The Ordering Party.4. Equivalent Solutions: A) If The Attached Documentation - Detailed Delivery Specification - Would Indicate, In Relation To Certain Materials, Devices And Products, Trademarks, Approvals, Specifications And Systems Referred To In Art. 99 Section 5 Of The Public Procurement Law Or The Origin, In Particular The Proper Name Of The Material, Device Or Product, Catalog Number, Trademark, Manufacturer Or Supplier, Then It Should Be Treated As An Exemplary Solution Specifying The Standards, Appearance And Technical Requirements, And The Ordering Party, In Accordance With Art. 99 Section 5 And 6 Of The Public Procurement Act, Allows The Offer Of Materials, Devices, Products Or Equivalent Solutions Provided That They Guarantee The Correct Implementation Of This Task And Ensure That Technical Parameters Are Not Worse Than Those Assumed In The Detailed Delivery Specification, Which Means That The Contractor May Offer The Subject Of The Contract Characterized By With Better Technical And/Or Operational Parameters. B) All Materials, Devices And Products From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Materials, Devices And Products Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order. C) All Materials, Devices And Equivalent Solutions Must Meet The Following Requirements And Standards In Relation To The Material, Device And Product Specified In The Description Of Minimum Parameters, I.E. They Must Be At Least: - The Same Strength, - The Same Durability, - The Same Level Of Aesthetics Of The Device, - Technical Parameters Of Materials And Devices, If Specified In The Documentation, - Fulfill The Same Functions, - Meet Construction Safety, Occupational Health And Safety And Fire Protection Requirements, - Have Appropriate Documents Allowing For Use In Construction, Certificates And Technical Approvals. D) The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Materials And/Or Devices Proposed By Him Meet (Are Equivalent) The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Is Obliged To Provide In The Offer The Names (Types) And Manufacturers Accepted For Valuation And Use In The Execution Of The Order Of The Offered Products And/Or Systems, And To Submit Appropriate Documents (In Polish) Describing The Technical Parameters And Manufacturer, Certificates And Certificates Required By Law. Other Documents Allowing It To Be Clearly Established That They Are Indeed Equivalent. Equivalence In Terms Of Technical, Functional And Operational Parameters Is Intended In Particular To Ensure That Technical Parameters Are Not Worse Than Those Assumed In This Swz.5. In Order To Fulfill Its Obligations, The Contractor Should Provide Experienced And Qualified People Capable Of Carrying Out All Assigned Tasks (This Also Applies To Conducting Training In The Use Of Equipment), In Accordance With Applicable Law And In Accordance With The Provisions Of Relevant Decisions, Arrangements And Opinions, Conditioning The Proper Implementation Of The Order.6. The Quality Guarantee For The Delivered Subject Of The Order Will Be Assessed By The Ordering Party As One Of The Criteria For Evaluating The Offers. The Ordering Party Requires That During The Guarantee And Warranty Period, All Repairs Or Replacements Covered By The Guarantee Or Warranty Be Made As Part Of The Contractual Remuneration. The Ordering Party Will Not Bear Any Costs Related To Repairs Or Replacement. The Minimum Required Warranty Period For Devices Is 2 Years (24 Months).7. In The Event Of A Complaint About The Poor Quality Of The Delivered Goods Or The Non-Compliance Of The Goods With The Order Or With The Swz, The Ordering Party Demands, Under The Warranty, The Replacement Of The Goods With A New One - Corresponding To The Parameters Described In The Swz.8. In The Event Of Late Delivery Or Lack Of Deliveries Due To The Fault Of The Contractor Or The Contractors Failure To Comply With The Provisions Of Point 7, The Ordering Party Will Order The Goods From Another Supplier And Charge The Costs To The Contractor.
