Improving Access To Prevention, Diagnostics And Medical Rehabilitation Facilitating Remaining In Employment And Returning To Work For Sub-Measure: 8.3.2. The Scope Of The Order Includes The Delivery Of Wired And Cordless Automatic Scrubbers And The Delivery Of Cleaning Sets And Multifunctional Trolleys With A Mop To The Commune Office In Mykanów, Ul. Samorządowa 1 - Building A, Which Is To Be Implemented In Two Parts: Part 1 - Delivery Of Automatic Scrubbers, I.E. - Cordless Automatic Scrubber - 7 Pieces - Wired Automatic Scrubber - 4 Pieces In Accordance With The Detailed Quantitative List In Annex No. 1A To The Swz Contractor May Submit An Offer For One Or Two Lots. Before Submitting An Offer, The Contractor Is Obliged To Read And Verify The Annexes Attached To The Swz (Annex No. 1A), Which Specify The Detailed Required Parameters Of The Subject Of The Order.4. The Subject Of The Order Also Includes: - Delivery With Transport, Unloading, Bringing To The Place Indicated By The Ordering Party (At The Risk And Responsibility Of The Contractor).5. The Subject Of The Order Must Be Brand New And Unused And Free From Defects And Defects, It Must Be Free From Third Party Rights, It Must Have, If Applicable Under Applicable Law, The Necessary Approvals, Quality Certificates, Safety Certificates, Declarations Valid On The Date Of Submission Of The Offer. The Parameters And Requirements Indicated In The Opz Define The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Order Delivered To The Ordering Party. 7. The Ordering Party Requires: Guarantee And Warranty: The Contractor Will Provide The Ordering Party With A Minimum • 24-Month Quality Guarantee And Warranty For Defects On The Delivered Subject Of The Order For Part I. The Period Of Warranty And Warranty For Defects Is Counted From The Date Of Final Acceptance Of The Subject Of The Order With The Appropriate Acceptance Protocol. 9. The Offered Deliveries Must Meet The Requirements Of The Ordering Party And Be Performed In Accordance With All Applicable Legal Acts Relevant To The Subject Of The Order And On The Terms And Conditions Contained In The Contract Template Constituting Annex No. 5 To The Swz. 10. Pursuant To Art. 101 Section 4 Of The Act, The Ordering Party Allows Equivalent Solutions. If The Documentation Would Indicate Trademarks, Patents Or Origin In Relation To Certain Materials Or Devices, The Ordering Party, In Accordance With Art. 99 Section 5 Of The Public Procurement Law, Allows Offering Equivalent Materials Or Devices. Materials Or Devices From Specific Manufacturers Determine The Minimum Quality Parameters And Functional Features That The Materials Or Devices Offered By The Contractor Must Meet In Order To Meet The Requirements Set By The Ordering Party. Materials Or Devices From Specific Manufacturers Constitute Only A Quality Standard Of The Subject Of The Order. The Term Minimum Quality Parameters And Performance Characteristics Means That The Ordering Party Understands The Requirements For Materials Or Devices Contained In Publicly Available Sources, Catalogs And Manufacturers Websites. The Use Of Exemplary Manufacturers Names Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. The Use Of Manufacturer/Product Names Is For Example Purposes Only. By Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product In The Description Of The Subject Of The Order, The Ordering Party Also Allows Equivalent Products With Quality Parameters And Functional Features At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Or Better Parameters.11. The Contractor Is Obliged To Prove That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Order To An Equivalent Extent. The Burden Of Proving That The Material Or Product Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. If The Materials Or Products Or Devices Offered By The Contractor As Equivalent Are Not Equivalent To Those Specified In The Opz, In The Light Of The Documents Submitted By The Contractor, The Contractors Offer Will Be Rejected As Inconsistent With The Terms Of The Order. 12. The Contractor Is Responsible For The Quality Of The Delivered Subject Matter Of The Order In Its Entirety And Materials Used.13. The Contractor Is Fully Responsible For The Performance Of All Services Constituting The Subject Of The Order And For The Persons Or Entities With Whose Help The Contractor Performs His Duties Or To Whom He Entrusts Their Performance. 14. The Subject Of The Order Does Not Include Requirements Regarding Accessibility For Disabled Persons And For All Users. The Supplies That Are The Subject Of The Order Are Not An Order For Natural Persons, But Are A Response To The Needs Of The Ordering Party, Which Does Not Indicate Any Special Needs In Terms Of Accessibility For Disabled People. Due To The Above, It Is Waived To Take Into Account The Requirements Regarding Accessibility For Disabled People, In Accordance With Art. 100 Of The Public Procurement Law. 15.
