The Subject Of The Order Are Construction Works Consisting In The Construction Of A Sidewalk In Wola Podłężna - Ul. Warciańska With A Total Length Of 0.288 Km, Including The Left Side 0.143 Km And The Right Side 0.145 Km. The Sidewalk Is Designed With A Surface Of 2.0 M Wide Concrete Paving Stones Laid On A Layer Of C 3/4 Cement Mixture. On The Road Side, There Is A Built-In Concrete Curb 15X30x100 On A Concrete Bank With Resistance. On The Side Of The Property, The Sidewalk Will Be Limited By An 8X30x100 Concrete Edge On A Concrete Footing With Resistance. In Order To Drain Rainwater From The Road, Sidewalk Sewage Is Designed From Prefabricated Concrete Elements With Dimensions Of 15*50*60. Concrete For Concrete Footings - C12/15. Sidewalk Cross Slope 2% Towards The Road. The Exits, As Part Of The Sidewalk, Will Have A Surface Made Of Concrete Paving Stones Laid On A Base Of Crushed Aggregate. From The Side Of The Property, They Will Be Limited By A 12X25x100 Resistor Lowered To The Existing Area. On The Road Side, A Low Curb Of 15X22x100 Is Planned, Raised 4 Cm Above The Existing Bituminous Road. Rainwater Will Flow To The Adjacent Area With Good Permeability Through Designed Sidewalk Sewage Made Of Prefabricated Concrete Elements. A Detailed Description Of The Subject Of The Order Is Included In The Design Documentation - Annex No. 7 To Swz.2. Equivalent Solutions: All Requirements Specified In The Swz Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Minimum Requirements Will Result In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law As Inconsistent With The Terms Of The Order. If The Swz Contains Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes Products Or Services Provided By A Specific Contractor, The Ordering Party Allows The Offer Of Equivalent Solutions With Parameters Not Worse Than Those Indicated By The Ordering Party. A Contractor Who Relies On Equivalent Solutions Is Obliged To Demonstrate That The Construction Works He Offers Meet The Requirements Specified By The Ordering Party. Equivalent Solutions Used By The Contractor Must Be At Least: • Of The Same Strength And Durability, With The Same Level Of Aesthetics; • Of Technical Parameters Indicated In The Description Of The Subject Of The Contract; • Meet The Same Functions, Safety And Quality Requirements; • Have Appropriate Approval Documents For Use. In Each Case Of Use In Technical Documentation Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Technical Documentation, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Technical Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Technical Documentation, It Means That They Are Given As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. . The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Technical Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Implementation Order That The Equipment And Materials Used By Him Meet The Requirements Specified By The Ordering Party. The Use Of A Label In The Technical Documentation Means That The Ordering Party Accepts All Labels Confirming That Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party. If The Contractor, For Reasons Beyond Its Control, Cannot Obtain The Label Specified By The Contracting Authority Or An Equivalent Label, The Contracting Authority, Within The Deadline Set By Itself, Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Works Construction, Supplies Or Services To Be Performed By Him Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. The Use In The Technical Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Test Report Carried Out By This Body As A Means Of Evidence Confirming Compliance With Requirements Or Features Specified In The Description Of The Subject Of The Contract, Offer Evaluation Criteria Or Contract Performance Conditions Means That The Ordering Party Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Ordering Party Also Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, In The Event That A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In An Appropriate Time, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor. , And Provided That A Given Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Specified In The Description Of The Subject Of The Order, The Offer Evaluation Criteria Or The Requirements Related To The Implementation Of The Order. If The Description Of The Subject Of The Order Includes A Provision Resulting From The Knr Or Knnr Indicating The Need To Use Specific Equipment With Specific Parameters To Complete The Order. The Ordering Party Allows The Use Of Other Equipment As Long As It Ensures The Achievement Of The Assumed Design Parameters And Does Not Result In The Risk Of Non-Compliance Of The Work Performed With The Technical Documentation.
