1. The Subject Of The Order Is The Delivery And Assembly Of Furniture, Catering Equipment And Other Equipment For Newly Built Tourist Facilities, I.E. A Brine Graduation Tower With A Geothermal Water Pump Room And A Geothermal Tourism Point For The Uniejów Commune Carried Out Under The Polish Government Fund Program: Strategic Investment Program .2.The Delivery Is Carried Out As Part Of The Investment Task Creation Of An Interactive Geothermal Tourism Point In Uniejów And Intensification Of The Tourist Economy In The Uniejów Spa By Building A Brine Graduation Tower With A Thermal Water Pump Room3. The Execution Of The Order Includes The Purchase And Delivery Of Brand New Furniture, Catering Equipment And Other Equipment In Accordance With The Description Contained In Annex 5 (Sopz) To Swz, Together With The Assembly Service In The Following Facilities: A) Graduation Tower With A Water Pump Room At Bpa Świnki Street In Uniejów B) Point Geothermal Tourism At Zamkowa Street In Uniejów. 4. The Costs Of Delivery And Unloading Of The Subject Of The Order Are The Responsibility Of The Contractor.5. The Delivered Subject Of The Order Should Be Brand New, Free From Defects, Meet The Quality Standards Specified In The Relevant Legal Acts, Have A Manufacturers Warranty And Should Meet All Requirements Provided For In Applicable Regulations For This Type Of Products And Cannot Be The Subject Of Claims By Third Parties. 6. The Scope Of The Order Includes In Particular: A. Delivery Of Furniture And Equipment Together With Transport To The Facilities B. Bringing In Furniture And Equipment, C. Assembly Of Furniture And Equipment, Setting And Leveling D. Delivery Of Equipment And Ensuring Installation, Commissioning And Integration Of The Purchased Equipment7. The Detailed Scope Of Works Is Included In The Attached To The Swz: Detailed Description Of The Subject Of The Order (Sopz) - Annex No. 1.1 To Swz 8. The Detailed Description Of The Subject Of The Contract (Sopz) Included In Annex No. 5 Contains The Minimum Requirements That The Offered Subject Of The Contract Must Meet. Regarding The Dimensions Of Furniture And Equipment, The Ordering Party Does Not Allow Dimensions Other Than Those Indicated In The Sopz. The Dimensions Of The Furniture And Kitchen Equipment Have Been Adapted To The Size Of The Existing Rooms And Any Deviations In The Dimensions Of The Furniture Could Prevent Delivery.9. The Scope Of Work Also Includes Auxiliary And Accompanying Works And Other Works Necessary To Perform The Order Not Included In The Above-Mentioned Documents, But Necessary To Be Performed Due To The Principles Of Technical Knowledge And Legal Provisions, In Particular: A. All Types Of Security, Including Security: Under In Terms Of Safety, Occupational Health And Safety As Well As Theft And Devastation, B. Repairing Any Damage Caused During The Performance Of Works, C. Collecting, Transporting, Managing And Transferring Waste For Disposal In Accordance With The Act Of December 14, 2012 On Waste (Consolidated Text: Journal Of Laws Of 2019, Item 701, As Amended), The Contractor Is A Waste Producer Within The Meaning Of The Act Indicated In This Point And Will Manage, At His Own Responsibility And Expense, Waste Generated During The Implementation Of The Task, D. Removal Of Waste Generated From The Places Of Its Generation On An Ongoing Basis 10. Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Tasks Related To The Subject Of The Order. The Contractor May Entrust The Implementation Of Elements (Parts) Of The Subject Of The Order To Subcontractors. If The Contractor Intends To Perform The Subject Of The Contract With The Participation Of Subcontractors, The Contractor Is Obliged To Indicate In His Offer The Parts Of The Contract (Material Scopes) The Performance Of Which He Intends To Entrust To Subcontractors, And To Provide The Names Of Any Subcontractors, If They Are Already Known. Such Indication Should Be Included In The Offer. If Subcontracting Is Not Indicated In The Offer, The Contractor Will Be Able To Introduce A Subcontractor Only On The Terms Specified In The Contract. 11. Project Co-Financed By The Polish Government Fund: Strategic Investments Program No. 01/2021/5658/Polskilad 12. The Contractor Undertakes To Properly Perform The Subject Of The Order, In Accordance With The Requirements Specified In The Specification Of The Terms Of Order And The Provisions Of The Draft Contract And The Principles Of Technical Knowledge, Principles Of Due Diligence And Applicable Standards And Regulations.13. The Contractor Is Obliged To Notify The Ordering Party About The Date Of Delivery And Installation Of Individual Furniture, Catering And Multimedia Equipment And Other Equipment At Least 2 Days (2 Business Days) In Advance. Delivery Of The Subject Of The Contract For Each Part Will Take Place Between 8:00 A.M. And 3:00 P.M. On Business Days. 14. Equivalent Solutions: • If The Ordering Party In The Description Of The Subject Of The Order Indicated Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described - I.E. They Consist In Maintaining Such The Minimum Technical, Quality And Functional Parameters. • A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards. • If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described, In Accordance With Annex No. 1.1 To Swz.15. The Delivered Furniture, Catering Equipment And Other Equipment Will Be Accepted In The Form Of A Protocol, After Confirming The Compliance Of The Delivery With The Terms Of The Order. 16. The Contractor Will Be Obliged To Clean Up And Dispose Of, At His Own Expense, Remains After Delivery And Assembly As Well As Other Waste From His Own Activities (Garbage, Empty Packaging, Used Elements, Etc.).
