1. The Subject Of The Order Is The Reconstruction And Expansion Of The Sewage Treatment Plant In Janów, In The Design And Build Formula.2. The Subject Of This Order Is To Design The Works, Obtain All Relevant Decisions, Arrangements And Administrative Permits, And Perform Works Related To The Implementation Of The Investment. The Scope Of Works Includes The Reconstruction And Expansion Of The Sewage Treatment Plant In Janowo, In Accordance With The Tasks Indicated In The Functional And Utility Program (Hereinafter Referred To As Pfu).3. A Detailed Description Of The Subject Of The Order Can Be Found In The Pfu, Which Constitutes Annex No. 8 To Swz.4. If The Materials Describing The Subject Of The Order Contain Trademarks, Patents Or Origin, Source Or Detailed Process That Characterizes The Products Delivered By A Specific Contractor, The Ordering Party Allows Materials And/Or Solutions Equivalent To Those Described, Provided That The Technical, Quality And Operational Parameters Are Not Worse Than Those Indicated. In Documentation And Not Leading To A Change In Technology. The Names Indicated In The Documentation Should Be Treated As Examples. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate In The Offer That The Construction Works And Materials Used/Delivered As Part Of The Subject Of The Order Offered By Him Meet The Requirements Specified By The Ordering Party. 5. A Detailed Description Of The Subject Of The Order Is Also Included In The Draft Provisions Of The Contract, Which Constitute Annex No. 7 To Swz.6. The Contractor Will Perform The Subject Of The Order On The Basis Of: Developed Design Documentation, Swz Together With Annexes, Questions And Answers Provided During The Public Procurement Procedure, As Well As Applicable Detailed Regulations And Construction Practice.7. The Execution Of The Order Is Subject To Polish Law, In Particular The Act Of July 7, 1994 Construction Law (Consolidated Text, Journal Of Laws Of 2021, Item 2351, As Amended) (Hereinafter Referred To As The Construction Law), The Provisions Of The Civil Code And The Public Procurement Law. The Contractor Will Be Obliged To Perform Design Services And Construction Works In Accordance With Polish Law, In Particular With Technical And Construction Regulations, Regulations Regarding Independent Technical Functions In Construction And Regulations Regarding Products And Materials Used In Construction.8. Investment Co-Financed By The Rural Development Program For 2014-2020.9. The Contractor Or Subcontractor Undertakes To Provide Employment Under An Employment Contract Within The Meaning Of Art. 22 §1 Of The Act Of June 26, 1974, Labor Code, Throughout The Entire Period Of Contract Execution, All Persons Performing Activities Involving Physical Work During The Implementation Of Construction Works, In Particular Activities Related To: Performing Earthworks, Assembly Works, Related To The Installation Of Pipelines, Installations (Electrical), Construction Of Hardened Surfaces (E.G. Roads, Sidewalks), Operation Of Construction Machines And Equipment (E.G. Operation Of Excavators, Bulldozers, Loaders, Trucks, Etc.) Covered By The Scope Of The Order Indicated In § 1 Of The Draft Provisions Of The Contract, Which Constitute An Annex No. 7 To Swz. The Requirement Does Not Apply To Persons Managing Construction Sites, Persons Performing Independent Technical Functions In Construction, Persons Running A Sole Proprietorship (Self-Employment) Providing Construction Materials, Transport, Equipment And Similar Services. Detailed Requirements For Employment Under An Employment Contract And Sanctions For Non-Compliance Above The Requirement Has Been Described In § 12 And 13 Of The Draft Provisions Of The Contract, Which Constitute Annex No. 7 To The Swz.
