1. The Subject Of The Order Is The Construction Of A Room For People With Special Needs In The Building Of The Wielkopolska Provincial Office In Poznań.2. The Detailed Scope Of Construction Works And The Method Of Their Implementation Were Specified In The Description Of The Subject Of The Order (Annex No. 4.1 To The Swz), The Bill Of Quantities (Annex No. 4.2 To The Swz) And The Technical Specification For The Execution And Acceptance Of Works (Annex No. 4.3 To The Swz), Which Constitute Annex No. 4 To Swz. 3. The Contractor Is Obliged To Prepare As-Built Documentation Of The Completed Works As Part Of The Subject Of The Order.4. The Contractor Is Obliged To Include Works Not Included In The Bill Of Quantities, But Necessary To Complete The Subject Of The Order, In The Offered Order Price. 5. The Ordering Party Requires A Guarantee For The Work Performed And The Materials Used During The Work For A Period Of Min. 36 Months, Counted From The Date Of Signing (Without Comments) Of The Final Works Acceptance Report.6. Construction Works Will Be Carried Out In Compliance With The Minimum Standards Of Architectural And Information And Communication Accessibility Specified In Art. 6 Of The Act Of July 19, 2019 On Ensuring Accessibility For Persons With Special Needs (Journal Of Laws Of 2022, Item 2240). The Construction Work Will Be Performed In Accordance With The Regulation Of The Minister Of Infrastructure Of April 12, 2002 On The Technical Conditions To Be Met By Buildings And Their Location (Journal Of Laws Of 2022, Item 1225), Including: Taking Into Account Lighting, Surfaces, Equipment And Dimensions Referred To In The Above-Mentioned Regulation7. Before Starting The Works, The Contractor Will Present To The Ordering Party For Approval Catalog Cards Or Samples Of Materials Used To Complete The Order, Including: Floor Coverings, Paints, Aluminum Windows And Doors, Furniture, Glass Panels, Changing Table, Sanitary Fittings, Etc.8. Before Commencing The Execution Of The Order Regarding Furniture Development, The Contractor Will Present The Ordering Party With 3 Different Samples Of The Furniture Color In Shades Of Gray. The Ordering Party Will Inform The Contractor About The Selection Of The Selected Color Sample By E-Mail. The Contractor Will Make Furniture In The Color Of The Selected Sample.9. All Materials Used To Complete The Order Must Be Of Full Value And Have Valid Quality Certificates, Approval Certificates, Attestations, Safety Mark Certificates, Declarations Of Conformity Or Certificates Of Compliance With The Polish Standard Required By Applicable Regulations.10. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems In Accordance With Art. 101 Section 4 Of The Act, The Ordering Party Allows Equivalent Solutions. If The Detailed Description Of The Subject Of The Order (Annex No. 4 To The Swz) Includes The Names Of Materials, Products Or Devices From Specific Manufacturers, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials, Products Or Devices With At Least The Same Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used Are At Least The Same As Those Described In The Swz. If An Equivalent Solution Is Offered, The Contractor Is Obliged To Demonstrate The Equivalence Of The Solutions Used. 11. The Contractor Who Refers To Equivalent Solutions Is Obliged To Prove/Demonstrate In The Offer That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Order To An Equivalent Extent. During The Work Implementation Stage, The Contractor Will Use The Materials Indicated In The Offer. 12. The Ordering Party Allows For A Local Inspection Of The Place Of Execution Of The Subject Of The Order, After Prior Telephone Arrangement Of The Date And Time With The Employees Of The Service And It Office, Tel. (61) 854 17 40, Tel. 506 195 042 And (61) 854 16 86. 13. The Ordering Party Requires That Burdensome Work Be Performed After The Offices Opening Hours, I.E. After 15.30 And On Saturdays. The Ordering Party Will Enable The Contractor To Carry Out The Work Until 8 P.M. On Working Days And On Saturdays. 14. The Ordering Party Requires That The Work Area Where Construction Works Have Been Completed Be Handed Over To The Ordering Party And Cleaned. 15. On An Ongoing Basis, During The Implementation Of The Works, The Contractor Is Obliged To Remove And Dispose Of Construction Waste, Garbage And Other Materials Remaining After The Works At His Own Expense. 16. The Contractor Is Fully Liable For Any Damage Occurring On The Premises Of The Work Being Performed And/Or In Connection With These Works, Including, Among Others: Damage/Destruction Of Facade Walls And Internal Installations. If Any Damage Occurs Due To The Fault Of The Contractor, He Is Obliged To Inform The Ordering Party And Repair The Damage At His Own Expense And On His Own Responsibility.17. The Required Scope Of Works Should Be Carried Out By The Contractor With Due Diligence, In Accordance With The Requirements Of Polish Standards, The Provisions Of The Construction Law, Occupational Health And Safety Law, And Fire Protection Law. And The Principles Of Construction Art. 18. The Contractors Contact Persons Indicated In The Contract Will Each Time Participate In Working Meetings, Organized As Needed, To Discuss The Progress Of Work Or Any Possible Problems. 19. Before Starting Work, The Contractor Will Provide The Ordering Party With A List Of Employees Performing The Subject Of The Order. The Contractor Is Obliged To Update The List Of Employees On An Ongoing Basis In The Event Of Any Changes In Employment.20. The Work Will Be Performed In An Operational Facility. Due To The Above, The Contractor Should Ensure Safe Access To The Office Rooms, Secure The Construction Site In Such A Way As Not To Restrict The Movement Of People And So That The Construction Site Does Not Pose A Threat To The Employers Employees And Customers, In Accordance With Art. 6 Point 1 Letter A Of The Act On Ensuring Accessibility For Persons With Special Needs. 21. The Ordering Party Provides For The Requirements Referred To In Art. 95 Section 1 Of The Act, I.E.: The Ordering Party Requires That All Persons Performing Construction And Installation Works Are Employed Under An Employment Contract By The Contractor Or Subcontractor.22. The Scope Of Similar Works Referred To In Art. 214 Section 1 Point 7 Of The Act: Installation, Electrical, Water And Sewage Works, Plastering, Laying Of Pvc Flooring, Disassembly And Installation Of Aluminum Doors, Installation Of An Aluminum Window, Installation Of Furniture, Changing Table, Sanitary Fittings, Construction And Painting Works Related To The Above-Mentioned Works).
