1. The Subject Of The Order Is The Provision Of Property Protection Services: 1) The Area Of The Base Of Zakład Gospodarki Komunlnej W Grodzisk Mazowiecki Sp. Z O. O. I.E. The Area Located In Chrzanów Duży At Ul. Ekologicna 1 Together With The Facilities Erected On It (Hereinafter Referred To As The Basis Area);2) The Area Of The Waste Landfill Located In Kraśnicza Wola (Hereinafter Referred To As The Landfill Area);3) The Area Of The Municipal Market Located In Grodzisk Mazowiecki At Ul. Montwiłła 38 (Hereinafter Abbreviated As The Market Area);4) The Area Of The Gas Boiler Room Located In Grodzisk Mazowiecki At Ul. Bałtycka 18 (Hereinafter Abbreviated As The Boiler Plant Area). Each Area Is Referred To Individually As The Terrain And Collectively As The Lands.2. The Map Of The Areas Constitutes Annex No. 3 To Swz.3. The Contractor Undertakes To Perform The Subject Of The Order By: 1) Staffing The Base Area With One Security Employee Each Week As Follows: On Working Days From Monday To Friday From 18:00 To 07:00 In The Morning Of The Next Day, On Saturdays (If It Is A Working Day) From 15:00 To 07:00 In The Morning Of The Next Day, And On Holidays 24 Hours A Day; 2) Observation Of Images From 6 Video Monitoring Cameras Installed On The Landfill Site In Kraśnicza Wola. Image Preview From The Above-Mentioned Cameras Is Available In The Facility Located On The Base Premises;3) Sending An Intervention Patrol To The Landfill Area In Kraśnicza Wola Upon Notification Of The Ordering Party Or In The Event Of Observing Undesirable Movements On The Monitoring;4) Sending An Intervention Patrol To The Market Premises After Receiving A Signal Signaling A Burglary Into The Building Or At The Request Of The Ordering Party; 5) Sending An Intervention Patrol To The Boiler Room Premises After Receiving A Signal Signaling A Burglary Into The Building Or At The Request Of The Ordering Party.4. Under The Agreement, The Contractor Undertakes In Particular To: 1) Provide Its Own Intervention Patrol With An Intervention Group, And The Response Time Of The Intervention Patrol May Not Exceed 15 Minutes; 2) Prevent Burglary, Destruction Or Damage To Protected Property; 3) Check The Condition Of All External Closures, Security Measures And Seals To Which The Contractor Has Access; 4) Reporting In Writing To The Ordering Party Any Observed Deficiencies Or Violations Regarding The State Of Security Of Property In The Protected Area; 5) Reporting In Writing To The Ordering Party Any Observed Violations Of Internal Order Rules; 6) Installing At The Expense Of The Contractor, On The Base Area, A System For Monitoring The Time, Place And Results Of Work Of Security Staff In Real Time And Providing Reports On Rounds Each Time At The Request Of The Ordering Party And Its Dismantling After The Expiry Of The Contract Period;7) Making Systematic Rounds Of The Base Area;8) Responding In Cases Noticing Packages Of Unknown Origin On The Base Premises;9) Checking The Condition Of Movable Property (Company Cars, Materials And Equipment, Etc.) Located On The Base Premises;10) Performing Activities Related To General Inspection Of Vehicles Leaving And Entering The Protected Base Premises, I.E. Checking Compliance Of The Type Of Goods Exported/Imported By These Vehicles With The Documents Issued For Them (Specifications, Invoices, Etc.). If The Vehicle Leaving The Premises Contains Equipment Or Materials That Were Not In The Vehicle When The Vehicle Entered The Premises, The Vehicle Driver Must Provide Written Consent To The Removal Of The Materials Or Equipment, In Such A Situation The Security Guard Is Obliged To Make A Note In The Service Log, Specifying The Circumstances Of The Incident. ;11) Determining By Security Staff The Rights Of Third Parties To Stay On The Base Premises And Verifying The Identity Of Persons In Order To Establish Their Identity;12) General Management Of The Movement Of Persons And Vehicles On The Base Premises;13) Calling On Third Parties To Leave The Base Premises In The Event Of A Lack Of Permission To Stay There; 14) Exercise Due Diligence In Identifying Persons Who Pose A Direct Threat To The Protected Property In Order To Immediately Hand Over These Persons To The Police, Including The Use Of All Legally Available Possibilities To Apprehend The Perpetrator Or Perpetrators Of A Crime Or Offense Committed On The Protected Areas ;15) Undertake Interventions Using Own Forces And Means Permitted By Law;16) Immediately Inform The Relevant Units Of The Rescue And Fire-Fighting System, The Gas Emergency Service, The Police, The Emergency Service And The Representative Of The Ordering Party Indicated In The Agreement About Noticed Threats;17) Coordinate Actions In The Event Of Intervention By The Services External (Police, Fire Brigade, Ambulance Service, Etc.) By Indicating Evacuation Routes Or Direct Indication Of Routes To The Places Of Events And Providing Information About The Event;18) Keeping A Service Book During Each Duty Of A Security Employee And Showing It Each Time At The Request Of The Ordering Party;19 ) Obligations Of Security Staff To Keep All Information Related To The Implementation Of The Agreement Confidential; 20) Make Keys To The Premises And Vehicle Files Available To Authorized Persons; 21) Immediately Notify The Police Or Other Relevant Services In The Event Of Noticing A Break-In On The Protected Areas; 22) Perform Other Agreed Activities By The Parties To The Agreement. The Ordering Partys Representative Indicated In The Agreement, In Justified Cases, May Issue Instructions Directly To Security Employees, Provided That This Fact Is Recorded In The Service Book, The Issued Instructions Will Fall Within The Subject Matter Of The Agreement And Will Not Conflict With The Provisions Of Law.5. Security Staff Should Be In Uniform Or Have Uniform Clothes And Id Badges.6. The Contractor Undertakes To Perform The Agreement With Due Diligence, In Accordance With The Applicable Legal Provisions, Except That The Ordering Party Does Not Require The Provision Of The Services Described In Section 3 Points 1 And 2 Above By Persons Entered On The List Of Qualified Security Personnel. The Ordering Party Allows The Service To Be Provided By Persons With A Disability Certificate, Provided That The Services Specified In The Swz Will Be Performed Correctly, I.E. That The Disability Of Security Staff Will Not Negatively Affect The Level And Safety Of The Services Provided.7. The Contractors Employees Are Subject To And Carry Out The Orders Of The Contractor, And Exceptionally, In Particularly Justified Cases - Special Orders Of An Authorized Employee Of The Ordering Party. Such Special Instructions May Only Be Implemented Within The Scope Of The Subject Matter Of The Agreement, Applicable Legal Provisions And While Maintaining The Security Of The Protected Property.8. The Contractor Accepts From The Ordering Party Individual Buildings And Warehouses, Together With The Equipment And Movable Property Therein, Devices And Other Property Located On The Base Premises, For Direct Protection.9. The Contractor Will Keep Service Books For The Base Area. In The Service Book, Security Employees Will Make Entries Regarding: 1) Entries And Exits Of Persons Who Are Not Employees Of The Ordering Party, In Particular Containing The Name And Surname Of The Person And Id Card Number; 2) Entries And Exits Of Vehicles Not Owned By The Ordering Party, Specifying The Car Brand And Registration Number , Time Of Entry Or Exit, Destination; 3) Document Regarding The Goods Being Imported Or Exported; 4) Any Irregularities Occurring And Observed In The Areas; 5) Situations Referred To In Section 4 Points 10/10 The Security Book Is Returned To The Ordering Party After Completion Of The Agreement.11. At The Request Of The Ordering Party, The Contractor Will Remove From Performing Activities A Security Employee Who, According To The Ordering Party, Does Not Perform Services Properly, After Warning The Contractor Once, Sent To The E-Mail Address Indicated In § 10 Section 8 Of The Agreement.12. When Performing Services, Physical Security Employees Should Be Fully Physically And Mentally Fit, Dressed In Uniform, Clean And Neat. The Ordering Party Reserves The Right To Inspect The Above-Mentioned Condition, As Well As To Demand That A Security Employee Who Does Not Meet This Requirement Be Removed From Performing His Duties. About The Occurrence Of The Above-Mentioned Circumstances, The Ordering Party Will Notify The Contractor To The E-Mail Address Indicated In § 10 Section 8 Agreement. 13. If It Is Necessary To Immediately Remove Or Prevent The Employee From Performing Services Pursuant To Section 11-12, The Contractor Undertakes To Send Another Physical Security Employee To A Given Location Within A Period Not Longer Than 120 Minutes. This Time Also Applies In Emergency Situations That Prevent The Physical Security Employee From Performing Services.14. The Provision Of Section 13 Above Shall Apply Accordingly In The Event Of Illness Or Other Absence Of The Security Employee.15. The Guaranteed Number Of Man-Hours For The Provision Of Property Protection Services For The Base Area Throughout The Entire Period Of Implementation Of The Agreement Is 11,174, While The Maximum Number Is 11,520. The Maximum Number Of Hours Will Be Used In The Event Of Additional Days Off At The Ordering Party, As Well As In The Event Of Additional Organizational Needs For The Ordering Party. If The Maximum Number Of Man-Hours Is Not Used, The Contractor Is Not Entitled To Any Claims In This Respect.
