The Subject Of The Order Includes The Delivery Of A Balance Beam To Hws Urania Under Project No. Rpwm.08.01.00-28-0001/20, Entitled: Reconstruction And Expansion Of The Urania Entertainment And Sports Hall In Olsztyn.2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz Description Of The Subject Of The Order. 3. The Parameters And Requirements Indicated In The Opz Specify The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Order Delivered To The Ordering Party.4. The Entire Delivered Assortment And Its Elements Must Meet The Specifications Specified In The Description Of The Subject Of The Order (Opz), And In Particular They Must: A) Be Manufactured No Earlier Than In 2022; B) Be Brand New, Not Previously The Subject Of Exhibitions Or Displays, And Technically Efficient , Without External Defects, Complete And Ready For Use In Accordance With Their Intended Purpose; C) Be In Accordance With The Conditions Resulting From Applicable Legal Provisions And Applicable Standards And Quality Norms In The Industry For This Type Of Assortment; D) Have All Legally Required Certificates, Approvals, Permits, Etc. Authorizing Their Use; E) Have Full Documentation And Accessories Necessary For Use, I.E. In Particular: Operation And Maintenance Manual (If Applicable), Declaration Of Conformity, Warranty Conditions, And All Documents Must Be Prepared In Polish (Accessories Mean All Devices That Are Necessary For Proper Ongoing Operation, If The Accessories Require Permanent Installation, The Contractor Undertakes To Deliver And Install Them).5. The Ordering Party Allows The Submission Of Equivalent Offers In Accordance With Art. 99 Section 5 Ppl And Art. 101 Section 4 Of The Public Procurement Law, However, The Requirements And Technical Parameters Specified By The Ordering Party Defining The Subject Of The Contract Are The Minimum Conditions That The Ordering Party Will Expect To Be Met. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions, As Appropriate, Together With Its Description Or Standards.6. The Ordering Party Informs That Where The Ordering Party Has Described The Subject Of The Contract By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Contracting Authority Indicates That It Allows Solutions Equivalent To Those Described. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies Or Services He Offers Meet The Requirements Specified By The Ordering Party.7. The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor.8. The Ordering Party Requests That The Contractor Indicate In The Offer The Parts Of The Order The Performance Of Which He Intends To Entrust To Subcontractors, And Provide The Names Of Any Subcontractors, If They Are Already Known.9. The Ordering Party Does Not Intend To Verify Subcontractors For The Absence Of Grounds For Exclusion.10. The Ordering Party Does Not Allow The Submission Of Variant Offers And Requires The Submission Of An Offer Consistent With The Subject Of The Order.
