The Subject Of The Order Is The Renovation Of Rooms In Building No. 7 In The Military Complex At Ul. Jagiełły 11-23 In Grudziądz, In Accordance With The Requirements Specified In The Contract And A Detailed Description Of The Subject Of The Order And Its Scope Included In The Technical Specification For The Execution And Acceptance Of Works (Stwiorb) And Design Documentation Including The Bill Of Quantities. Scope Of The Subject Of The Order: ►Construction Works: Replacement Of Joinery Door; Replacement Of Window Frames; Bricklaying Works; Vertical And Horizontal Anti-Moisture Insulation Of Rooms; Flooring Works - Laying Floor Tiles Along With Repairing The Floor And Applying A Self-Leveling Layer; Construction Of Sewage And Water Lines With Plasterboards; Cutting Off Old And Making New Internal Plasters; Laying Wall Tiles; Laying Floor Coverings; Painting Of Wall Surfaces With Prior Plastering; Construction Of Suspended Ceilings On Metal Grids.►Electrical Installation Works: Replacement Of Cables, Sockets And Switches; Replacement Of Lighting Fixtures; Installation Of An Electric Heater; Installation Of A Mechanical Fan ►Sanitary Works: Replacement Of Water And Sewage Installations; Replacement Of Sanitary Facilities; Replacement Of Radiators ►The Scope Of Works Also Includes The Performance Of Accompanying Works Consisting Of Lighting The Work Area, Securing The Work Area With Warning Signs, Constructing And Maintaining Construction Facilities, Marking And Securing Installations And Devices On The Work Site. The Above Is Carried Out By The Contractor With His Own Efforts And At The Price Of The Contract. The Facility Within The Scope Of Which The Works Will Be Performed Will Be Open For The Duration Of Their Execution, With The Exception Of The Part Of The Building Where The Works Will Be Performed. All Construction Works Should Be Organized And Carried Out In Such A Way As To Ensure Safety For People Staying In The Complex And Building And Uninterrupted Use Of The Building. ► The Contractor Is Obliged To: 1) Ensure The Safety Of Employees Performing The Works (In Particular To Train Employees And Equip Them With Necessary Equipment);2) Securing The Building Against Destruction And Other Damage;3) Carrying Out Works On The Work Site In A Way That Does Not Cause Any Inconvenience To The Users Of The Military Complex4) Enabling Safe And Undisturbed Use Of The Building And The Complex Area By Employees, Soldiers And Customers Of A Given Military Unit; 5) Ensuring, On Its Own And At Its Own Expense, Appropriate Occupational Health And Safety Conditions, Protective Clothing And Accessories In Accordance With Applicable Regulations, As Well As Equipment, Resources (Including Personal Protective Equipment And Disinfectants) And Devices Necessary To Perform The Activities Covered By The Contract. If The Conditions As Above Are Not Met, The Contractor Shall Be Liable For Damages And Situations Arising As A Result Of His Actions Or Omission. ► The Contractors Remuneration For The Execution Of The Subject Of The Order Is Determined In A Cost Estimate, According To The Price Indicated In The Contractors Offer. ►The Contractor Provides All Materials And Equipment Necessary To Perform The Subject Of The Order On Its Own And At Its Own Expense And Is Obliged To Use Construction Products Consistent With The Technical Specification For The Execution And Acceptance Of The Works And Approved For Use By The Act Of July 7, 1994 Construction Law ( Journal Of Laws Of 2023, Item 682, Consolidated Text), With Current Approvals And Certificates Allowing Their Use. ►The Materials Used To Complete The Subject Of The Order Cannot Reduce The Utility And Quality Value Of The Completed Order Elements Or Negatively Affect The Durability, Functionality, Aesthetics And Safety Of Use And Enjoyment Of The Work Area And Its Boundaries. If A Trademark, Patent, Origin Is Indicated In The Description Of The Subject Of The Order - It Should Be Assumed That The Indicated Trademarks, Patents, Origin Determine The Technical, Operational And Utility Parameters, Which Means That The Ordering Party Allows Solutions Equivalent To Those Described (Legal Basis: Art. 99 Of The Act) Provided That The Technical Parameters/Physical And Chemical Composition Of The Offered Equivalent Products Guarantee The Final Effect Required By The Ordering Party, Identical To The Original Product. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate (At The Stage Of Submitting The Offer) That The Materials He Offers Or Products For The Execution Of The Subject Of The Order Meet The Requirements Specified By The Ordering Party (Legal Basis: Article 99 Of The Act) By Submitting A Technical Description And Providing The Name Of The Product And Manufacturer. If The Contractor Does Not Submit Information On The Use Of Equivalent Materials With The Offer, It Is Assumed That The Price Calculation Includes The Materials Indicated In The Documentation. ► The Contractor Is Obliged To Perform The Works In Accordance With Construction Practice And Construction Standards, Applicable Technical And Technological Regulations And Standards, While Compliance With Applicable Occupational Health And Safety Regulations.►The Transport Of All Materials And Equipment To The Work Site And Their Operation Are The Responsibility Of The Contractor. ►The Contractor Is Obliged To Ensure Its Own Removal And Disposal Of Waste (Garbage, Rubble, Etc.) In Accordance With Applicable Law, In Particular The Waste Act (Article 3(1)(32) Of The Waste Act Of December 14, 2012, Journal Of Laws Of 2023, Item 1587, As Amended) And Documenting These Activities. The Contractor (Or His Subcontractor) Should Have Authorizations Regarding Permits Arising From The Waste Act And Compliance With The Requirements Of The Act Of December 14, 2012 On Waste (Journal Of Laws Of 2023, Item 1587, As Amended). If The Contractor Uses A Subcontractor In The Above Scope, He Should Indicate The Subcontractor Along With The Offer. If The Contractor Does Not Indicate Entrusting The Removal And Disposal To A Subcontractor, The Ordering Party Will Assume That The Contractor Will Perform The Scope In Question On His Own And Has All The Rights In This Respect In Accordance With Applicable Law. ►The Contractor Is Obliged To Collect And Remove Scrap Obtained During Construction Works. Scrap Obtained From Ongoing Disassembly Should Be Immediately Weighed In The Presence Of The Ordering Partys Supervisory Inspector. Removal Of Scrap From The Construction Site Will Be Possible After Written Notification And Acceptance Of The Document By The Supervisory Inspector. Each Removal And Reweighing Will Prepare A Quantitative Summary Of The Scrap Obtained From Dismantling, Indicating The Type Criterion (Steel, Cast Iron, Copper, Brass, Aluminum Scrap). Each Time, Based On The Prepared List Obtained From The Dismantling Of Scrap, The Ordering Party Will Issue A Vat Invoice In Accordance With The Currently Applicable Provisions Of The Act And Thus Authorize The Contractor To Sell Or Manage The Scrap Obtained From The Dismantling. The Value Of The Scrap Will Be Determined As Follows: Number Of Kg Of Steel Scrap X Pln 0.85/ Kg (Average Wholesale Price In The Kuyavian-Pomeranian Voivodeship); Quantity Kg Of Cast Iron Scrap X Pln 1.20/Kg (Average Wholesale Price In The Kuyavian-Pomeranian Voivodeship); Quantity Kg Of Aluminum Scrap X Pln 5.33/Kg (Average Wholesale Price In Kuyavian-Pomeranian Voivodeship);► The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Construction Works Covered By The Scope Of The Subject Matter Of The Contract - The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2023, Item 1465). The Contractor Or Subcontractor Is Obliged To Employ People Under An Employment Contract At Least For The Duration Of The Contract Concluded Between The Contractor And The Ordering Party - Art. 95 Of The Public Procurement Law
