1. The Subject Of The Public Contract Are Construction Works Consisting In The Construction Of A Hardened Shoulder Of A Municipal Road In Łojewo.2. The Scope Of The Order For Part 1 Includes: 1) Construction Of Approx. 530 Meters Of Roadside In The Village Of Łojew, In Accordance With The Construction Design. 2) Roadside Width Variable, Up To 2.2 M. Limited On One Side By A Resistor (On The Side Of One Side) And An Edge Or Plinth From The Existing One. Fences. 3) One-Sided Transverse Slope 2%. 4) A Foundation Made Of Mechanically Stabilized Crushed Aggregate, 20 Cm Thick, With An Aggregate Fraction Of 0/31.5 Mm. 5) A Wearing Course Of 8 Cm Thick Concrete Cubes On A 1:4 Cement-Sand Ballast, 3 Cm Thick. 6) Bituminous Sealing Mass Should Be Used Between The Road And The Resistor. 7) The Section Planned For Construction From The Side Of The National Road.3. The Detailed Scope Of The Subject Of The Order For Parts 1 And 2 Is Specified In The Technical Documentation Constituting Annex No. 1 To The Swz, Which Consists Of: Design Documentation And Technical Specification For The Execution And Acceptance Of Construction Works.4. The Bill Of Quantities Attached To The Swz By The Ordering Party Is Of Informative And Auxiliary Nature And Does Not Constitute The Basis For Determining The Amount Of Remuneration In Connection With The Adoption Of A Lump Sum Remuneration. As Part Of The Remuneration, The Contractor Is Obliged To Perform Work Not Included In The Bill Of Quantities, Which Could Be Predicted On The Basis Of The Attached Technical Documentation. 5. All Requirements Specified In The Technical Documentation Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Pzp.6 Act. If The Technical Documentation Indicates Names, Trademarks, Patent Or Origin, Source Or Specific Process Characterizing The Product Or Service Provided By A Specific Contractor, If This Could Lead To Privilege Or Elimination Of Certain Contractors Or Products - They Should Be Treated As Exemplary Solutions Specifying Standards, Appearance And Technical Requirements. The Ordering Party Allows The Offer Of Equivalent Materials Or Devices Described In The Swz, Provided That They Ensure Technical Parameters Not Worse Than Those Specified In The Documentation.7. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party In Chapter Iii, Section. 9 Swz. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.8. The Contractor Is Obliged To Offer A Product With Similar Properties That Is Functionally Suitable For The Intended Use. All Materials, Devices And Equivalent Solutions Must In Particular: Have The Same Strength And Durability, Have The Same Level Of Aesthetics, Have The Technical Parameters Of Materials And Devices If Specified In The Technical Documentation, Must Be Compatible With The Existing And Planned Infrastructure, Fulfill The Same Functions , Meet Construction Safety, Occupational Health And Safety And Fire Protection Requirements And Have Appropriate Documents Allowing Use In Construction, Certificates And Technical Approvals.9. The Contractor Is Obliged To Perform The Subject Of The Order In Accordance With The Swz And The Documents Attached Thereto, The Submitted Offer, Applicable Laws, Standards And Construction Practice.10. Required Warranty Period For The Subject Of The Order (Materials And Labor): Minimum 3 Years From The Date Of The Mutually Signed Final Acceptance Protocol, Maximum 5 Years From The Date Of The Mutually Signed Final Acceptance Protocol, In Accordance With The Contractors Declaration Submitted In The Offer. The Warranty Period Is One Of The Criteria For Evaluating Offers In Accordance With Chapter Xv Of The Swz. 11. The Description Of The Ordering Partys Requirements In Terms Of Implementation And Acceptance Is Specified In The Draft Provisions Of The Contract Constituting Annex No. 9 To The Swz.
