The Ordering Party Does Not Allow The Submission Of Variant Offers.4. The Ordering Party Requests That The Contractor Indicate In The Offer The Parts Of The Order Whose Performance Will Be Entrusted To Subcontractors, And Provide The Names Of Any Subcontractors, If They Are Already Known (Appendix No. 5).5. Employment Requirements Based On An Employment Relationship In The Circumstances Referred To In Art. 95 Of The Act: 1) The Ordering Party Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract, Persons Performing Activities Related To The Execution Of The Order. 2) During The Execution Of The Order, The Ordering Party Is Entitled To Carry Out Inspection Activities Towards The Contractor Regarding Compliance By The Contractor Or Subcontractor With The Requirement Of Employing Persons Performing The Activities Indicated In Point 1 On The Basis Of An Employment Relationship. In Order To Verify The Fulfillment Of These Requirements, The Ordering Party Is Entitled, In Particular, To Request: A) Declaration Of The Employed Employee; B) Declaration Of The Contractor Or Subcontractor About Employing An Employee Under An Employment Contract; C) A Certified Copy Of The Employment Contract Of The Employed Employee; D) Other Documents - Containing Information, Including Personal Data, Necessary To Verify Employment Under An Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Duties; 3) At Each Request Of The Ordering Party, Within The Time Specified In The Request, The Contractor Will Submit To The Ordering Party The Evidence Indicated In Point 2 In Order To Confirm The Fulfillment Of The Requirement Of Employment Under An Employment Relationship By The Contractor Or Subcontractor Of Persons Performing The Activities Listed In Point 1. 4) In The Event Of Justified Doubts As To To Comply With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate.
