1. The Subject Of The Order Is The Purchase Of A Van (Brigade Truck), With A Permissible Total Vehicle Weight Of 3,500 Kg, Equipped With A Hook Adapted To Tow A Trailer With A Gvw Of 3,500 Kg, For The Needs Of The Municipal Sports And Recreation Center In Elbl g, According To The Detailed Description Of The Subject Of The Order Constituting The Annex. No. 1 To Swz.2. The Vehicle Must Be Free From Defects And Damage And Free From Any Encumbrances Owed To Third Parties And Is Not The Subject Of Any Proceedings Or Security.3. Together With The Vehicle Being The Subject Of The Contract, The Contractor Is Obliged To Provide Documentation In Polish, Including: 1) A Set Of Documents: Warranty Book, Owners Manual And Other Vehicle Documents Required By Law, Including Documents Necessary For Vehicle Registration. 2) List Of Authorized Service Stations In Poland With Addresses And Telephone Numbers;3) Vehicle Warranty Book; 4) Terms Of The Warranty;5) Approval Certificate;6) Service Inspection Book In Paper Form (If The Manufacturer Issued One).4. The Vehicle Constituting The Subject Of The Order Must Meet The Technical Conditions Provided For By Legal Regulations In Force In Poland, In Particular It Must Be Approved And Meet The Requirements For Exhaust Emissions In Accordance With Applicable Regulations.5. The Contractor Is Obliged To Attach To The Offer A Detailed Technical And/Or Functional Description Of The Offered Vehicle, Allowing For The Assessment Of The Compliance Of The Offered Vehicle And Its Parameters With The Swz Requirements, Including Clear Photos Of The Offered Vehicle, Which Will Allow The Ordering Party To Assess, In The Most Accurate Way Possible, At Least The Visual Condition Of The Offered Vehicle. Vehicle.6. The Ordering Party Will Collect The Vehicle At The Contractors Premises At Its Own Expense And Risk, After Prior Arrangement Between The Contractor And The Ordering Party On The Date And Time Of Collection. The Delivery Date Will Be Agreed In Writing Or By E-Mail At Least 2 Business Days Before The Scheduled Delivery Date.7. After Selecting The Offer, After Signing The Contract, And Before Signing The Acceptance Protocol, The Ordering Party Reserves The Right To Inspect The Vehicle And The Right To A Test Drive (Lack Of Consent To The Implementation Of The Above-Mentioned Condition Will Result In The Ordering Partys Right Not To Sign The Acceptance Protocol, Due To The Fault Of The Contractor). The Contractor Is Obliged To Refuel The Vehicle With Enough Fuel To Enable The Test Drive Referred To Above8. The Ordering Party May Refuse To Accept The Subject Of The Contract If: 1) It Finds Defects In The Subject Of The Contract, 2) The Subject Of The Contract Does Not Meet The Conditions Specified In The Swz Or In The Contractors Offer.9. If The Circumstances Referred To In Section 8 The Ordering Party Will Set An Additional Deadline For The Contractor To Deliver The Subject Of The Contract In Accordance With The Swz And Free From Defects, At The Contractors Expense And Risk (Not Shorter Than 7 Days), Which Will Be Included In The Acceptance Protocol. After The Ineffective Expiry Of The Above Deadline, The Ordering Party Will Have The Right To Withdraw From The Contract In Its Entirety Due To The Fault Of The Contractor.
