Square Area: 7002 M2 2. The Road Mileage Given Above Is Indicative The Ordering Party Reserves The Right To Introduce Additional Road Sections For Snow-Making And To Verify Their Length. It Is Not Possible To Determine The Actual Number Of Kilometers Of Winter Maintenance Of The Above-Mentioned Roads During The Contractual Period - This Is Due To Meteorological Conditions Beyond The Control Of The Ordering Party. 3. A Map Of The Commune With A List Of Roads And Streets Covered By Winter Maintenance Of Commune Roads And Streets, Divided Into Parts Of The Order, Is Set Out In Annex No. 1 To Swz 4. The Ordering Party Allows The Submission Of Partial Offers. The Contractor May Submit An Offer For The Performance Of One Or More Selected Or All Parts Of The Order.5. Winter Maintenance Of Municipal Roads And Streets Should Be Carried Out In Accordance With The Following Standards: A) The Entire Width Of The Road Should Be Cleared Of Snow/Minimum Snow Clearing Width 4 M, Snowdrifts Are Not Allowed, There May Be A Layer Of Accumulated Snow With A Thickness That Does Not Impede Traffic: Ruts Deeper Than 5 Cm, B) Sprinkling With A Mixture Of Sand And Salt In A Weight Ratio Of 3:1 On An Ongoing Basis As Needed (Snowfall, Drizzle), C) Snow Removal, Sprinkling Carried Out Using Mechanical Equipment, I.E. Light Equipment (Plows, Sand Spreader), Equipment Heavy (Excavator, Loader, Etc.) D) Clearing Snow From Sidewalks Enabling Free Movement Of People, Bus Bays, Parking Lots, Etc. 6. When Implementing The Scope Of The Order, The Contractor Is Obliged To: A) Carry Out An Inspection Of The Equipment Intended For The Execution Of The Order. The Equipment Should Be Operational And Prepared To Such An Extent That It Can Be Ready For Use At The Time Indicated By The Contractor In The Offer Form. B) Clearing Snow From Roads And Sprinkling In The Event Of Winter Slipperiness Or Excessive Snowfall, C) Providing Own Material For Sprinkling Municipal Roads And Streets To Remove Winter Slipperiness, I.E. Sand And Salt Mixture (3:1), D) Carrying Out Permanent Observing Weather Conditions And Informing The Ordering Party About The Need To Take Action To Maintain Municipal Roads And Streets, E) Strictly Respecting The Instructions Of The Employee Of The City And Commune Office Of Olsztyn Responsible For Direct Winter Action In The Field Of Snow Removal And Sprinkling, F) Confirming The Implementation Of The Ordering Partys Telephone Instructions, At The Latest At Settlement Of Completed Service Stages, G) In The Event Of Bad Weather Conditions, Within ... Minutes, Undertake Snow Removal Or Sprinkling Operations On Municipal Roads After Determining By Telephone With The Ordering Partys Representative The Scope And Type Of Services To Be Performed, H) Performing The Service Also At The Request Of Mpk Or Pks Dispatchers Tarnobrzeg, The Police And Based On Their Own Assessment Of Weather Conditions And The Road Situation, But After Obtaining The Approval Of The Ordering Party, I) Ensuring 24-Hour Communication With The Ordering Party In Order To Transmit Orders, Comments And Instructions, J) Using Only Registered And Approved Road Vehicles And Machines For Traffic On Public Roads And Equipped With A Flashing Warning Light According To Applicable Regulations, K) In The Event Of A Breakdown Of The Vehicle Providing The Services, Ensuring A Replacement Vehicle That Meets The Requirements Contained In This Tor. The Ordering Party Will Not Incur Any Additional Costs In This Respect. L) Providing In The Event Of Extraordinary Weather Conditions (Intense, Long-Lasting Snowfall, Snowstorms, Snowstorms) Specialized Equipment Necessary To Eliminate These Effects Under The Concluded Contract. The Ordering Party Will Not Incur Any Additional Costs In This Respect. M) Removing Snow And Mud From The Area Covered By The Order At The Request Of The Ordering Party. The Removal Of Snow And Mud As Well As The Place Where It Is Stored Is The Responsibility Of The Contractor, In Accordance With Applicable Regulations In This Regard. N) Ensuring An Operator With Appropriate Qualifications To Drive Vehicles Intended For The Execution Of The Order. O) Comply With The Provisions Of The Highway Code While Performing Work And Pay Attention To The Safety Of Vehicles And People Nearby. P) The Ordering Party Is Not Liable For Any Damage Caused By The Contractor While Performing The Subject Of The Order.7. Rules Of Conduct During The Performance Of Works Commissioned By The Ordering Party: 1) Compliance With The Provisions Of: A) The Act Of June 20, 1997 - Road Traffic Law B) The Act Of December 14, 2012 On Waste C) The Act Of September 13, 1996 On Maintaining Cleanliness And Order In Municipalities D) Regulation Of The Minister Of The Environment Of October 27, 2015 On The Type And Conditions Of Use Of Measures That May Be Used On Public Roads, Streets And Squares E) The Contractor Will Adjust The Work Organization In Such A Way That It Is Possible To Handling Several Orders At The Same Time (E.G. When It Is Necessary To Perform Snow Removal And Sprinkling Services At The Same Time, The Contractor Is Obliged To Perform These Services At The Same Time).2) Reservations Of The Ordering Party A) Type Of Service - For Example: Snow Removal Followed By Sprinkling Or Simultaneous Snow Removal And Road Sprinkling, The Ordering Party Decides. B) The Contractor Who Submits The Most Advantageous Offer Will Be Obliged To Present The Declared Equipment For Inspection Before Signing The Contract. C) The Ordering Party Reserves The Right To Check The Correctness Of The Service By Checking The Thickness Of Snow Left On The Road, The Width Of Snow Removal, The Amount Of Agents Scattered And The Width And Length Of Sections Sprinkled With Roughening Material. In The Event Of Non-Performance Or Improper Performance Of The Subject Of The Order, The Contractor Shall Incur Financial Penalties In The Amount Specified In The Contract. D) It Is Recommended That The Contractor, In Order To Obtain All Information That May Be Necessary To Correctly Estimate The Value Of The Winter Road Maintenance Service, Conduct A Local Inspection Of The Municipal Roads Where It Will Be Carried Out. The Contractors Claims Related To Incorrect Calculation Of The Price Of The Service Are Excluded. 8. The Detailed Scope Of The Contractors Obligations For All Parts Of The Order Is Specified In The Draft Contractual Provisions In Annex No. 10 To The Swz
