1. The Subject Of The Order Is A Service Related To Comprehensive Winter Maintenance Of Municipal And Internal Roads In The Winter Season 2023/2024. The Detailed Scope Of Works Is Specified In The Technical Specification For The Execution And Acceptance Of Works (Referred To As St, Stwior Or Similar), Also Including List Of Roads And Their Standards Constituting Annex No. 12 To The Swz And In The Offer Cost Estimate Constituting Annex No. 6 To The Swz.1.1. For Maintaining Readiness To Complete The Order, The Contractor Will Be Paid A Lump Sum, Which Will Be Charged In The Case Of Less Than Five Trips Of The Contractor During A Calendar Month.1.2. In The Case Of An Incomplete Month, The Lump Sum Will Be Paid In Proportion To The Number Of Calendar Days. 1.3. If At Least One Confirmed Trip Is Made, The Lump Sum Amount Is Reduced According To The Conversion Rate: 1 Confirmed Trip = Lump Sum Reduction By 20%. A Trip Is Understood As Carrying Out An Active Action On At Least 60% Of The Roads Listed In Annex 12 To This Swz (The Value Is Calculated Relatively By Summing The Length Of The Actually Cleared Snow Roads, Dividing This Value By The Total Length Of The Roads And Multiplying The Obtained Result By 100.00%). The Length Of The Snow-Cleared Road Means The Distance Covered By The Equipment, Counted Along The Road, On One Side (Due To Road And Weather Conditions, Trips On Both Sides Are Counted As A One-Way Trip) While Simultaneously Performing The Activity For Which The Equipment Is Intended. The Implementation Of An Active Action Is Confirmed By Submitting A Printout From The Gps Navigation System By The Contractor And By Inspecting The Snow-Cleared Sections By The Ordering Partys Representative. These Conditions Must Be Met Cumulatively. The Gps Navigation System Records Must Show That The Equipment Performed The Work For Which It Was Intended. Errors, Ambiguities And Any Omissions And Inaccuracies Resulting From The Operation Of Devices And Equipment Are The Responsibility Of The Contractor. In Case Of Doubts As To The Recording Of The Gps Device, The Ordering Party Has The Right To Refuse To Count The Trip.1.5. The Ordering Party Reserves The Right To Immediately Call On The Contractor To Perform The Subject Of The Order In The Event Of Special Circumstances. 1.6. Any Work Or Activities Necessary For The Proper Performance Of The Order And Not Described In The Detailed Scope Of Work Should Be Treated As Obvious, Covered By The Costs And Deadlines Of The Subject Of The Order.1.7. The Contractor Is Responsible For Quality And Compliance With The Technical And Quality Conditions Described For The Subject Of The Order. Due Diligence Is Required In Fulfilling The Obligations Of The Contract.1.8. Arrangements And Decisions Regarding The Execution Of The Order Will Be Agreed By The Ordering Party With The Contractors Appointed Representative.1.9. The Contractor Will Specify Contact Telephone Numbers, Fax Numbers, E-Mail Addresses And Other Arrangements Necessary For Efficient And Timely Execution Of The Order.1.10. The Contractor Bears Full Legal And Financial Responsibility For The Destruction Of Private, Local Government And State Property Caused By The Contractors Action Or Omission During The Execution Of The Order.1.11. The Contractor Is Obliged To Provide Passenger Transport For Weekly (Maximum 4 Hours A Week) Road Inspection Together With The Ordering Partys Representative In Order To Carry Out Disposal, Inspection And Acceptance Activities. 1/12. The Ordering Party Reserves The Right To Limit The Scope Of The Order.1.13.
