The Subject Of The Order Is The Organization Of A Training Stay, Including Hotel Services, Catering Services And Conference Room Rental Services For Training Groups Of The Following Size: 2 Groups Of Approximately 110 People Each.2. A Detailed Description Of The Subject Of The Order Is Specified In Annex No. 1 To The Swz And In The Contract Template, Which Constitutes Annex No. 2 To The Swz.3. The Ordering Party Does Not Reserve The Right To Apply For The Order Only By Contractors Referred To In Art. 94 Of The Pzp.4 Act. Subcontracting:1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S).2) In Connection With The Execution Of The Order, The Ordering Party Does Not Reserve The Obligation To Personally Perform Key Tasks Of The Order. 3) The Ordering Party Requires That In The Event Of Entrusting Part Of The Contract To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Contract The Performance Of Which He Intends To Entrust To Subcontractors And Provide (If They Are Already Known) The Names Of These Subcontractors. 4) Entrusting Part Of The Contract To Subcontractors Does Not Release The Contractor From Responsibility For Proper Performance Contracts.5. Requirements Regarding The Employment By The Contractor Or Subcontractor Under An Employment Relationship Of Persons Performing The Activities Indicated By The Ordering Party In The Implementation Of This Order: A) Pursuant To Art. 95 Section 1 Of The Public Procurement Law, The Ordering Party Requires The Contractor Or Subcontractor To Employ Persons Performing Organizational And Administrative Activities Under This Order On The Basis Of An Employment Relationship Within The Meaning Of The Act Of June 26, 1974, Labor Code. B) If The Activities Specified In Section 5(A), Meeting The Requirements Of Art. 22 1 Of The Labor Code, The Contractor Will Perform The Work Independently (As The Owner/Co-Owner). The Ordering Party Will Consider This To Be A Fulfillment Of The Employment Condition Based On The Employment Relationship Of Persons Performing Activities Related To The Execution Of The Order. C) The Contractor Will Declare In The Contract That The Person Or Persons Performing The Above-Mentioned Activities Related To The Implementation Of This Order Are Or Will Be Employed On The Basis Of An Employment Relationship Within The Meaning Of The Act Of June 26, 1974. Labor Code. D) The Ordering Party Will Be Entitled To Check Whether The Contractor Meets The Requirements Related To The Employment Of The Person/Persons Entrusted With The Implementation Of The Indicated Activities. At The Request Of The Ordering Party, Within The Period Specified By The Ordering Party, Not Shorter Than 5 Business Days, The Contractor Undertakes To Submit: - A Statement Of The Employed Employee And/Or - A Statement Of The Contractor Or Subcontractor On The Employment Of An Employee Under An Employment Contract And/Or - A Certified True Copy Of The Original. A Copy Of The Employment Contract Of The Employed Employee, Containing Information, Including Personal Data, Necessary To Verify Employment Under The Employment Contract, In Particular The Name And Surname Of The Employed Employee, The Date Of Conclusion Of The Employment Contract, The Type Of Employment Contract And The Scope Of The Employees Responsibilities.E) The Ordering Party Informs That In Case Of Any Doubts Regarding The Employment By The Contractor Or Subcontractor Of Persons Performing Activities On The Basis Of An Employment Relationship, He Is Entitled To Notify The Competent Labor Inspectorate And Request That It Carry Out An Inspection In This Respect. F) Employment Of Persons Referred To In Paragraph 5 Lit. A) Should Last Continuously Throughout The Entire Period Of Performance Of These Activities For The Contractor (Being The Employer), Performed At The Place And Time Designated By Him And Under His Direction. G) The Ordering Partys Rights Regarding Sanctions For Failure To Meet The Requirements Specified In Section 5 Lit. A), Were Regulated In The Contract Template Constituting Annex No. 2 To Swz.6. The Ordering Party Does Not Allow The Possibility Of Submitting A Variant Offer Referred To In Art. 92 Of The Public Procurement Law, I.E. An Offer Providing For A Different Method Of Contract Performance Than That Specified In This Swz.7. The Ordering Party Does Not Envisage Concluding A Framework Agreement And Establishing A Dynamic Purchasing System And Does Not Envisage Selecting The Most Advantageous Offer Using An Electronic Auction. 8. The Ordering Party Does Not Envisage Awarding Orders Pursuant To Art. 214 Section 1 Point 7 Of The Pzp.9 Act. The Ordering Party Does Not Allow Submitting An Offer In The Form Of Electronic Catalogs Or Attaching Electronic Catalogs To The Offer In The Situation Specified In Art. 93 Of The Pzp.10 Act. The Ordering Party Does Not Provide For Settlement In Foreign Currencies. The Order Is Settled In Pln.11. The Ordering Party Does Not Provide For Reimbursement Of The Costs Of Participation In The Procedure. 12. The Ordering Party Does Not Provide For Advance Payments For The Execution Of The Order.13. The Ordering Party Does Not Require The Contractor To Take Part In An On-Site Visit/Check The Documents Necessary To Complete The Order.14. If There Is A Need To Increase The Number Of Training Courses, The Ordering Party Envisages The Use Of The Option Right Referred To In Art. 441 Of The Public Procurement Law. The Option Assumes An Increase In The Subject Of The Order By A Maximum Of 50% Of The Basic Order, I.E. By 1 Group Of Approximately 110 People, While Maintaining The Gross Unit Price Per Person Indicated For The Basic Order, Taking Into Account That The Option Will Be Implemented Within The Time Limit Of The Basic Order, I.E. Up To 2 Months From The Date Of Signing The Contract. Information About The Final Number Of Participants Will Be Provided Each Time 5 Days Before The Date Of A Given Training.15. The Option Right Will Mean That The Ordering Party May Commission The Organization Of One Training Stay For A Specified Number Of People, Subject To Section 14 Above, However, The Contractor Is Not Entitled To Any Claim Against The Ordering Party If The Ordering Party Does Not Exercise The Option Right. 16. The Rules For The Implementation Of The Subject Of The Contract Covered By The Option Right Regarding: The Method Of Its Implementation, Its Acceptance, The Method Of Payment, The Method Of Calculating Contractual Penalties And The Cooperation Of The Parties Will Be The Same As Those Applicable To The Basic Subject Of The Contract. 17. The Ordering Party Will Notify The Contractor About Exercising The Option Right, Depending On Its Needs, No Later Than 14 Days From Signing The Contract For The Basic Order, Based On The Ordering Partys Written Declaration On Exercising The Option Right.18. The Ordering Party Does Not Allow The Possibility Of Submitting Partial Offers (The Order Has Not Been Divided Into Parts). The Ordering Party Does Not Envisage Dividing This Order Into Parts Due To The Nature Of The Order, The Organizational And Technical Inspection Service Should Be Performed By One Contractor. Moreover, Its Size And Value Do Not Constitute An Access Barrier To Procurement For Small And Medium-Sized Enterprises. Dividing The Contract Into Parts Would Result In Excessive Costs Of Contract Execution, Among Others: Possible Restriction Of Competition (Smaller Subject Of The Contract Less Interest In The Order From Contractors Higher Price).
