The Contracting Authority Will Conclude Framework Agreements For 12 Months, With A Maximum Of 4 Economic Operators According To The Provisions Of Law 98/2016, Art. 118, Para. (1), Lit. C) In The First 6 Months Without Reoffering, And After The First 6 Months The Reoffering Will Be Done Offline (Via Email). The Framework Agreements Will Be Signed With The Economic Operators Designated Winners At The End Of The Award Procedure. The Subsequent Contracts Will Be Concluded Without The Resumption Of The Competition In The First 6 Months After The Signing Of The Framework Agreements, With The Bidder Ranked First; In The Situation Where The First Bidder Does Not Support The Bidding Conditions Presented At The Auction Or Refuses To Conclude The Subsequent Contract, He Is Obliged To Demonstrate The Impossibility Of Fulfilling The Contractual Clauses, The Contracting Authority Having The Possibility Of Concluding The Contract With The Next Ranked Bidder That Supports And Fulfills The Bidding Conditions Within The Auction , Until The Ranking Is Exhausted. If Force Majeure Is Not Proven, The Economic Operator Who No Longer Supports/Refuses To Sign The Subsequent Contract, Bears The Price Difference Between It And The Next Ranked With Which The Subsequent Contract Is Concluded, If It Causes Damage To The Contracting Authority. In The First 6 Months After Signing The Framework Agreement, The Price Of Contracts/Framework Agreements With The Inflation Index Communicated By The National Institute Of Statistics Is Not Accepted. The Price Update For Food Commodities With The Inflation Index Can Only Be Done Within The Re-Offer Process, In Order To Conclude A New Subsequent Contract. After The First 6 Months From The Signing Of The Framework Agreement, Subsequent Contracts Will Be Concluded Following A Re-Offer Procedure, The Object Of Which Is Only The Price Component. Following The Re-Bidding Procedure, A New Score Will Be Awarded For The Price Component (40%), Respecting The Calculation Algorithm And Scoring Published In The Award Documentation For This Open Tender Procedure, A Score That Will Be Added To The Score Obtained Following The Evaluation Technical Proposals, For The Technical Component (60%), Drawing Up A New Ranking. The Bidder Who Obtains The Highest Score Is The One With Whom The Next Subsequent Contract Will Be Signed. The Elements Of The Technical Component For Which Points Are Awarded (The Supply Chain And The Realization Of A Production Stage In The Western Region) Are Not Included In The Re-Bidding Procedure, The Economic Operators Participating In The Procedure Being Obliged To Keep Them For The Entire Period Of The Framework Agreement, The Points Initially Obtained And Preserved During The Re-Offering Procedure. Considering The Fluctuation Of The Number Of Persons Deprived Of Liberty For Whom The Food Products Are Purchased, The Subsequent Contracts Will Be Concluded According To The Needs Of The Unit And The Available Budget Funds. The Term Until Which The Interested Economic Operators Can Request Clarifications To The Award Documentation: Until The 15Th Day Before The Deadline For Submitting Offers. The Term In Which The Contracting Authority Will Respond Consolidated To Requests For Clarification: At The Latest On The 10Th Day Before The Deadline For Submission Of Offers.
