Development Of Pre-Hospital Medical Infrastructure, Specific Investment: I1.3 Outpatient Medical Assistance Units According To The Attached Specifications. Clarification Requests Are Submitted 10 Days Before The Deadline For Submission Of Offers. The Contracting Authority Will Respond To Requests For Clarification 10 Days Before The Deadline For Submission Of Offers, So That Bidders Have Enough Time To Prepare The Offer. Suspense Clause: The Procedure For Awarding The Public Procurement Contract Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Financing Contract, For The Project With The Title Development Of The Infrastructure Of The Integrated Outpatient Military Emergency Hospital Dr. Alexandru Augustin Sibiu Approved And Financed From Pnrr/2022/C12/Ms/I1.3/Ambulatory Medical Assistance Units, Component 12: Health Related To The National Recovery And Termination Plan Of Romania. The Maximum Estimated Term Until Which The Suspensive Clause Applies Is 31.12.2023. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Credits For This Purpose. If, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, The Contracting Authority, After Receiving The Notification Regarding The Non-Granting Of Funding, Reserves The Right To Cancel The Awarding Procedure, Provided That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Paragraph (1) Letter C) Sentence Aiia Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders In This Procedure Understand That The Contracting Authority Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To The Possible Damages That Lear Could Suffer In The Described Situation, In The Event Of The Cancellation Of The Procedure Or In The Event That They Do Not Conclude The Public Procurement Contract Due To The Lack Of Financing.
