1. The Subject Of The Contract Is The Performance Of The Task Entitled: Removal Of Asbestos And Asbestos-Containing Products From The Area Of The D bie Commune.2. The Subject Of The Order Is A Service Consisting In The Performance Of Works Related To The Collection, Transport And Disposal Of Asbestos And Asbestos-Containing Products From Real Estate Constituting Residential, Non-Residential And Farm Buildings In The D bie Commune, Owned Or Held By Third Parties. The Collection, Transport And Disposal Of Waste Containing Asbestos Is Understood As Work Related To The Collection Of Dismantled Materials As Well As Their Packaging And Protection Against Harmful Effects - Emission Into The Environment; Loading Waste Containing Asbestos And Transporting It To An Authorized Waste Landfill For Disposal, In Accordance With Applicable Legal Provisions In This Regard.3. Material Scope Of The Order: 1) Securing Waste Containing Asbestos In Accordance With Applicable Regulations; 2) Transport Of Waste Containing Asbestos Using Specialized Equipment, In Accordance With Applicable Regulations, In A Way That Prevents Contamination Of Roads And Public Utility Areas And Does Not Pose A Threat To The Environment ;3) Transfer Of Waste Containing Asbestos To A Place Where It Can Be Disposed Of - The Offer Must Indicate The Place Of Disposal And The Entrepreneur With A Waste Disposal Permit Who Will Collect Asbestos Waste From The Contractor.4. The Estimated Amount Of Asbestos And Products Containing Asbestos, I.E. Waste With Code 17 06 05* - Construction Materials Containing Asbestos, Is Approximately 200 Mg. The Indicated Quantity May Change Due To The Actual Measurement Of The Area And Weight Of The Products Removed During The Order Execution. The Final Number Of Asbestos-Containing Products To Be Removed Under The Order In Question Will Depend On The Number Of Applications Submitted By Users Of Asbestos-Containing Products And The Funds Allocated For This Task In The Budget Of The D bie Commune. The Maximum Amount Of Asbestos Waste Collected And Disposed Of Under The Subject Of The Contract May Be 200 Mg. As Of August 22, 2023, The Number Of Submitted Applications For Asbestos Removal Is 43, And The Estimated Weight Of Waste Indicated In The Applications And Scheduled For Collection Is 84.56 Mg. 5. After Signing The Contract, The Contractor Will Receive From The Ordering Party A List Of Properties From Which Asbestos And Asbestos-Containing Products Will Be Collected.6. The Contractors Obligations Also Include: 1) Organization And Security Of The Work Site, In Particular Ensuring Conditions For The Safe Removal Of Asbestos-Containing Products From Their Places Of Occurrence And Carrying Out Work Related To The Removal Of The Indicated Products In A Way That Prevents Emission Into The Environment, 2) Preparing A Report That Will Be Contained The Following Information: - Name And Surname Of The Person From Whom The Waste Will Be Collected, - Indication Of The Place Of Collection, Date Of Collection, - Type Of Waste, Amount Of Waste (In Mg), - Signature Of The Property Owner And A Statement That The Commissioned Works Were Carried Out In Compliance With The Relevant Regulations Technical And Sanitary, And The Areas Of The Real Estate Where The Works Were Carried Out Were Properly Cleaned Of Asbestos; 3) Submitting A List Of Properties From Which Asbestos Was Collected And Neutralized, Containing The Amount Of Asbestos And Asbestos-Containing Products From All Properties In The Mg And The Type Of Products Removed (E.G. Corrugated Boards, Flat Boards), 4) Documenting The Transfer Of Asbestos Waste For Disposal By Delivering Waste Transfer Cards To The Ordering Party. It Is Allowed To Prepare A Collective Asbestos-Containing Waste Transfer Card For All Properties Covered By The Order, 5) Set The Date Of Collection Of Asbestos And Asbestos-Containing Products With The Owners Of The Properties Where The Service Is To Be Provided, 6) Prepare Photo Documentation Of The Completed Task For Each Property Where Asbestos Was Removed. The Documentation Should Be Prepared In An Electronic Version On A Data Carrier (E.G. Cd).7) The Contractor Is Not Entitled To Commission Work Under This Order To Subcontractors;8) The Ordering Party Will Record The Acceptance Of The Services Performed.7. The Contractor Bears Full Liability For Accidents, As Well As For The Destruction Of Private Property And Legal Persons Caused By His Action Or Omission, Related To The Implementation Of This Order.8. The Subject Of The Contract Must Be Performed In Accordance With Applicable Regulations, Including: 1) The Act Of 14 December 2012 On Waste (Journal Of Laws Of 2022, Item 699, As Amended); 2) The Regulation Of The Minister Of Economy, Labor And Social Policy Of 2 April 2004 On The Methods And Conditions Of Safe Use And Removal Of Asbestos-Containing Products (Journal Of Laws Of 2004, No. 71, Item 649, As Amended);3) Regulation Of The Minister Of Economy And Labor Of 14 October 2005 On The Principles Of Occupational Health And Safety When Securing And Removing Asbestos-Containing Products And The Training Program In The Safe Use Of Such Products (Journal Of Laws Of 2005, No. 216, Item 1824 );4) Regulation Of The Minister Of Economy Of 13 December 2010 On The Requirements For The Use Of Asbestos-Containing Products And The Use And Cleaning Of Installations Or Devices In Which Asbestos-Containing Products Have Been Or Are Used (Journal Of Laws Of 2011, No. 216, Item 1824).
