Tenders Are Invited For Delivery Of Gaseous Fuel Together With The Provision Of Distribution Services To The Facilities Of The Medical University Of Warsaw, Case Number: Aez/S-139/2023
1. The Subject Of This Order Is The Supply Of Natural Gas, High-Methane E, According To Tariff Groups W-1.2, W-2.2 And W-5.1, And The Provision Of Distribution Services (Comprehensive Agreement) To The Employers Facilities, Specified As To The Location, Collection Points And Forecasted Fuel Consumption In Appendix No. 1 To The Swz, Within 12 Months, Under The Conditions Set Out In The Draft Agreement, The Template Of Which Is Appendix No. 8 To The Swz.2. The Expected Amount Of Natural Gas Over The Period Of 12 Months Is 324,445 Kwh, In Accordance With The Calculation Of The Forecasted Gas Consumption Made In Appendix 1 (List Of Withdrawal Points And Projected Gas Fuel Consumption) And Appendix 3.1 And 3.2 To The Tor (Price Form). 3. Gas Will Be Supplied Under The Agreement, The Draft Of Which Constitutes Appendix No. 8 To The Tor And Will Be Performed In Accordance With The Provisions Of The Energy Law Act Of April 10, 1997 (I.E. Journal Of Laws Of 2022, Item 1385 Of As Amended), The Civil Code (Consolidated Text: Journal Of Laws Of 2023, Item 1610) And The Implementing Regulations Issued On Their Basis.4. Pursuant To The Provisions Of 1 Sec. 2 Of The Draft Agreement, The Ordering Party Reserves The Right To Limit The Subject Of The Agreement, In Terms Of Quantity, To 80% Of The Total Forecast Volume Of Gaseous Fuel Sales, Specified In 1 Section 1. In Such A Case, The Contractor Shall Not Be Entitled To Any Claim For Non-Use Of The Forecast Amount Of Gaseous Fuel, Subject To The Provisions Of 12 (Remuneration Indexation) And With The Reservation That The Final Settlement Will Depend On The Actual Consumption Of Gaseous Fuel Specified In The Contractors Offer ( 8 Section 1 Of The Draft Agreement), And Subject To Section 5.5. If, Pursuant To An Act Of Generally Applicable Law, The Maximum Price Of Gaseous Fuels Or The Maximum Rate Of Any Fees Related To The Implementation Of The Agreement, Including Fees For The Provision Of Gaseous Fuel Distribution Services, Apply In The Settlements For That Period, The Prices And Fees Not Higher Than The Price Rates And Maximum Fees. This Provision Applies Directly, I.E. Without The Need To Change The Contract In The Form Of A Written Annex.
